WELCOME TO THE CEDAR RAPIDS CITY COUNCIL MEETING FOR TUESDAY, OCTOBER 10, 2023.

I'D LIKE TO WELCOME OUR CITY MANAGER, OUR CITY CLERK, AND OUR CITY ATTORNEY AND THANK YOU AS ALWAYS, TO CITY STAFF WHO IS HERE TODAY AND WHO MADE A TREMENDOUS SHOWING AT YESTERDAY'S FIRST ANNUAL MAYOR'S YOUTH CONFERENCE.

THANK YOU FOR BEING A PART OF THAT AND BEING HERE WILLING TO ANSWER QUESTIONS FROM THOSE IN ATTENDANCE.

A REMINDER TO PLEASE TURN OFF ANY CELL PHONES OR ELECTRONIC DEVICES THAT MIGHT INTERRUPT OUR MEETING, AND PLEASE NOTE THAT ALL MEETING AGENDAS, MINUTES, AND VIDEOS ARE AVAILABLE ON OUR CITY'S WEBSITE.

OUR FIRST WILL BE FOR NATIONAL ARTS AND HUMANITIES MONTH, AND I'LL INVITE MAYOR PROTEMPO TO THE DIOSE TO READ THAT AT ANYBODY WHO'S HERE FOR THAT TO PLEASE JOIN HER AS SHE READS THE PROCLAMATION UP HERE.

IT'S MY HONOR TO READ A PROCLAMATION FROM THE CITY OF CEDAR RAPIDS.

WHEREAS THE MONTH OF OCTOBER HAS BEEN RECOGNIZED AS NATIONAL ARTS AND HUMANITIES MONTH BY THOUSANDS OF ARTS AND CULTURAL ORGANIZATIONS, COMMUNITIES AND STATES ACROSS THE COUNTRY, AS WELL AS BY THE WHITE HOUSE AND CONGRESS FOR MORE THAN TWO DECADES AND WHEREAS ARTS AND HUMANITIES ENHANCE AND ENRICH THE LIVES OF EVERY AMERICAN, INCLUDING THOSE OF US LIVING IN CEDAR RAPIDS AND WHEREAS, CREATIVE INDUSTRIES, WHICH RANGE FROM NON-PROFIT MUSEUMS, SYMPHONIES, THEATERS, ART SCHOOLS AND SERVICES, FILM, RADIO, TELEVISION, AND PERFORMING ARTS ARE THE FOUNDATION FOR THE CREATIVE ECONOMY.

WHEREAS ARTS AND HUMANITIES PLAY A UNIQUE ROLE IN THE COMMUNITY AND MAKE CEDAR RAPIDS UNIQUE.

WHEREAS LINN COUNTY, IOWA, IS HOME TO NEARLY 500 ARTS RELATED BUSINESSES, THAT EMPLOY OVER 2,000 PEOPLE.

WHEREAS THE CITY OF CEDAR RAPIDS RECOGNIZE THE BENEFITS OF THE ARTS AND HUMANITIES HAS ON THE COMMUNITY ENJOYMENT, LIVABILITY, AND ECONOMIC VIBRANCY.

THEREFORE, I AND PAUL ON BEHALF OF THE MAYOR TIFFANY OF DONALD, AND THE ENTIRE CEDAR RAPIDS CITY COUNCIL OF CEDAR RAPIDS, IOWA, DO HEREBY PROCLAIM OCTOBER 2023 AS THE NATIONAL ARTS AND HUMANITIES MONTH, AND URGE OUR RESIDENTS TO RECOGNIZE A POSITIVE IMPACT OF ARTS AND HUMANITIES IN CEDAR RAPIDS. CONGRATULATIONS. [APPLAUSE].

WE HOPE EVERYONE PARTAKES OF THE ARTS IN OCTOBER AND AFTER THAT TOO.

THOSE WHO ARE HERE TO HONOR GENTLEMAN DAY WITH A PROCLAMATION.

>> WELL, I HAVE THE PRIVILEGE OF READING THIS PROCLAMATION.

WHEREAS, ONE IN THREE WOMEN WILL EXPERIENCE DOMESTIC VIOLENCE DURING HER LIFETIME AND WHEREAS, INTIMATE PARTNER VIOLENCE IMPACTS VICTIMS, CHILDREN, FAMILY, FRIENDS, AND THE COMMUNITY AT LARGE AND WHEREAS, DOMESTIC VIOLENCE IS NOT CONFINED TO ANY GROUP OR GROUPS OF PEOPLE, BUT IS EXPERIENCED IN ALL ECONOMIC, RACIAL, ETHNIC, EDUCATIONAL, SOCIETAL, AND RELIGIOUS GROUPS, AND IS SUSTAINED BY SOCIETAL INDIFFERENCE.

WHEREAS PERPETRATORS OF DOMESTIC VIOLENCE SHOULD BE HELD ACCOUNTABLE FOR THEIR ACTIONS AND VICTIMS SHOULD HAVE THE ACCESS TO THE SUPPORT AND SERVICES TO HELP THEM OVERCOME THEIR EXPERIENCE, AND WHEREAS IT IS IMPORTANT TO RECOGNIZE THE COMPASSION AND DEDICATION OF THE INDIVIDUALS WHO PROVIDE THIS SUPPORT TO VICTIMS OF INTIMATE PARTNER VIOLENCE AND WORK TO INCREASE PUBLIC UNDERSTANDING OF THIS SIGNIFICANT PROBLEM.

WHEREAS ONLY A COORDINATED EFFORT FROM ALL COMMUNITY MEMBERS WILL PUT A STOP TO THIS HORRENDOUS CRIME.

NOW, THEREFORE, I, SCOTT OLSON ON BEHALF OF MAYOR TIFFANY O'DONNELL, AND THE ENTIRE CITY COUNCIL, DO RECOGNIZE OCTOBER 18, 2023 AS GENTLEMAN DAY.

THIS IS TO SUPPORT WAYPOINT SERVICES IN ENDING VIOLENCE, DOMESTIC VIOLENCE, AND URGE EVERYONE TO WORK TOGETHER.

[1. A public hearing will be held to consider amending Ordinance No. 016-23, which established new collection rates for fiscal year 2024 under Chapter 24 of the Municipal Code, Solid Waste and Recycling, to correct the rates (Roy Hesemann). CIP/DID #SWM24-02]

WHICH ESTABLISHED A NEW COLLECTION RATES FOR FISCAL YEAR 2024 UNDER CHAPTER 24 OR THE MUNICIPAL CODE, SOLID WASTE AND RECYCLING TO CORRECT THE RATES.

AND ROY HAUSSMANN IS HERE AND WE ALL RECOGNIZE YOU.

ROY HAUSSMANN, UTILITIES DEPARTMENT.

ORDINANCE NUMBER 016-23, WHICH WAS PASSED BY COUNSEL ON MAY 23RD, 2023, INADVERTENTLY HAD THE WRONG RATES IDENTIFIED.

IT ACTUALLY STILL HAD THE RATES FROM THE PRIOR FIVE YEARS AND DID NOT INCORPORATE THE NEW 1% DECREASE IN RATES PRESENTED TO COUNCIL AS PART OF OUR OVERALL UTILITY BUDGET.

FORTUNATELY, WE HAVE BEEN CHARGING CUSTOMERS THE CURRENT LOWER BILLING RATES AND THIS AMENDMENT ADJUST THE ORDINANCES CORRECTLY.

UTILITIES DEPARTMENT SOLID WASTE AND RECYCLING DIVISION RECOMMENDS AMENDING CHAPTER 24 AS OUTLINED AND WITH THAT, I WILL TURN IT BACK OVER TO YOU, MAYOR.

[2. A public hearing will be held to consider the disposition of City-owned property at 1500 2nd Avenue SE, known as The Heights (Sara Buck). CIP/DID #CDBG-CV-FY19]

OF CITY-OWNED PROPERTY AT 1500 SECOND AVENUE SOUTH EAST, KNOWN AS THE HEIGHTS.

SARAH BUCK IS HERE AND SARAH, I WILL RECOGNIZE YOU.

>> THANK YOU, MAYOR AND CITY COUNCIL.

SARAH BUCK WITH COMMUNITY DEVELOPMENT, AND THIS IS A PUBLIC HEARING FOR THE PROPERTY DISPOSITION OF THE HEIGHTS 1500 SECOND AVENUE SOUTHEAST.

SOME BACKGROUND, THE CITY PURCHASED THE VACANT, BLIGHTED BUILDING IN DECEMBER OF 2021.

WE WERE ABLE TO SECURE FOUR FEDERAL GRANTS TO REHAB THE BUILDING INTO 25 AFFORDABLE HOUSING UNITS, AND THOSE ARE DUE FOR COMPLETION IN MARCH OF NEXT YEAR.

THE PROPERTY NEEDS TO BE TRANSFERRED TO AN ENTITY TO OWN AND MANAGE THROUGH THE DURATION OF THAT 15-YEAR AFFORDABILITY PERIOD.

THROUGH THAT PERIOD OF TIME, THE PROPERTY LIEN WILL BE PLACED ON THE PROPERTY UNTIL ENSURING THAT COMPLIANCE PERIOD FOR THAT 15 YEARS.

I DO ALSO WANT TO NOTE THAT THE REASON THAT WE'RE BRINGING THIS FORWARD THIS EARLY IN THE PROCESS SINCE

IT'S NOT ACTUALLY GOING TO BE COMPLETED UNTIL MARCH IS THERE'S A FOUR-MONTH REQUIREMENT FOR FAIR HOUSING MARKETING TO BE COMPLETED AND SO WE REALLY NEED TO IDENTIFY THEIR OWNER NOW SO WE CAN COMPLETE THAT FOUR MONTHS TIME PERIOD, SO WHEN MARCH COMES AROUND AND IT'S ALL READY TO GO, WE CAN MAKE SURE THAT LEASE HAPPENS.

WE ALSO DID PROVIDE THE REQUEST FOR PROPOSAL DRAFT TO THE WELLINGTON HEIGHTS NEIGHBORHOOD ASSOCIATION FOR FEEDBACK AND WE'LL CONTINUE TO WORK WITH THEM THROUGH THIS PROCESS.

SOME OF THE PROPERTY CHARACTERISTICS, THERE'S A TOTAL OF 25 UNITS, SIX OF THOSE UNITS ARE FULLY ADA COMPLIANT.

ALL THE UNITS ARE CONVERTIBLE TO ADA.

THERE ARE OFFICE SPACES, COMPUTER LAB, MEETING ROOM, ONSITE LAUNDRY AND TENANT STORAGE.

THEN THE MAIN THING I WANTED TO ADDRESS HERE IS THAT THERE'S A GAS-POWERED BACKUP GENERATOR.

IF THERE IS, I DON'T WANT TO SAY IT, ANOTHER DERECHO OR SOME OTHER FORM OF DISASTER THAT HAPPENS WHERE THEY LOSE POWER, ALL THE UNITS WILL HAVE ACCESSIBILITY TO POWER SO EVERYONE WILL HAVE A REFRIGERATOR THAT'S ABLE TO WORK IF THEY NEED TO STORE INSULIN OR ANYTHING LIKE THAT.

HERE'S AN AERIAL VIEW OF THE PROPERTY ON THE CORNER OF 15TH STREET SOUTHEAST AND SECOND AVENUE SOUTHEAST.

THEN HERE'S SOME PRE-CONSTRUCTION PHOTOS.

OF YOUR PHOTOS A LOT OF THE WINDOWS WERE BROKEN OUT, DAMAGE WAS DONE.

THERE WAS ASBESTOS AND MOLD REMEDIATION THAT NEEDED TO HAPPEN AS PART OF THE CONSTRUCTION.

HERE'S AN ARCHITECTURAL RENDERING OF WHAT WE ANTICIPATE THE BUILDING TO LOOK LIKE.

IF YOU'VE DROVE BY RECENTLY, YOU SEE THAT THE BRICK IS ALMOST 100% COMPLETE ON THE OUTSIDE, SO IT'S LOOKING REALLY GOOD.

THE EVALUATION CRITERIA FOR THE REQUEST FOR PROPOSALS, WE WANT TO ENSURE THAT THE OWNER HAS CAPACITY AND FINANCIAL FEASIBILITY.

SO LOOKING AT PREVIOUS MANAGEMENT EXPERIENCE IN AFFORDABLE HOUSING AND THEN OVERALL FINANCIAL FEASIBILITY OF THE OWNER.

THAT WILL BE REVIEWED AS PART OF THAT 15-YEAR PRO FORMA, AND ENSURING THAT THERE'S ADEQUATE RESERVES FOR MAINTENANCE AND LONG-TERM MAINTENANCE OF THAT BUILDING.

THEN ALSO COMMUNITY BENEFITS, SO IF THE PROPOSER CHOOSES TO SERVE A HIGHER-NEED POPULATION SUCH AS A LOWER PERCENTAGE OF THE AREA MEDIAN INCOME, SO LOWER-INCOME HOUSEHOLDS.

THAT COULD BE SOMETHING THAT THEY PROPOSE TO DO OR PROVIDING ADDITIONAL AMENITIES OR SURFACES TO THE TENANT, IS SOMETHING THEY CAN ALSO PROPOSE TO DO, NOT REQUIRED BY THE GRANT, BUT THEN IT IS AN OPTION.

THE RECOMMENDATION IS TO APPROVE THE RESOLUTION, TO INITIATE THE REQUESTS FOR PROPOSALS.

THEN THE TIMELINE, THIS CAME BEFORE DEVELOPMENT COMMITTEE IN SEPTEMBER.

TODAY'S THE PUBLIC HEARING AND THE RESOLUTION ON PROPOSALS WOULD BE DUE AT NOON ON NOVEMBER 6TH.

THEN ON THE 13TH, THERE WILL BE A STAKEHOLDER REVIEW AND THEN THE RECOMMENDATION WILL COME BEFORE CITY COUNCIL, THEN ON NOVEMBER 21ST FOR THAT CONSIDERATION AND SELECTION.

THEN WE HOPE TO HAVE THAT NEGOTIATION OF DEVELOPMENT AGREEMENT COME BACK IN WINTER OR SPRING OF 2024.

>> ABSOLUTELY. THEY WOULD BE THE OWNER OF THE BUILDING, SO THEY WOULD A 100% BE RESPONSIBLE FOR ALL THE MAINTENANCE INCLUDING SNOW REMOVAL, MOWING.

I DO KNOW THAT A SECTION OF THAT CONCRETE PAD IS GOING TO BE GRASS INSTEAD OF PARKING LOT.

THE PARKING LOT WE'LL BE REDUCED.

>> THANK YOU, MAYOR. SARAH, I DRIVE BY THIS EVERY DAY AS PROBABLY SEVERAL OF US DO ON COUNCIL AND FOR THE LONGEST TIME IT JUST SAT THERE.

IT'S A TREMENDOUS PROJECT FOR THE COMMUNITY AND VERY HIGH-QUALITY.

I JUST HAVE A COUPLE OF QUESTIONS.

DO WE IN OUR OWN MINDS HAVE AN IDEA OF WHAT THE IDEAL BUYER OR IDEAL ENTITY WOULD BE IN MANAGING THIS, ESPECIALLY WITH THE REQUIREMENTS OVER THE 15 YEARS? SECONDLY, DO WE HAVE A PROCESS OR THOUGHTS ABOUT IF IN FACT, IT TURNS OUT WE NEED TO TAKE ACTION BECAUSE THEY AREN'T FOLLOWING THROUGH ON THE REQUIREMENTS AND WHAT WOULD HAPPEN THERE?

>> THE DEVELOPMENT AGREEMENT WILL ENSURE IN THAT PROPERTY LIEN, WE'LL ENSURE THAT THERE'S THAT LONG-TERM COMPLIANCE AND WE HAVE THINGS IN PLACE THAT WE WILL DO TO MAKE SURE THAT THAT COMPLIANCE IS MET, EVEN IF THAT MEANS TAKING POSSESSION BACK OF THE BUILDING, WHICH OBVIOUSLY WOULD BE THE LAST RESORT.

THIS IS SOMETHING THAT OUR STAFF DOES EVERY DAY WITH OTHER PROJECTS.

THIS IS JUST A LARGER PROJECT THAN WHAT WE'RE USED TO WORKING WITH.

BUT NONETHELESS, ALL OF THOSE REQUIREMENTS WILL BE PART OF THAT DEVELOPMENT AGREEMENT.

THEN SECONDLY, I WOULD SAY IN THE EVALUATION CRITERIA THAT REALLY LAYS OUT WHAT OUR PROSPECT WOULD BE.

DEFINITELY SOMEONE WHO HAS EXPERIENCE WITH AFFORDABLE HOUSING AND WORKING WITH FEDERAL GRANTS WOULD BE THE HIGHEST PRIORITY AND THAT HAVE ALREADY REALLY SHOWN IN THE COMMUNITY THAT THEY CAN DO THIS WELL OR NOT NECESSARILY IN OUR COMMUNITY, BUT THAT THEY HAVE DONE THIS WELL ON OTHER PROJECTS WOULD BE HIGHEST PRIORITY.

>> CAN YOU GO BACK TO THIS SLIDE THAT OUTLINES WHAT THE UNITS? I JUST WANT TO EMPHASIZE HOW CRITICAL IT IS TO HAVE SIX UNITS FULLY ADA COMPLIANT AND THE BACKUP GENERATOR.

BECAUSE I THINK A LOT OF US WHO WERE HANDS-ON DURING THE DERECHO HAVE THOSE MEMORIES THAT'LL PROBABLY NEVER REALLY LEAVE US OF GOING ONSITE, SEEING PEOPLE THAT WERE PRETTY DESTITUTE.

THAT UNFORTUNATELY, WE JUST REALLY DIDN'T HAVE ANY OTHER PLACE TO PUT THEM.

IT'S NOT FOR LACK OF TRYING.

CERTAINLY YOU AND DIRECTOR PRATT WORKED TIRELESSLY TO FIND UNITS, BUT WE DIDN'T HAVE DOZENS OF PEOPLE LOOKING FOR FULLY ADA.

WE HAD A FEW AND FOR THOSE WHO NEED IT, IT IS CRITICAL SO THAT EVERYTHING IS ACCOMMODATING TO THEM SO THAT THEY'RE ON THAT MAIN FLOOR.

IT SEEMS A SMALL NUMBER.

IT'S A PRETTY BIG IMPACT IN OUR COMMUNITY AND REALLY APPRECIATE THE FACT THAT [NOISE] WE'RE PUTTING THIS PRODUCT BACK OUT THERE. THANK YOU.

THEY WILL HAVE ALL THEIR COSTS COVERED BY WHAT THEY DO FROM THEIR RENTS.

BUT WE CANNOT LET OUR RENTS, I THINK, GET TO THAT 80% LEVEL.

I THINK WE NEED TO HAVE SOMEBODY THAT'S GOING TO HOLD THOSE RENTS DOWN.

BECAUSE IT CAN'T BE DONE AND WE HAVE A RARE OPPORTUNITY TO PROVIDE 20+ UNITS THAT ARE TRULY AFFORDABLE, THAT ARE BEAUTIFUL, THAT ARE NEW, THAT ARE NOT IN A RUN-DOWN HOUSE.

I DON'T THINK 80% IS A NUMBER WE SHOULD USE.

WE NEED TO HAVE SOMEBODY THAT KNOWS HOW TO RUN A BUILDING AND MAINTAIN IT, AT THE SAME TIME PROVIDE WELL BELOW MARKET RENTS.

THIS IS A RARE OPPORTUNITY FOR THE CITY OF CEDAR RAPIDS.

HOPEFULLY IN YOUR RFPL, YOU PUT A TOUGHER STANDARD IN THERE AND SEE IF THEY CAN MEET IT.

WHEN YOU GET A BUILDING WITH NO DEBT, ALL RENOVATED, THERE SHOULD BE NO REASON THAT THEY CAN'T, WITH THIS NUMBER OF UNITS AND THIS QUALITY OF FACILITY, NOT CHARGE A RENT THAT'S MORE THAN THE OPERATING COSTS AND STAFFING COSTS, AND MAINTAINING A RESERVE SO THAT THIS BUILDING CAN BE MAINTAINED FOR 15 YEARS.

IT'S VERY SIMILAR TO A HUD TYPE PROJECT WHERE THEY HAVE THESE STANDARDS.

AGAIN, I WANT TO ISSUE THAT CHALLENGE BECAUSE WE'RE NOT GOING TO SEE THIS AGAIN FOR A LONG TIME.

TO PUT THIS AMOUNT OF MONEY INTO IT, WE DON'T WANT TO SEE THAT.

WE'VE HAD THOSE HAPPENED IN THE PAST, WERE WELL-INTENTIONED, BUT SIX OR SEVEN YEARS DOWN THE ROAD, THE MODEL THAT THE NON-PROFIT IS USING ISN'T WORKING.

NO NEED TO NAME ANY NAMES, BUT WE ALL ARE AWARE OF THOSE.

WE'RE CONSTRUCTING SOME TRAIL APPROACHES, AS WELL AS DOING SOME OTHER BRIDGE REPAIR, REPAINTING, BARRIER AND RAIL WORK.

ANOTHER INTERESTING FACTORS THAT WE ARE LINING THE WATER MAIN THAT HANGS UNDER THE BRIDGE AT THIS POINT TO EXTEND THE LIFE OF THAT $2.9 MILLION ESTIMATED COST, WHICH INCLUDES $660,000 OF A SURFACE TRANSPORTATION BLOCK GRANTS WERE SCHEDULED FOR AN IOWA DOT LETTING THIS IS BEING BID THROUGH THEM ON OCTOBER 17TH AND JUST LIST THE LATE START DATE, WHICH IS GOING TO BE NEXT SPRING.

I ALSO NOTE PHASE B OCCURRING HERE TO THE WEST.

OF THAT GRADING IS FINISHING UP THIS YEAR BETWEEN C AVENUE AND JUST A LITTLE PAST MEADOW KNOWLES.

THEN AFTER PHASE A PAVING BEGINS, WE'RE GOING TO GO TO BID WITH THE PHASE B PAVING PROJECTS.

BY THE END OF NEXT YEAR PERHAPS WILL BE PRETTY MUCH LINKED UP BETWEEN ALBERT NETS AND C AVENUE.

BETWEEN THE RIVER AND THE LEVEE TRAIL.

THE WHIRLWIND COMPLETED IS EXPECTED TO HAVE A CAPACITY RANGING FROM 3,400 GALLONS PER MINUTE DURING WINTER MONTHS TO 4,500 GALLONS PER MINUTE IN THE SUMMER MONTHS.

CARGILL RELIES ON SEVERAL VERTICAL WELLS.

NOW LET'S PROVIDE MOST OF THEIR COOLING WATER SUPPLY.

FIVE OF THESE WELLS ARE SHALLOW ALLUVIAL THAT RELY HEAVILY ON THE RIVER FOR RECHARGE.

AS PART OF THE FLOOD RISK MANAGEMENT PROJECT, A FLOOD WALL WILL BE CONSTRUCTED ALONG CARGILL'S PROPERTY, AND THAT'S DEPICTED AS RED HERE ON THIS FIGURE.

THE FLOOD WALL CONSTRUCTION INCLUDES DRIVING SHEET PILE TO BEDROCK, WHICH WILL SIGNIFICANTLY REDUCE PRODUCTION OF THE WELLS.

THIS IS GENERALLY DEPICTED IN THE LOWER-RIGHT DEBT DIAGRAM.

THE RED VERTICAL LINE SYMBOLIZES A SHEET PILE BEING DRIVEN AT BEDROCK AND YOU CAN SEE THAT THAT SHEET PILE WILL IMPEDE THE FLOW THROUGH THE AQUIFER TO THEIR WELLS.

BECAUSE OF THIS, A NEW SOURCE OF WATER SUPPLY IS REQUIRED.

THE HORIZONTAL COLLECTOR WELL 7 PROJECT REPLACES THE COOLING WATER SUPPLY IMPACTED BY THE FLOOD CONTROL SYSTEM PROJECT.

THE PROJECT REALLY INCLUDES FOUR SEPARATE CONTRACTS.

CONTRACT 1 IS THE CAISSON AND LATERALS CONTRACT, WHICH IS TODAY'S PUBLIC HEARING 9.

CONTRACT 2 IS THE WELLHOUSE CONTRACT WHICH IS TODAY'S PUBLIC HEARING 10.

THIS CONTRACT INCLUDES A PORTION OF THE PIPELINE FROM THE WELLHOUSE TO JUST BE ON THE RAILROAD BRIDGE.

GENERALLY ABOUT IN HERE.

A THIRD CONTRACT BY THE ARMY CORPS OF ENGINEERS WILL CONSTRUCT A PORTION OF THE PIPELINE FROM JUST EAST OF THE RAILROAD BRIDGE AND THE CARGILL'S PROPERTY AND A FOURTH CONTRACT BY CARGILL WILL CONSTRUCT THE PIPELINE ON CARGILL'S PROPERTY ITSELF.

THIS IS THE FIRST STEP IN COMPLETING THE FLOOD PROTECTION SYSTEM IN THIS AREA.

I ALSO WANTED TO MENTION THAT WE EVALUATED SEVERAL OTHER ALTERNATIVES, INCLUDING DIFFERENT LOCATIONS FOR THE COLLECTOR WELL, A VERTICAL WELL FIELD FURTHER TO THE SOUTH, A COOLING TOWER IN LIEU OF A NEW WELL OR WELLS AND USING THE RIVER AS A DIRECT WATER SOURCE.

THIS PROPOSED PROJECT WAS DETERMINED TO BE THE MOST FEASIBLE DUE TO COSTS, RELIABILITY, AND CAPACITY FACTORS.

CONTRACT 1 CAISSON AND LATERALS PROVIDES FOR THE CONSTRUCTION OF A 20-FOOT DIAMETER CAISSON THAT WILL BE APPROXIMATELY 75 FOOT DEEP.

A CAISSON IS A ROUND CONCRETE STRUCTURE SIMILAR TO A SILO, EXCEPT IN THIS CASE IT IS CONSTRUCTED BELOW GROUND INSTEAD OF ABOVE-GROUND LIKE A SILO WOULD BE.

THAT'S DEPICTED HERE IN THIS FIGURE.

FROM THE CAISSON 6 12-INCH DIAMETER, HORIZONTAL LATERALS WILL BE EXTENDED TO A LENGTH OF ABOUT 200 FEET.

THIS WORK IS HIGHLY SPECIALIZED, WHICH IS WHY IT IS BEING BID SEPARATELY FROM THE WELLHOUSE PORTION OF THE CONTRACT.

THE COST OPINION FOR THE CONTRACT IS $5,110,000.

A PRE-BID MEETING WILL BE HELD TOMORROW, OCTOBER 11TH, AND THE BID OPENING WILL BE HELD ON WEDNESDAY, OCTOBER 25TH.

CONSTRUCTION IS SCHEDULED TO BEGIN IN APRIL 2024 FOLLOWING COMPLETION OF THE RAILROAD BRIDGE DEMOLITION PROJECT AND IS EXPECTED TO BE COMPLETE BY FEBRUARY 2025.

CONTRACT 2 IS FOR THE WELLHOUSE AND PROVIDES FOR THE WELLHOUSE STRUCTURE, PUMPING EQUIPMENT, ELECTRICAL AND HVAC EQUIPMENT, A GENERATOR, INTERNAL AND EXTERNAL PIPING IN UNRELATED SITE WORK.

THE RENDERING AT TOP RIGHT SHOWS WHAT THE WELLHOUSE WILL LOOK LIKE FROM THE TRAIL ON THE NORTH SIDE OF THE RIVER, LOOKING SOUTH TOWARDS MOUNT RUSHMORE.

THE LOWER-RIGHT RENDERING SHOWS WHAT THE WELLHOUSE WILL LOOK LIKE FROM THE SOUTH SIDE OF THE RIVER.

THE COST OF OPINION FOR THIS CONTRACT IS $17,810,000.

BIDS WERE OPENED THE FOLLOWING DAY ON SEPTEMBER 27TH.

ESTIMATED COST FOR THE PROJECT WAS $350,000 AND THE PROJECT IS SET TO INITIATE IMMEDIATELY WITH COMPLETION SET FOR FALL OR WINTER OF YET THIS YEAR.

WE HAD THREE BIDS THAT WERE SUBMITTED.

THE FIRST BID WAS FROM TRICON GENERAL CONSTRUCTION, INCORPORATED OF CEDAR RAPIDS, AND CAME IN AT $194,000.

PLEASE NOTE THAT THE TRICON GENERAL CONSTRUCTION, INC'S BID WAS DISQUALIFIED DUE TO THE REQUIREMENT FOR THE PROJECT START DATE NOT MEETING THE SPECIFIED TIME FRAMES.

BOTH THE REQUEST FOR BIDS AND THE PROJECT ADDENDUM SPECIFIED AN IMMEDIATE START REQUIREMENT FOR THE PROJECT.

TRICON WAS UNABLE TO START THE PROJECT FOR 105 DAYS, WHICH DID NOT SATISFY THE BID REQUIREMENTS, RESULTED IN THE DISQUALIFICATION OF THEIR BID.

SECOND BIT THAT WE RECEIVED WAS FROM MINTURN INCORPORATED OF BROOKLYN, IOWA, AND THAT WAS FOR $324,000.

THE THIRD BID THAT WE RECEIVED WAS FROM UNZEITIG CONSTRUCTION COMPANY OF CEDAR RAPIDS AND CAME IN AT $328,300.

A LITTLE BACKGROUND.

ON MAY 9TH, CITY COUNCIL AUTHORIZED SUPPORT UNDER THE LOCAL MATCH-ECONOMIC DEVELOPMENT PROGRAM, WHICH BRINGS A STANDARD INCENTIVE AS PART OF THE DEVELOPER'S APPLICATION FOR WORKFORCE HOUSING TAX CREDITS.

UNFORTUNATELY, THE DEVELOPER WAS NOT AWARDED THE WORKFORCE HOUSING TAX CREDITS.

THIS PROJECT DOES QUALIFY UNDER THE TARGETED DISTRICT REINVESTMENT - ECONOMIC DEVELOPMENT PROGRAM.

A TERM SHEET IS BEING PROPOSED TO MOVE FORWARD WITH THE PROJECT WITHOUT STATE INCENTIVES.

AS WITH ANY REQUESTS FOR ABOVE STANDARD INCENTIVES, A FINANCIAL GAP ANALYSIS IS PERFORMED.

WE DO VERIFY CONSTRUCTION AND OPERATIONAL COSTS, AND WE DO ENSURE THAT THE DEVELOPERS EQUITY EXCEEDS THE PRESENT VALUE OF CITY INCENTIVES.

THE PROJECT TERM SHEET WOULD INCLUDE A FOUR MILLION DOLLAR CAPITAL INVESTMENT, A TOTAL OF 15 UNITS ON THE FIVE PARCELS BELOW.

EACH PARCEL WOULD CONSIST OF THREE UNITS, ONE SINGLE FAMILY HOME, AND TWO ADU UNITS, A TOTAL OF THREE GARAGE STALLS AND WITH SIX TOTAL OFF STREET PARKING SPACES.

CONSTRUCTION IS PLANNED TO COMMENCE NO LATER THAN MAY OF 2024 AND COMPLETE BY MAY OF '25.

THE INCENTIVES WOULD INCLUDE A REIMBURSEMENT OF 100% TAX INCREMENT.

AN ESTIMATED ONE MILLION OF NEW TAXES WOULD BE GENERATED OVER 20 YEARS WITH A REIMBURSEMENT UP TO 400,000 AND NET PRESENT VALUE.

ONE OTHER STIPULATION IS IF THE DEVELOPER WOULD NEED TO APPLY FOR WORKFORCE HOUSING TAX CREDITS AGAIN IN 2024 IF CONSTRUCTION HAD NOT COMMENCED PRIOR TO THE APPLICATION DEADLINE, IF THEY WERE AWARDED, CITY INCENTIVES WOULD BE REDUCED BY THE NET PRESENT VALUE OF THE AWARD.

REALLY, YOU CAN LEARN WAY MORE AT THE FAIR ABOUT IT THAN I CAN SAY HERE, BUT I'LL JUST BRIEFLY DESCRIBE THAT THE PROJECT, GETTING A SOLAR AND BATTERY INSTALLATION IN A COMMUNITY OF NEED REALLY STARTED WITH THE REACTION TO THE DERECHO AND SEEING HOW HARD IT HIT CERTAIN COMMUNITIES MORE THAN OTHERS.

IT STARTED ORGANICALLY.

ME AND OTHER FOLKS WORKING IN MUTUAL AID EFFORTS WANTED TO TRY TO DIY A SOLAR AND BATTERY SYSTEM AND REALIZED HOW DIFFICULT THAT COULD BE.

THEN LONG STORY SHORT, FOUND PARTNERS AND PEOPLE WILLING TO GIVE THEIR TIME AND DONATE MATERIALS AND GET THIS SOLAR AND BATTERY SYSTEM THAT'S MORE ROBUST THAN SOMETHING WE COULD DO JUST BY OURSELVES.

THE FAIR IS TO NOT ONLY CELEBRATE THAT ELEMENT OF RESILIENCY, THAT RESILIENCY HUB IN THIS NEIGHBORHOOD AND ENCOURAGE REPETITIONS OF THOSE RESILIENCY HUBS IN MORE NEIGHBORHOODS IN NEED, IT'S ALSO TO JUST CELEBRATE ALL OF THE EFFORTS PEOPLE ARE DOING TO STRENGTHEN RESILIENCY ALL AROUND CEDAR RAPIDS.

FOR EXAMPLE, WE ALSO PLAN TO INVITE THE CITY WATER DEPARTMENT IF THEY WOULD LIKE TO HAVE A TABLE AT THE FAIR AND TALK ABOUT THE EFFORTS THEY DO TO HAVE A RESILIENT WATER SYSTEM, FOR EXAMPLE.

BUT OTHER ELEMENTS OF RESILIENCY BEYOND ELECTRICITY ARE JUST PEOPLE BEING KIND TO EACH OTHER, FOODS SUCH AS THE COMMUNITY FRIDGE AT THE RESILIENCY HUB, AND HOUSING; PEOPLE TO HAVE STABLE HOUSING AND ABILITY TO REPAIR THAT HOUSING QUICKLY.

ALL THINGS LIKE THAT ARE GOING TO BE TALKED ABOUT AND CELEBRATED AT THE FAIR.

THEN WITH LOOKING FORWARD TO THE FUTURE OF MORE RESILIENCY HUBS AND MORE OF THOSE EFFORTS CONTINUING.

THE LAST THING I'LL SAY IS JUST THAT I'M SPEAKING ON BEHALF OF OUR FUTURE.

OUR FUTURE IS AN ORGANIZATION THAT'S THE GROUP OF PEOPLE THAT I MENTIONED WHO WHEN WE STARTED OUT JUST AS TRYING TO DIY THE SYSTEM.

WE FORMED OUR OWN GROUP TO DO NOT ONLY PROJECTS LIKE THIS, BUT ENCOURAGE AND HELP FUNDRAISE AND PAY YOUNG OR EMERGING LEADERS WHO ARE FACING SOCIAL ECONOMIC BARRIERS TO DO PROJECTS LIKE THIS OF THEIR OWN DESIGN.

MY FOCUS THERE WAS REALLY TO ADDRESS HOW THE SCHOOL DISTRICT NEEDS TO KEEP ITSELF INDEPENDENT FROM EXTERNAL INFLUENCES THAT MIGHT NOT FOLLOW THE SAME ETHICS THAT THEY REALLY NEED TO FOLLOW.

I POINTED OUT THREE CONFLICTS OF INTEREST.

THE FIRST, LAURA SEYFER, THE FORMER IOWA BIG DIRECTOR.

IOWA BIG WAS HOUSED OUT OF THE NEWBOCO OFFICES WHERE DAVE TOMINSKY, THE PRESIDENT OF THE SCHOOL BOARD WORKS.

SHE WORKED HALF-TIME FOR THE ECONOMIC ALLIANCE AND HALF-TIME FOR IOWA BIG.

TWO WEEKS AFTER THE VOTE, SHE WAS PROMOTED TO FULL-TIME FOR THE ECONOMIC ALLIANCE, SUGGESTING THAT THERE'S A POSSIBILITY THAT THIS WAS A KPI, THAT IT WAS PART OF HER RESPONSIBILITY TO URGE AND MAKE SURE THAT THIS DEAL GOT DONE AND THAT IT GOT MOVED INTO ECONOMIC ALLIANCE, THE HIGH SCHOOL.

THERE ARE ALSO TWO BOARD MEMBERS THAT ARE EMPLOYED OR OFFICERS OF NONPROFIT ORGANIZATIONS THAT THEY DO THEIR FUNDRAISING LARGELY THROUGH THEIR EA MEMBERSHIP AND THEY'RE ALSO BOTH PART OF EA AND CITY DEFINED DEVELOPMENT DISTRICTS.

AGAIN, REPRESENTING A LIKELIHOOD THAT THERE'S BIAS IN THEIR POSITION, THAT WOULD CHANGE THE WAY THAT THEY WOULD THINK ABOUT THAT.

I HAD LEARNED ABOUT DEI REPORT THAT WAS PRODUCED BY TOP RANK, AND I READ MY PRESENTATION LAST NIGHT TALKING ABOUT THAT BECAUSE IN THE REPORT IT POINTS OUT THAT THE SCHOOL DISTRICT HAS A CULTURE PROBLEM AND THAT THEY ARE AT A TIPPING POINT WHERE THE CULTURE ISSUES THAT ARE THERE, CENTRALIZED POWER, THE FURTHER PEOPLE ARE AWAY FROM THE SCHOOL BOARD,

THE LESS INFLUENCE THEY HAVE, LESS POWER THEY HAVE, AND THE MORE PUNITIVELY THEY'RE GOING TO BE TREATED IF THEY SPEAK UP ABOUT CONCERNS.

THE REPORT POINTS OUT THAT THIS IS AT A TIPPING POINT.

IT COULD BECOME INGRAINED OR THEY COULD DO SOME THINGS TO CHANGE THAT.

I POINTED OUT THAT SOME OF THESE EXTERNAL INFLUENCES, SOME OF THE REASONS THAT THE SCHOOL DISTRICT IS BEING CENTRALIZED IS BECAUSE THEY'RE GETTING A LOT OF EXTERNAL PRESSURES AND LOT OF EXTERNAL DEALS BEING PRESENTED TO THEM.

LIKE DO THESE THINGS AND THEN THIS IS GOING TO HAPPEN AND WE'RE GOING TO MOVE HERE AND THAT, AND SO PEOPLE DOWN AT THE BOTTOM DON'T HAVE ANY SAY IN THOSE DECISIONS.

I FEEL LIKE THERE'S TWO DIFFERENT COMPONENTS OF THIS.

THERE'S THE EA COMPONENT AND THERE'S THE CITY COMPONENT.

I THINK THAT THE CITY ALSO HAS SOME OF THESE CULTURAL PROBLEMS GOING ON WITHIN IT.

BUT I WOULD DESCRIBE IT AS MORE OF AN ANGER AND FRUSTRATION ABOUT CITY RESIDENTS AND PEOPLE THAT LIVE HERE.

MY INTERVIEW WITH AMANDI GRIDER WHERE SHE DISCLOSED HER ANGER AND FRUSTRATION ABOUT NOT BEING ABLE TO APPROPRIATELY PUNISH RESIDENTS FOR NONCOMPLIANCE WITH ORDINANCES.

LAST SESSION'S CONVERSATION ABOUT THE FERAL CATS WHICH IS EXCESSIVELY RESTRICTIVE AND ALSO MY PREVIOUS CONVERSATION REGARDING ALL OF THE MY CR REPORTING.

ALL THOSE THINGS FLOW TOGETHER INTO THAT.

IT'S JUST TOO FAST.

I'VE WORKED IN COLLEGES FOR YEARS AND WE HAD A 2-3 YEAR DEVELOPMENT TIMELINE FOR PROGRAMS. WE HAD NEW PROGRAM.

YOU'D HAVE SIX IN THE PIPELINE AND SOMETHING NEW CAME IN AND JUMPED INTO A ONE-AND-A-HALF YEAR CYCLE, IT WAS PUBLIC AND THERE WAS A LOT OF CONVERSATION ABOUT IT.

IN ADDITION, I POINTED OUT THAT ONGOING CONCERNS AROUND THE EA'S OPEN HOUSE LAST MONTH REGARDING DEVELOPMENT OF THE MEDQ.

PHILIP WOST ANNOUNCED TO THE EVENT ON HIS LINKEDIN AFTER THE EVENT HAPPENED.
