I'D LIKE TO WELCOME OUR CITY MANAGER, OUR CITY CLERK AND OUR CITY ATTORNEY.

AND THANK YOU, AS ALWAYS TO CITY STAFF FOR BEING HERE IN ATTENDANCE TO ANSWER ANY QUESTIONS OUR CITIZENS MAY HAVE HERE WITH US TODAY.

A REMINDER TO TURN OFF ANY CELL PHONES OR ELECTRONIC DEVICES THAT MAY DISRUPT OUR MEETING TODAY.

LORD, WE'RE EXPERIENCING A GREAT TIME OF YEAR WITH THE CHANGE OF WEATHER AND THE COOLNESS AND THE FRESHNESS.

AND I JUST PRAY THAT THAT WOULD CONTINUE IN THIS CHAMBER.

GOD GUIDE THE DECISIONS, BRING THIS GROUP AND ALL THE CITY TOGETHER AS WE CONTINUE TO MOVE FORWARD.

WE'RE GOING TO BEGIN WITH A FEW PROCLAMATIONS, BEGINNING WITH THE LATINO HERITAGE MONTH, FOLLOWED BY OUR CONSTITUTION WEEK.

SO I'D LIKE TO INVITE ANY OF YOU WHO ARE HERE FOR LATINO HERITAGE MONTH TO JOIN ME UP HERE AT THE DAIS.

THANK YOU. WHEREAS LATINOS ARE THE SCIENTISTS AND ENGINEERS REVOLUTIONIZING OUR WAYS OF LIFE AND MAKING DISCOVERIES TO IMPROVE THEM.

THE ADVOCATES LEADING THE WAY FOR SOCIAL AND POLITICAL CHANGE, THE FARMERS WORKING EVERY DAY TO CONTRIBUTE TO IOWA'S ECONOMY, THE PROFESSIONALS RESPONDING TO THE MENTAL HEALTH NEEDS OF OUR COMMUNITIES.

THEY ARE THE TEACHERS THAT EDUCATE OUR YOUTH.

THEY ARE THE BRAVE MEN AND WOMEN IN UNIFORM WHO DEFEND OUR MOST CHERISHED IDEALS AT HOME AND ABROAD.

AND. WHEREAS, THE CEDAR RAPIDS LATINO COMMUNITY HAS THE SAME DREAMS, VALUES, TRIALS AND TRIUMPHS OF PEOPLE IN EVERY CORNER OF OUR NATION, AND THEY SHOW THE SAME GRIT AND DETERMINATION THAT HAS CARRIED THIS COMMUNITY FORWARD FOR CENTURIES.

AND WHEREAS, WE RECOGNIZE THAT THIS COUNTRY'S REMARKABLE STORY BEGAN WITH IMMIGRATION, THE CITY OF CEDAR RAPIDS CONTINUES TO SEEK WAYS TO MAKE THE PROMISE OF OUR NATION REAL AND THE LIVES OF ALL PEOPLE, INCLUDING THOSE WHO ARE AMERICANS IN EVERY WAY EXCEPT FOR A PIECE OF PAPER.

WE AFFIRM THAT DIVERSITY AND MORE IMPORTANTLY, INCLUSION IS THE KEY TO MOVING FORWARD IN ACHIEVING A BETTER AND BRIGHTER FUTURE.

AND WHEREAS, WE ALSO RECOGNIZE ALL LATINOS THAT CONTINUOUSLY HELP OUR COMMUNITY THROUGH THE DIFFICULTIES CREATED BY CLIMATE CHANGE AND ALL THOSE LATINOS AND LATINAS WHO ORGANIZE THEMSELVES IN NONPROFITS TO ADVANCE INCLUSION AND DIVERSITY, AND ALL THOSE LATINOS AND LATINAS WHO SERVE IN THE US ARMED FORCES DEFEND OUR FREEDOM, EARNING MEDALS OF HONOR AND OTHER DISTINGUISHED MILITARY DECORATIONS FOR THEIR LEADERSHIP, COURAGE AND PATRIOTISM.

NOW, THEREFORE, I TIFFANY O'DONNELL, MAYOR OF CEDAR RAPIDS, IOWA, ALONGSIDE OUR CITY COUNCIL, DO HEREBY RECOGNIZE THAT SEPTEMBER 15TH THROUGH OCTOBER 15TH IS LATINO HERITAGE MONTH AND ENCOURAGE RESIDENTS.

I ENCOURAGE OUR RESIDENTS TO CELEBRATE LATINO HERITAGE MONTH AND CALL THIS OBSERVANCE TO THE ATTENTION OF ALL BECAUSE DIVERSITY, INCLUSION AND EQUITY ARE THE KEYS TO MOVING FORWARD AND ACHIEVING A BRIGHTER FUTURE FOR EVERYONE.

COME AND SEE THE DIVERSITY WITHIN THE HISPANIC COMMUNITY.

COME AND SEE IF HISPANICS AND LATINOS ARE THE SAME THING OR JUST TERMS THAT WE DON'T COMPREHEND.

PLEASE COME AND SEE THAT THERE ARE SOME OF US THAT HAVE BEEN IN THIS COUNTRY FOR 40 YEARS.

OTHERS THAT HAVE BEEN BORN HERE.

THAT SOME OF US ARE BILINGUAL.

OTHERS, EVEN THOUGH THEY WERE BORN HERE, ARE NOT.

PLEASE COME AND SEE AND UNDERSTAND THAT DIVERSITY AND HOPEFULLY TALK TO SOME OF US AND UNDERSTAND THE BENEFITS OF BEING BILINGUAL OR THE STRUGGLES OF BEING HISPANIC AND NOT BEING BILINGUAL.

IT CANNOT BE A GOOD MEETING WITHOUT A CHALLENGE TO LEARN SOMETHING ABOUT HISPANICS IN IOWA DURING THIS MONTH OF THE HISPANIC HERITAGE MONTH.

THERE IS A KID OUT OF WEST LIBERTY, CHUY RENTERIA.

AND I SHOULD STOP CALLING HIM A KID.

HE'S 36 YEARS OLD, AS MY SON IS.

THEY BOTH GREW UP AT THE SAME TIME, BUT IN TWO COMPLETELY DIFFERENT UNIVERSES.

ONE IN WEST LIBERTY, WHERE SPEAKING SPANISH WAS NOT WELL SEEN.

THEREFORE, HE DOESN'T SPEAK SPANISH.

BUT HE IS A WONDERFUL WRITER.

AND ANOTHER KID, MY SON, WHO GREW UP IN CEDAR RAPIDS IN A BILINGUAL FAMILY AND LEARNED THE VALUE OF BEING BILINGUAL.

TWO COMPLETELY DIFFERENT UNIVERSES 20, 30 MILES APART.

I INVITE YOU, PLEASE.

AND I DO NOT KNOW CHUY, AND I'M NOT TRYING TO SELL THE BOOK, BUT I INVITE YOU DURING THIS MONTH AT LEAST READ THE FIRST PAGES OF THE PREFACE AND LEARN WHAT IOWANS HISPANIC IOWANS GO THROUGH.

IT'S A LONG WAY. WHEREAS THE TRADITION OF CELEBRATING THE CONSTITUTION WAS STARTED MANY YEARS AGO BY THE DAUGHTERS OF THE AMERICAN REVOLUTION, THE DAR.

AND WHEREAS, IN 1955, THE DAUGHTERS PETITIONED CONGRESS TO SET ASIDE SEPTEMBER 17TH THROUGH 23RD ANNUALLY TO BE DEDICATED FOR THE OBSERVANCE OF CONSTITUTION WEEK, WHICH WAS LATER ADOPTED BY THE UNITED STATES CONGRESS AND SIGNED INTO PUBLIC LAW NUMBER 915 ON AUGUST 2ND, 1956, BY PRESIDENT DWIGHT D EISENHOWER.

AND WHEREAS, THE AIM OF THE CELEBRATION IS TO, ONE, EMPHASIZE CITIZENS RESPONSIBILITIES FOR PROTECTING AND DEFENDING THE CONSTITUTION, PRESERVING IT FOR POSTERITY, TO INFORM THE PEOPLE THAT THE CONSTITUTION IS THE BASIS FOR AMERICA'S GREAT HERITAGE AND THE FOUNDATION FOR OUR WAY OF LIFE.

AND THREE ENCOURAGE THE STUDY OF THE HISTORICAL EVENTS THAT LED TO THE FRAMING OF THE CONSTITUTION ON SEPTEMBER 1787.

AND WHEREAS, THE UNITED STATES OF AMERICA FUNCTIONS AS A REPUBLIC UNDER THE CONSTITUTION, WHICH IS THE OLDEST DOCUMENT STILL ACTIVE IN USE THAT OUTLINES THE SELF GOVERNMENT OF A PEOPLE. AND WHEREAS, TODAY THE CONSTITUTION STANDS AS AN ICON OF FREEDOM FOR PEOPLE AROUND THE WORLD.

NOW, THEREFORE, I TIFFANY O'DONNELL, MAYOR OF CEDAR RAPIDS, IOWA, ALONGSIDE OUR CITY COUNCIL, DO HEREBY PROCLAIM SEPTEMBER 17TH THROUGH 23RD, 2023 AS CONSTITUTION WEEK IN THE COMMUNITY AND ENCOURAGE ALL CITIZENS TO TAKE TIME THROUGHOUT THIS WEEK TO REFLECT ON OUR HERITAGE OF FREEDOM.

IT'S SCARY TO THINK WHAT OUR COUNTRY WOULD BE WITHOUT THE CONSTITUTION.

RECENTLY IN THE NEWS I'M HEARING ABOUT THINGS UNCONSTITUTIONAL OR CONSTITUTIONAL OR WHAT PEOPLE'S RIGHTS ARE.

AND I THINK IT'S ONLY FITTING THAT WE PAY TRIBUTE TO THE DOCUMENT THAT WAS WRITTEN SO MANY YEARS AGO, AND WE STILL LIVE BY IT.

TODAY I'D LIKE TO PROVIDE AN UPDATE, A PROJECT UPDATE ON THE FORMER COLONIAL BUILDING NOW KNOWN AS THE HEIGHTS.

SO THE PURPOSE OF THIS PUBLIC HEARING IS TO PROVIDE ACCOMPLISHMENTS TO DATE, PROVIDE, PROVIDE EXPENDITURES TO DATE, ANY REMAINING WORK TO BE COMPLETED IN ANY CHANGES ON THE PROJECT. SO TO DATE, WE HAVE PURCHASED THE BLIGHTED VACANT BUILDING AT 1500 SECOND AVENUE SOUTHEAST.

WE SELECTED AN ARCHITECT WHO COMPLETED THE RENOVATION PLANS.

WE SELECTED A GENERAL CONTRACTOR WHO IS UNDER CONTRACT AND NOW COMPLETING THE WORK.

WE COMPLETED OUR INTERIOR DEMOLITION OF THE BUILDING.

SO REMOVING ALL OF THOSE INTERIOR WALLS, MOLD, ASBESTOS, THINGS OF THAT NATURE, AND THEN THE INTERIOR FRAMING IS UNDERWAY AND EXTERIOR REPAIRS ARE UNDERWAY.

SO IF YOU'VE DRIVEN PAST THE BUILDING, YOU WILL SEE THAT ALL OF THOSE THINGS ARE HAPPENING.

SO EXPENDITURES TO DATE, THERE ARE FOUR DIFFERENT FUNDING SOURCES FOR THIS PROJECT.

WE HAVE OUR STATE CDBG-CV FUNDING, OUR CITY ENTITLEMENT, CDBG FUNDING, OUR HOME ARP FUNDING AND THE ARPA FUNDING AWARDED THROUGH THE CITY.

OUR TOTAL PROJECT BUDGET CAME IN AT 6.9 MILLION AND TOTAL EXPENDITURES TO DATE ARE 2.8 MILLION.

AND OF ALL OF THAT FUNDING SO FAR, $370,000 OF CDBG-CV FUNDS HAVE BEEN EXPENDED.

SO REMAINING WORK TO COMPLETE THE WE HAVE COMPLETED THE EXTERIOR BRICK REPLACEMENT WINDOW DOOR INSTALLATION.

SO THOSE THINGS ARE HAPPENING PROBABLY ABOUT 90% COMPLETE WITH THOSE ITEMS. INTERIOR FINISHES, INCLUDING THE PLUMBING, ELECTRICAL AND MECHANICAL SYSTEMS ARE BEING COMPLETED.

AFTER THAT, THE EXTERIOR LANDSCAPING AND PARKING, RESURFACING AND FENCING WILL BE COMPLETED.

AND LASTLY, THE INSTALLATION OF A GENERATOR ON THE PROPERTY.

PROJECT CHANGES.

THE BUDGET HAS INCREASED BY APPROXIMATELY $500,000.

THIS WAS DUE TO BUILDING RENOVATION UNKNOWNS SUCH AS THE EXTERIOR BRICK NEEDING TO BE REPLACED DUE TO THE SHEETING ON THE EXTERIOR WAS MUCH MORE WATER DAMAGE THAN WHAT WE HAD ANTICIPATED AND NOT OBVIOUSLY WITH THE CITY OWNING THIS BUILDING AND RENOVATING IT, WE WANTED TO ENSURE THAT THE BUILDING WILL LAST FOR A VERY LONG TIME.

AND SO THAT WAS SOMETHING THAT WE DECIDED TO DO RATHER THAN DOING SMALL REPAIRS, WE WANTED TO MAKE SURE THAT WE REPLACED IT AND IT WAS IN VERY GOOD CONDITION.

AND ALL OF THIS FUNDING IS WITHIN THE PROJECT CONTINGENCY.

AND SO BECAUSE OF THOSE CHANGES, THE TIMELINE DID GET PUSHED A MONTH.

SO MARCH OF 2024 IS WHEN WE ANTICIPATE TURNING THIS OVER TO A NONPROFIT.

AND SO, AGAIN, THIS PUBLIC HEARING WAS JUST TO REVIEW THE STATUS OF THIS FUNDED ACTIVITY AND PROVIDE AN OPPORTUNITY FOR THE PUBLIC TO GIVE ANY TYPE OF FEEDBACK ON THE PROJECT, THE ACCOMPLISHMENTS, EXPENDITURES, REMAINING WORK AND ANY ACTIVITY CHANGES.

AND I'M HAPPY TO ANSWER ANY QUESTIONS.

COULD YOU JUST QUICKLY, FOR THE PEOPLE IN THE AUDIENCE AND ARE WATCHING US, JUST GIVE A QUICK OVERVIEW OF THE UNITS THAT WILL HAVE THE SERVICES THAT WILL BE IN THE BUILDING AND AND WE CALL IT AFFORDABLE.

YOU KNOW, GIVE US A FEEL FOR WHAT THAT MEANS IN RENTAL TERMS OR HOWEVER.

WOULD YOU MIND DOING THAT? SURE.

SO THERE'S 25 TOTAL UNITS IN THE BUILDING AND SIX OF THOSE UNITS WILL BE FULLY ADA ACCESSIBLE, WHICH IS FOR FOUR ADDITIONAL UNITS IN COMPARISON TO WHAT WOULD NORMALLY BE REQUIRED BY CODE.

AND THEN SO THIS WILL GO OUT FOR AN RFP OR REQUEST FOR PROPOSAL PROJECT HERE IN THE NEXT PROBABLY 2 TO 3 WEEKS.

WE'RE WORKING THROUGH THAT WITH PURCHASING RIGHT NOW FOR TO FIND A NONPROFIT TO OWN AND OPERATE THIS BUILDING TO SERVE AS AFFORDABLE HOUSING.

AND THROUGH THAT PROCESS, WE WILL ALLOW THOSE NONPROFITS TO TELL US WHO THEY INTEND TO SERVE.

OBVIOUSLY, THERE ARE SOME FUNDING REQUIREMENTS AND INCOME REQUIREMENTS OF WHO WOULD BE ALLOWED BECAUSE IT IS LOWER RENT TO MAKE IT AFFORDABLE.

SO 60% OF THE AREA MEDIAN INCOME TO 80% AREA MEDIAN INCOME BECAUSE THERE ARE TWO DIFFERENT FUNDING SOURCES THERE THAT HAVE THOSE REQUIREMENTS.

BUT WE'RE HOPING THAT A NONPROFIT WILL COME IN WITH A REQUEST THAT WILL BE LOWER THAN THAT AND BE ABLE TO SERVE SOME OF THOSE.

BUT WE ALSO KNOW THAT THAT'S A BALANCE WITH THE FUNDING SOURCES AND BEING ABLE TO FUND, CONTINUING TO HAVE FUNDING WHEN THEY THROUGH THEIR BUDGET, TO BE ABLE TO ALLOW FOR MAYBE SOME OF THE LOWER INCOME UNITS AND THEN SOME OF THE HIGHER INCOME UNITS.

SO WE'LL JUST LOOK FORWARD TO GOING THROUGH THAT PROCESS AND WE'LL OBVIOUSLY BE BRINGING THAT BACK TO CITY COUNCIL FOR CONSIDERATION IN THE FUTURE.

AND THEN DON'T WE HAVE A LEVEL WHERE WE'RE HAVING STAFFING FOR SERVICES THAT'S PART OF THE RFP THAT YOU'RE GOING OUT FOR OR? IT COULD BE. YES. IT'S NOT A REQUIREMENT OF THE GRANT, BUT IT COULD BE.

IT'S NOT A REQUIREMENT. BUT IT COULD BE.

THERE WAS ORIGINALLY A 20 FOOT WIDE EMERGENCY ACCESS EASEMENT OFF OF [INAUDIBLE] AVENUE SOUTHWEST.

AND AS THE FIRST HAVE FIRST AND FIRST PROJECT HAS PLAYED OUT, THE PLACEMENT OF THAT EXISTING EASEMENT CONFLICTS WITH THE DEVELOPMENT.

SO THE REQUEST IS TO VACATE THIS EASEMENT AND THEN RELOCATE IT OFF OF THIRD STREET SOUTHWEST.

IT WILL COORDINATE WITH THE CURRENT DEVELOPMENT, THE PROPOSED HOTEL STRUCTURE THAT'S SHOWN ON THE DRAWING AS WELL AS THE PROPOSED PARKING RAMP.

AND THEN THIS WILL ALLOW FOR THE PUBLIC TO GET TO THE OPEN SPACE THAT'S ADJACENT TO THOSE TWO LOCATIONS.

THIS FIFTH PACKAGE IS FOR MCCLOUD RUN FROM J AVENUE TO WERNER AVENUE, AND 75% OF THE FUNDING IS COMING FROM NATURAL RESOURCE CONSERVATION SERVICE GRANT, WITH 25% FROM THE CITY.

AND THE INTENT IS TO RESTORE CONVEYANCE CAPACITY IN THE DRAINAGE WAYS BY REMOVING THE DERECHO DEBRIS.

HERE'S A MAP OF THE SPECIFIC LOCATIONS ALONG MCCLOUD RUN FOR THIS PACKAGE.

ENGINEER'S OPINION OF PROBABLE COST IS $510,000.

THE BID LETTING IS SCHEDULED FOR SEPTEMBER 20TH.

WE EXPECT THE PROJECT WOULD BE DONE BY JULY.

THERE WILL BE SOME TEMPORARY DETOURING OF THE CEDAR VALLEY NATURE TRAIL ONTO CENTER POINT ROAD.

THE CONTRACTOR IS RESPONSIBLE FOR PROTECTING THE EXISTING TRAIL AND MAKING SURE IT'S NOT DAMAGED, REPAIRING ANY DAMAGES THAT HAPPEN.

WE ALSO HAVE TEMPORARY LANE CLOSURES AT MADISON STREET AND NORTHBOUND I-380 EXIT AT 29TH STREET, AND THAT'S TO ALLOW EQUIPMENT, ACCESS AND EQUIPMENT STAGING.

THE DETOUR WOULD SEND BIKE TRAFFIC TO THE EAST ALONG CENTER POINT ROAD FOR AT LEAST A MAJORITY OF THAT AREA.

THERE IS AN EXISTING BIKE LANE THERE THAT COULD BE UTILIZED AND THAT'S BEEN COORDINATED WITH OUR TRAFFIC TEAM PUBLIC WORKS. SO WE'RE GOING TO HAVE TO DO A PRETTY GOOD COMMUNICATION PLAN WITH THIS BECAUSE IT'S GOING TO BE FOUR MONTHS, APRIL TO JULY.

AND I KNOW THAT LIKE EVEN UP ON 42ND STREET, THAT GETS A LITTLE HAIRY UP THERE WITH THE TRACKS.

AND SO I WOULD JUST SAY THAT TRAFFIC SHOULD DO A REALLY EXTENSIVE COMMUNICATION PLAN TO THE USERS OF THE TRAIL.

THE UTILITIES DEPARTMENT IS LOOKING TO REPLACE PORTIONS OF THE AIR CONDITIONING SYSTEM LOCATED AT THE WATER ADMINISTRATION BUILDING ON SHAVER ROAD, NORTHEAST THAT HAVE REACHED THE END OF THEIR SERVICE LIFE.

THE PROJECT WILL INVOLVE REPLACEMENT OF THE EXTERIOR CONDENSING UNIT COOLING COIL INSIDE THE AIR HANDLING UNIT, REFRIGERANT PIPING AND ASSOCIATED ELECTRICAL COMPONENTS.

THE EXISTING SYSTEM IS 20 YEARS OLD, HAS EXPERIENCED MULTIPLE FAILURES IN RECENT YEARS AND OPERATES ON REFRIGERANT R 22, WHICH IS NO LONGER COMMERCIALLY AVAILABLE. A 2021 STUDY OF THE COOLING CAPACITY INDICATED THAT THE EXISTING SYSTEM IS UNDERSIZED AND ADDITIONAL CAPACITY IS

WITH THAT BEING SAID, I HAVE CONCERNS ABOUT NOISE AND LIGHT POLLUTION AS WELL AS THE DRAINAGE ISSUES IN REGARDS TO THEIR INTENDED LAND USE.

IT DOESN'T FIT IN THE CHARACTER OF THE NEIGHBORHOOD WHICH ZONING DICTATES IT SHOULD THAT IT'S ZONED UNDER.

THERE HAS BEEN EXTREMELY NOTICEABLE INCREASE TO SOUND AND LIGHT POLLUTION COMING FROM THE CLUB COURT'S POSITION ROUGHLY 300FT AWAY FROM MY PROPERTY. SINCE THE HOMES ON FAIRWAY TARIFFS HAVE BEEN DEMOLISHED.

WHILE IN MY YARD I CAN HEAR CONVERSATION COMING FROM THE COURT AS WELL AS THE SOUND OF TENNIS AND PICKLEBALL BEING PLAYED.

AND THE LIGHT POLLUTION IS MORE AND MORE NOTICEABLE TOO.

SO THAT'S WHY I'M AGAINST LIGHTING UNDER THE TENNIS COURTS.

I AM CONCERNED ABOUT HOW IT WILL GROW EXPONENTIALLY WITH THE NEW COURTS BEING LIT AND CLOSER TO THE HOUSE ON THE TRIANGLE.

I AM ALSO CONCERNED ABOUT HOW THE PARKING SPACES ON THE WEST SIDE OF THE COURTS WILL BE ADDED NOISE AND LIGHT POLLUTION.

THE NEED TO ERADICATE THESE PARKING SPOTS HAVE BEEN BROUGHT UP PRIOR HERE AND AT THE NEIGHBORHOOD MEETING.

THERE IS NO NEED FOR THESE SPOTS.

AT THE NEIGHBORHOOD MEETING, IT WAS BROUGHT UP THAT FOR LARGER SPECIAL EVENTS THE PARKING MIGHT BE MOVED TO GRASSY AREA, BUT THAT WOULD NOT BE THE NORM.

JUST AN EXCEPTION WITH PARKING WAS THE MAXIMUM LIKE ON THE JULY 4TH EVENTS THAT THEY HAVE THERE.

ALSO EXHIBIT B, PAGE 348 SHOWS MY PROPERTY HAVING AT LEAST A HALF DOZEN FULL GROWN TREES WITH WOULD THINK HELP WITH THE SCREENING.

UNFORTUNATELY, THE RENDERING IS NOT CORRECT AND AS WE DO NOT HAVE FULL GROWN TREES LIKE ON THE PROPERTIES THAT THEY SHOW, IT WILL TAKE 50 YEARS FOR THIS TO HAPPEN.

I'VE ALSO NOTICED THE WATER RUNOFF INCREASE SINCE THE FAIRWAY TERRACE HOMES WERE TAKEN DOWN AND I WOULD LIKE THE INFORMATION ON WHAT PLAN IS IN PLACE FOR THE ISSUE, AS NONE HAVE BEEN FORTHCOMING FROM THE ARCHITECT, THE CLUB, EVEN FROM SETH'S WHO REPRESENTS THE CITY.

IT HAS BEEN REZONED AND WATER IS NOT BEING RETAINED LIKE ZONING STIPULATES, JUST LIKE THE BUBBLE DOESN'T MEET THE ZONING REQUIREMENTS SET FORTH BY NEW

I ASKED THAT WHATEVER IS PUT IN OUTDOOR COURTS, INDOOR FACILITY PAVILIONS, PARKING ACCESS ROAD, THAT AT A MINIMUM IT BE WHAT IT WAS IN LAST YEAR'S APPROVAL THAT YOU GUYS MADE 28.8 FEET FROM MY PROPERTY LINE.

NEIGHBORS NEXT TO WALMART GET MORE CONCESSION IN REGARDS TO PARKING AND HOW FAR AWAY IT IS FROM THEM COMPARED TO WHAT WE'RE GETTING IN THE COUNTRY CLUB HEIGHTS NEIGHBORHOOD.

I KNOW IN MY RECENT CONVERSATION WITH THE CLUB MANAGER, TOM FELLER, WE HAVE DISCUSSED HAVING THE CLUB INSTALL THE PRIVACY FENCING AWAY FROM THE [INAUDIBLE] AND I APPRECIATE THAT.

I CAN ONLY PUT UP A SIX FOOT FENCE.

THEY CAN PUT UP A 7 OR 8 FOOT FENCE BECAUSE OF THEIR NEW ZONING.

I ASKED THEM TO PUT IT UP AS HIGH AS THEY POSSIBLY CAN BECAUSE TO ELIMINATE ANY OF THE LIGHTING.

THAT SEEMED VERY SURPRISING TO ME AND MADE ME WANT TO READ ABOUT THE EXISTING POLICY THAT GOVERNS THIS COUNCIL.

AND GUESS WHAT? IT'S REALLY HARD TO FIND THAT.

IT'S READILY NOT AVAILABLE ONLINE.

AND I WOULD JUST ASK, WHERE CAN THIS POLICY BE FOUND?

AS I SAID, THE CITY DOES NOT MAKE THE RULES OF ETHICS EASILY AVAILABLE, AND I CAN BE SURE, NO MATTER HOW NARROW OUR ETHICS RULES ARE IN CEDAR RAPIDS, ALLOWING PEOPLE THAT ARE THE OWNERS OF THE PROPERTY MAKING THEIR REQUESTS TO THE CITY VOTE ON A MEASURE THAT IS ABSOLUTELY 100%, WITHOUT A DOUBT, A GLARING AND EMBARRASSING CONFLICT OF INTEREST.

AS A FORMER MEMBER OF THE CEDAR RAPIDS COUNTRY CLUB AND OTHER PRIVATE CLUBS, I AM VERY FAMILIAR WITH HOW A PRIVATE CLUB WORKS AND IS FUNDED.

AND I CAN TELL YOU THERE IS NO DOUBT THAT THE APPROVAL OF BOTH A TENNIS FACILITY AND ONE THAT IS CONSIDERABLY CHEAPER THAN THE ONE THAT WAS APPROVED A YEAR AGO WILL PRODUCE BOTH FINANCIAL AND REPUTATIONAL BENEFITS TO THE CLUB AND ITS MEMBERS, WHO ARE THE ULTIMATE BENEFICIAL OWNERS OF THE CLUB BY GENERATING MORE REVENUES, COSTING LESS TO BUILD, AND ALL THE POSITIVE THINGS THAT GO ALONG WITH IT.

A BRICK AND MORTAR THAT WAS PROPOSED AND APPROVED LAST YEAR WAS, FROM WHAT I WAS TOLD, IS $7.4 MILLION DOLLARS VERSUS A BUBBLE.

THIS AND I'M GUESSTIMATING THIS I DON'T KNOW THIS FOR SURE, BUT LET'S SAY THE BUBBLE IS $1 MILLION DOLLARS.

SO AS A MEMBER OF THE COUNTRY CLUB, YOU'LL BE ASSESSED FOR THIS PROJECT, YOUR MONTHLY DUES.

OR YOU'LL BE ASSESSED FOR THIS PROJECT OR A COMBINATION OF BOTH.

THE COUNTRY CLUB IS REPRESENTED THROUGH VARIOUS PEOPLE AT VARIOUS DIFFERENT PUBLIC MEETINGS THAT THE INDOOR TENNIS STRUCTURE IS THE CULMINATION OF AND AGAIN, IT DEPENDS ON WHO IS SPEAKING A 10, A 20 OR A 20 PLUS YEAR PROJECT TO BRING THIS, YOU KNOW, TO CULMINATION. AFTER THE APPROVAL OF THE 2022 ORDINANCE, WHICH HAS THE BRICK AND MORTAR INDOOR TENNIS FACILITY, THE COUNTRY CLUB MEMBERS VOTED NOT TO BUILD THE APPROVED STRUCTURE BECAUSE OF THE FINANCIAL COST AND THE ACCOMPANYING ASSESSMENTS AND OR INCREASED DUES THAT WOULD BE LEVIED AGAINST THE CLUB MEMBERS. IN RESPONSE THE COUNTRY CLUB PROPOSED THE LEAST EXPENSIVE OF THE THREE TYPES OF TENNIS FACILITIES, INDOOR TENNIS FACILITIES THAT WE HAVE IN CEDAR RAPIDS. WE HAVE ELM CREST WITH ITS BUBBLE.

WE HAVE WESTFIELD, WHICH THE INDUSTRIAL LOOK, AND WE HAVE COE COLLEGE, WHICH HAS KIND OF A COMBINATION OF A BRICK AND MAYBE INDUSTRIAL LOOK, I'M NOT SURE HOW I WOULD DESCRIBE THAT.

IT APPEARS WHILE THAT THIS HAS BEEN A 10 TO 20 YEAR PROJECT, THE COUNTRY CLUB DID NOT MAKE ANY PROVISION FOR SINKING

AND THE COUNTRY CLUB'S PROPOSAL NEGATIVELY IMPACTS THE CITIZENS OF CEDAR RAPIDS AND THE IMMEDIATE NEIGHBORS OF THE COUNTRY CLUB BECAUSE OF THEIR LACK OF FINANCIAL PLANNING.

THE CITY COUNCIL'S PRIOR VOTES ON THE FIRST AND SECOND READING AND I'M MAKING AN ASSUMPTION THAT IT'S GOING TO PASS TODAY, REWARDS THE COUNTRY CLUB FOR ITS FAILURE TO PLAN TO THE DETRIMENT OF THE CITIZENS OF CEDAR RAPIDS AND TO THE NEIGHBORS OF THE COUNTRY CLUB.

WITH REGARD TO CONFLICT OF INTEREST, I UNDERSTAND THAT THE CITY CHARTER WAS AMENDED RECENTLY TO DEFINE CONFLICT OF INTEREST AS PERSONAL FINANCIAL GAIN. AND THIS IS AN UNCOMFORTABLE TOPIC TO DISCUSS.

IT'S HARD, AND BUT IT'S SOMETHING THAT WE SHOULD BE TALKING ABOUT IN THIS PUBLIC FORUM.

IN MY OPINION, WE TOOK A GIANT STEP BACKWARDS BY NARROWLY DEFINING CONFLICT OF INTEREST AS A PERSONAL FINANCIAL GAIN.

SO THIS PROJECT WILL PAVE WITH CONCRETE FROM EARHART BACK TO SIXTH STREET.

THE THE PROJECT SCHEDULE IS TO GET AHEAD OF THE IOWA DOT CITY INTERCHANGE PROJECT THAT WILL BE BIDDING NEXT YEAR.

SO SCHEDULE ON THIS PROJECT IS POSSIBLY TO START THIS FALL.

IT'S UP TO THE CONTRACTOR BUT BE COMPLETED BEFORE THE PROJECT AT THE DOT IS LET NEXT JULY.

THIS PROJECT ALSO INCLUDES A WATER MAIN LOOP WHICH COMES DOWN EARHART LANE WILL BORE UNDERNEATH 380 AND CONNECT BACK TO SIXTH STREET.

THIS WILL PROVIDE THE WATER DEPARTMENT SOME REDUNDANCY WITHIN THEIR SYSTEM AND ALSO BETTER MAINTENANCE WITH THAT.

SO THERE'S TWO MAIN PARTS TO THIS PROJECT, THE PAVING AND THE WATER MAIN.

WE RECEIVED 11 BIDS ON SEPTEMBER 6TH.

THE BIDS RANGED FROM $1,494,831.41 TO $2,294,458.60. THIS IS A LARGE NUMBER OF BIDDERS.

TYPICALLY, WE DON'T SEE OVER TEN BIDDERS ON PROJECTS, AND THIS IS DUE TO THE FAVORABLE WEATHER CONDITIONS WE'VE SEEN THIS SUMMER.

AND SO THESE CONTRACTORS ARE RUNNING LOW ON WORK.

SO WE GOT EXTREMELY GOOD BIDS ON THIS PROJECT, AS YOU CAN SEE.

THE ALLIANT COMMUNITY SOLAR GARDEN OFFERS 18,000 BLOCKS OF 250 WATT SOLAR PANELS AVAILABLE FOR CUSTOMERS TO PURCHASE.

HOW IT WORKS IS THAT CUSTOMERS HAVE THE OPTION OF PURCHASING BLOCKS OF SOLAR TO COVER THEIR ENERGY USE.

ENERGY IS THEN DELIVERED TO THE GRID.

RENEWABLE ENERGY IS USED TO POWER THE CEDAR RAPIDS COMMUNITY, AND THEN CUSTOMERS RECEIVE A BILL CREDIT BASED ON SOLAR PRODUCTION.

PARTICIPATING IN THE COMMUNITY SOLAR GARDEN PROGRAM SUPPORTS TWO COUNCIL ADOPTED PLANS FIRST ENVISION CR BE STEWARDS FOR THE ENVIRONMENT, PROMOTING AN ECONOMIC AND SOCIAL GROWTH, WHILE RESTORING THE RELATIONSHIP BETWEEN THE CITY AND THE NATURAL ENVIRONMENT AND THE COMMUNITY CLIMATE ACTION PLAN.

GOAL AREA CARBON FREE OBJECTIVE ONE BE INCREASED RENEWABLES TO 70 TO 100% ELECTRICITY BY 2050 AND SPECIFICALLY ACTION TEN SUPPORT LARGE SCALE SOLAR INSTALLATIONS IN UNDERUTILIZED AREAS AND URBAN RESERVE AREAS THAT OFFER MULTIPLE BENEFITS.

THE CITY OF CEDAR RAPIDS CAN BECOME AN ANCHOR TENANT BY PURCHASING 900 BLOCKS OF 250-WATT SOLAR PANELS AT A COST OF $291 PER BLOCK.

TOTAL SUBSCRIPTION COST OF $261,900 WOULD BE PAID FOR BY THE UTILITIES DEPARTMENT.

COSTS WOULD BE SPLIT BETWEEN WATER AND WPC.

THERE IS A 20 YEAR SUBSCRIPTION TERM.

A $35 SUBSCRIPTION FEE AND A LINE OWNS AND MAINTAINS THE SOLAR SITE.

AN ESTIMATED ANNUAL BILL CREDIT OF $29,200 IN THE FIRST YEAR AND A 20 YEAR TOTAL BILL CREDIT OF $562,500.

RENEWABLE ENERGY CREDITS.

RETIRED WILL BE RETIRED ON BEHALF OF THE CITY OF CEDAR RAPIDS, WHICH DEMONSTRATES THE CITY'S COMMITMENT TO ENVIRONMENTAL SUSTAINABILITY BY ENABLING CLEAN LOCAL ENERGY.

ALLIANCE SOLAR GARDEN IS LOCATED NORTH OF THE 1100 BLOCK OF 33RD AVENUE SOUTHWEST.

AND OTHER PROJECT CONSIDERATIONS INCLUDE A 16 YEAR PAYBACK, ASSUMING 4% INFLATION AND 4% PANEL DEGRADATION.

THE CITY WILL RECEIVE MONTHLY BILL CREDITS FOR 20 YEARS BASED ON SOLAR PRODUCTION, AND THE CITY WILL BE RECOGNIZED AS AN ANCHOR TENANT ON SIGNAGE AND MARKETING MATERIALS. CITY STAFF RECOMMEND THE APPROVAL OF THE AGREEMENT WITH INTERSTATE POWER AND LIGHT COMPANY.

AFTER ALL THAT, WE CAME UP WITH A NEW LANGUAGE.

YOU KNOW, I HAD TO SAY, ISN'T IT MORE POWERFUL FOR IMMIGRANTS WHO HAVE BECOME PART OF THIS COMMUNITY TO THEMSELVES, AUTHENTICALLY SAY, I WAS WELCOMED AND YOU WILL BE WELCOMED AS WELL.

NOT. YOU'RE WELCOME TO PULL PALLETS SO LONG AS YOU MOW YOUR LAWN AND OTHERWISE KEEP THE NOISE LEVEL DOWN.

WHICH REFERS TO MY OTHER COMMENTS THAT I'VE MADE AT THE END OF 2021, I GAVE THE EA A GAME PLAN TO BUILD RELATIONSHIPS WITH IMMIGRANT OWNED BUSINESSES, TO ESTABLISH TRUST AND TO DEVELOP THE RICH STORIES THAT ARE IN OUR COMMUNITY TO ENHANCE THAT PRESENCE WITH DIVERSE BUSINESSES AND DIVERSE COMMUNITIES.

I FEEL THAT THEY'VE DONE A TOUCH OF THAT, BUT NOWHERE NEAR ENOUGH TO REALLY DEVELOP WHAT THIS COMMUNITY CAN BE.

I ALSO THINK THAT THE ECONOMIC ALLIANCE IS PUSHING TOO HARD ON THEIR LINKEDIN.

THEY HAVE A DESCRIPTION THAT THEY WANT OUR COMMUNITY TO BECOME THE DRIVER IN THE COUNTRY FOR ECONOMIC DEVELOPMENT.

I THINK THAT THEY'RE MOVING TOO FAST ON THAT AND THEY'RE MISSING A LOT OF OF OF STEPS ALONG THE WAY.

I THINK, YOU KNOW, I PRESENTED AT THE LAST TWO WEEKS TO TWO SESSIONS AGO AND TALKED ABOUT ISSUES IN TERMS OF THEIR CAPACITY, IN TERMS OF CREATIVE SERVICES.

AND I THINK THAT AS THE CITY STARTS TO INVOLVE ITSELF MORE WITH THE ECONOMIC ALLIANCE IN TERMS OF WORKFORCE DEVELOPMENT, THAT THESE KINDS OF ISSUES NEED TO BE ON THE TABLE.

WE NEED TO HAVE REAL CONVERSATIONS AND WE NEED TO MAKE SURE THAT THE DIVERSITY WORK THAT WE ARE DOING IN OUR COMMUNITY IS ACTUALLY ENHANCING TRUE DIVERSITY AND AND VALUING EVERYBODY THAT MOVES HERE.

IN REGARD TO THE SPEEDING ALONG COUNTRY CLUB PARKWAY AND 27TH STREET DRIVE, IT'S JUST IT'S NOT JUST CLUB MEMBERSHIP, ITS GUESTS, IT'S STAFF.

BUT ON COUNTRY CLUB PARKWAY, THERE'S A LOT OF PEOPLE FROM THE SOUTHEAST SIDE SPEEDING DOWN, TRYING TO GET TO FIRST AVENUE.

AND I REALLY THINK THERE NEEDS TO BE I WORK IN IOWA CITY A LOT AND I SEE A LOT OF SPEED BUMPS THAT SLOW DOWN CARS, TOO, FOR THE FACT THAT BECAUSE UNLESS THERE'S ENFORCEMENT WHICH I'VE SEEN AN UPTICK.

SO, I APPRECIATE THE POLICE DEPARTMENT FOR DOING MORE SURVEILLANCE OF THAT AREA.

BUT AT THE SAME TIME, THEY CAN'T BE EVERYWHERE AT EVERY TIME.

AND SO THE BEST SCENARIO, THERE'S A GOOD EXAMPLE BETWEEN BOYSEN AND BLAIRS FERRY ROAD.

THERE'S MANY ROUNDABOUTS AT HIAWATHA PUT THROUGH TO STOP SPEEDING FROM CUTTING THROUGH FROM BOYSEN ROAD TO BLAIRS FERRY ROAD.

I THINK THOSE MINI ROUNDABOUTS WOULD BE A GOOD WAY OF SLOWING PEOPLE DOWN ON COUNTRY CLUB PARKWAY OR SPEED BUMPS TO SLOW THEM DOWN AND A PROGRESSION.

THEY'RE GOING TO HAVE TO SLOW DOWN OR LOSE A BUMPER.

SO AND I THINK THAT'S MORE OF A DETERRENT THAN TRYING TO POLICE MORE FOR SPEEDERS.

AND ONE OF THE ISSUES IT'S INTERESTING LISTENING TO FOLKS TALK ABOUT THE COUNTRY CLUB BECAUSE TWO BLOCKS FROM A COUNTRY CLUB AND KENWOOD, WHICH HAS BIG OUTDOOR TENNIS COURTS AND ONE OF THOSE BUBBLES, VERY NOISY, NOT MY ISSUE, BUT VERY INTERESTING THAT, YOU KNOW, WE'RE LOOKING AT ALLOWING FOLKS TO BUILD ANOTHER ONE WHEN IF THAT WAS SOMEONE'S PRIORITY, THEY COULD ACTUALLY PROBABLY JUST SWITCH COUNTRY CLUBS IN THE SAME, YOU KNOW, TEN BLOCKS TO COUNTRY CLUBS.

ONE'S GOT OUTDOOR TENNIS WITH A THING ONE DOESN'T.

YOU COULD JUST GO TO THE OTHER ONE. BUT I THINK IT KIND OF HIGHLIGHTS THAT THERE'S TWO CEDAR RAPIDS, YOU KNOW, ONE WHERE PEOPLE WITH MEANS AND RICH FOLK GET WHAT THEY WANT AND OTHER FOLKS JUST GET STUCK MAKING DO WITH WHATEVER THEY CAN.

35TH STREET GOES RIGHT THROUGH ROCKWELL COLLINS.

IT CONNECTS OAKLAND TO FIRST AVENUE, GOES RIGHT BY THE COUNTRY CLUB.

MOST OF THE TRAFFIC COMES FROM THE COUNTRY CLUB, ROCKWELL COLLINS, OF COURSE, RESIDENTS OF THE NEIGHBORHOOD.

BUT IT'S A BIG THROUGH STREET FOR OAKLAND TO FIRST AVENUE.

AND I'M, YOU KNOW, NOT GOING TO, YOU KNOW, I GUESS I NEVER SAW MYSELF AS THAT GUY WHO'S HERE RAILING ABOUT A STREET.

BUT HERE I AM.

YOU CAN'T DRIVE DOWN THAT STREET FOR AND THIS IS NOT AN EXAGGERATION.

AND I CHALLENGE EVERYBODY HERE TO DO THAT.

YOU CAN'T GO FOR ONE SECOND WITHOUT HITTING BUMPS.

JARRING. HURTING YOUR VEHICLE BUMPS, POTHOLES, BUMPS THAT HAVE BEEN FIXED OVER YEARS AND YEARS AND YEARS.

IT STARTS RIGHT IN FRONT OF ROCKWELL.

IT GOES TO OAKLAND, AND THEN IT STOPS EVERYTHING ELSE AROUND.

IT'S FINE. THOSE FEW BLOCKS ARE HORRIFIC.

I RIDE A MOTORCYCLE TO LESS POINTS OF CONTACT, ONLY TWO TIRES.

AND IF I REALLY WANTED TO, I COULD WEAVE ANYWHERE I WANTED TO ON THAT ROAD.

WOULDN'T MATTER. YOU CANNOT MISS POTHOLES OR SPEED BUMPS THROUGHOUT THAT ENTIRE STREET.

IT'S JUST HORRIBLE.

I AVOIDED AT ALL COSTS.

MY GRANDMOTHER LIVES TWO BLOCKS UP THAT STREET JUST AROUND THE CORNER ON HOUSTON.

I GO UP A STREET AND DOWN AND THEN COME BACK OFF OF OAKLAND TO ENTER ON THE OTHER SIDE OF HOUSTON, JUST TO AVOID WHAT WOULD NORMALLY BE A 2 OR 3 BLOCK DRIVE, YOU KNOW, JUST JUST RIDDLED.

AND AGAIN, MOST OF THAT TRAFFIC COUNTRY CLUB, ALSO RAYTHEON, I GUESS, IS TECHNICALLY THAT BUSINESS THAT IS RIGHT THERE.

I'D LIKE TO SEE THEM, YOU KNOW, HELP OUT WITH THE CITY.

THEY USE THOSE SIDE STREETS TO PARK ON THERE.

YOU KNOW, I MEAN, THE CARS, THE AMOUNT OF CARS IN THAT PARKING LOT ARE HUGE.

THE TRAFFIC ON THAT STREET IS IS GINORMOUS WHEN IT COMES TO THE BUSINESS AND THE COUNTRY CLUB.

THERE ARE PROJECTS ALL OVER THE CITY REDOING STREETS THAT DON'T EVEN NEED TO BE REDONE.

NICE STREETS. I WAS IN THE ADIRONDACK AREA OFF OF 32ND RECENTLY, GOING TO A FRIEND'S HOUSE AND I SAW ALL THESE QUARTER MILLION DOLLAR HOMES GETTING NEW APPROACHES POURED ALL THE WAY DOWN THE STREET. EVERY HOUSE GOT A NEW APPROACH.

STREETS FINE, SIDEWALKS ARE FINE.

EVERYBODY'S DRIVEWAY IS FINE.

BUT FOR SOME REASON, ALL THESE RICH PEOPLE GOT NEW APPROACHES.

BUT IN KENWOOD, WE HAVE DIRT DRIVEWAYS, NO CURBS.

HALF THE PEOPLE STILL HAVE ORANGEBURG'S 35TH STREETS.

HORRIFIC. BUT LIKE WE'RE GETTING CONSTANTLY IGNORED.

THAT CITY, THAT PART OF THE CITY, THAT TOWN, KENWOOD, IS FALLING INTO DISREPAIR.

AND PART OF IT IS JUST KEEPING UP THE NEIGHBORHOOD, THE COMPLETE STREETS PROGRAM ALL THE WAY AROUND KENWOOD.

NOTHING IN KENWOOD.

YOU KNOW, I THINK THE CLOSEST ONE IS THE INTERSECTION, WHICH IS BEING DONE RIGHT NOW, 32ND AND CENTER POINT ROAD OR OAKLAND, MAYBE.

OAKLAND. YEAH, THAT'S THE COMPLETE STREET INTERSECTION HAPPENING RIGHT NOW.

MEANWHILE, THAT ENTIRE NEIGHBORHOOD, AGAIN, DIRT DRIVEWAYS, NO CURBS, NO SIDEWALKS.

THERE ARE HOUSES WITH NO SIDEWALKS TO THE HOUSE.

THERE ARE HOUSES THAT ARE BOARDED UP.

THERE'S I GOT A NEIGHBOR I'M WORRIED ABOUT.

IT LOOKS LIKE HE'S SLEEPING IN HIS DRIVEWAY IN A CAR, BUT YET THIS NEIGHBORHOOD'S JUST BEING IGNORED.

I WOULD LIKE TO SEE THE CITY FIX THAT STREET, AND I'M GOING TO KEEP COMING BACK UNTIL THE CITY FIXES THAT STREET.

AND I'D LIKE TO HEAR A PLAN ON.

KENWOOD BEING INCLUDED IN THE VERY NEAR FUTURE ON THE COMPLETE STREETS ISSUE, BECAUSE AGAIN, LOTS OF KIDS WE HAVE A SCHOOL, GREAT SCHOOL.

KENWOOD ELEMENTARY MISSING A LOT OF SIDEWALKS, DIRT DRIVEWAYS.

HALF THE PEOPLE STILL HAVE ORANGEBURG'S IN THEIR PROPERTIES.

LOT OF HOMES NOT BEING KEPT UP AFTER THE DERECHO.

SO PLEASE, I CHALLENGE YOU ALL DRIVE THROUGH THAT NEIGHBORHOOD, SPECIFICALLY TAKE 35TH STREET FROM ADIRONDACK TO OAKLAND AND THEN TURN AROUND AND LOOK AT IT.
