[1. A public hearing will be held to consider repealing Chapter 59 of the Municipal Code, Massage Therapy Business License, and enacting a new Chapter 59, Massage Therapy, in its place to incorporate the existing Iowa State Code Chapter 152C (Annette Lorenz). CIP/DID #PD0033]

ITEM NUMBER ONE IS A PUBLIC HEARING TO CONSIDER REPEALING CHAPTER 59 OF THE MUNICIPAL CODE MASSAGE THERAPY BUSINESS LICENSE AND ENACTING A NEW CHAPTER 59 MASSAGE THERAPY IN ITS PLACE TO INCORPORATE THE EXISTING IOWA STATE CODE.

CHAPTER 152C.

JUST FOR SOME BACKGROUND ON THIS, A LICENSEE HAD SUCCESSFULLY CHALLENGED THE CITY'S MASSAGE THERAPY BUSINESS LICENSE ORDINANCE, RAISING VARIOUS CONCERNS AND CLAIMS FROM THIS CHALLENGE. CHAPTER 59 MASSAGE THERAPY BUSINESS LICENSE ORDINANCE WAS RULED UNCONSTITUTIONAL BY THE DISTRICT COURT, AND THE COURT RULED THAT THE EXISTING CHAPTER 59 MASSAGE THERAPY BUSINESS LICENSE EXCEEDS LEGISLATIVE HOME RULE POWERS AND IS IMPLIEDLY PREEMPTED BY STATE LAW.

OH, SORRY. THANK YOU.

AFTER ANALYZING THE COURT'S RULING.

WE CLOSELY WORKED WITH OUR CITY LEGAL DEPARTMENT, BUT WE AND WE SURVEYED OTHER CITIES APPROACHES TO THE ISSUE.

WE DETERMINED THAT THE BEST AND PERHAPS ONLY OPTION WAS TO REPEAL THE CURRENT CHAPTER 59 MASSAGE THERAPY BUSINESS LICENSE AND ENACT A NEW.

CHAPTER 59 MASSAGE THERAPY, INCORPORATING THE EXISTING 152C.

AND WE DID WORK CLOSELY WITH OUR LEGAL DEPARTMENT AT REVIEWING THE RULING, WHAT OPTIONS WE HAD MOVING FORWARD.

SO WHAT WILL BE REMOVING FROM CHAPTER 59 MASSAGE THERAPY BUSINESS LICENSE? IS THE BUSINESS LICENSE.

PART OF IT WILL BE REMOVING THE REQUIREMENT TO HOLD A CITY LICENSE TO PERFORM MASSAGE THERAPY, REMOVING THE CITY LICENSE FEE, REMOVING THE CITY APPLICATION PROCESS.

SO, IN REPEALING CHAPTER 59 MASSAGE THERAPY BUSINESS LICENSE ORDINANCE AND ENACTING A NEW CHAPTER 59 MASSAGE THERAPY.

THIS ORDINANCE WILL CONTAIN FOUR PARTS.

59.01 IS THE STATEMENT OF PUBLIC PURPOSE.

THE CITY OF CEDAR RAPIDS RECOGNIZES THE BENEFITS AND IMPORTANCE OF SERVICES WHICH ADDRESS HEALTH AND WELL-BEING OF ITS RESIDENTS.

THE CITY OF CEDAR RAPIDS ALSO RECOGNIZES, HOWEVER, THAT SOME INDIVIDUALS AND BUSINESSES MAY ENGAGE IN ILLEGAL ACTIVITY, INCLUDING HUMAN TRAFFICKING AND PROSTITUTION, IN CONNECTION WITH AND OR UNDER THE GUISE OF PROVIDING MASSAGE THERAPY SERVICES.

SUCH ILLEGAL ACTIVITY IS HARMFUL TO PUBLIC HEALTH, SAFETY, AND WELFARE, AND NEGATIVELY IMPACTS THE LEGITIMATE PRACTICE OF MASSAGE THERAPY.

PROFESSION. THE CITY OF CEDAR RAPIDS SEEKS TO BALANCE THE LEGITIMATE INTERESTS OF THOSE WHO LAWFULLY PROVIDE AND SEEK MASSAGE THERAPY, WITH THE PUBLIC INTEREST IN DETECTING AND HOLDING ACCOUNTABLE THOSE WHO ENGAGE IN ILLEGAL ACTIVITIES, SUCH AS HUMAN TRAFFICKING AND PROSTITUTION.

59.02. DEFINITIONS.

THE PURPOSE OF THIS CHAPTER.

THE DEFINITIONS SET FORTH IN IOWA CODE CHAPTER 152C AS THOSE TERMS MAY HEREAFTER BE AMENDED FROM TIME TO TIME, SHALL GOVERN THE IMPLEMENTATION AND ENFORCEMENT OF THIS CHAPTER.

50 903 THE STATE LAW AND REGULATIONS GOVERNING MASSAGE THERAPY.

IT IS UNLAWFUL FOR MASSAGE THERAPY IN THE CITY OF CEDAR RAPIDS, EXCEPT IN COMPLIANCE WITH THE IOWA CODE REGULATIONS ADOPTED PURSUANT THERETO AND THE REQUIREMENTS OF THE IOWA BOARD OF MASSAGE THERAPY.

59.04. PENALTIES.

A VIOLATION OF THIS CHAPTER IS DECLARED TO BE A MUNICIPAL INFRACTION AND A SIMPLE MISDEMEANOR.

ANYONE FOUND TO HAVE COMMITTED A VIOLATION OF THIS CHAPTER, WHETHER IT'S PRINCIPAL AGENT OR WHETHER IT'S PRINCIPAL AGENT OR ACCESSORY TO THE VIOLATION, SHALL BE SUBJECT TO THE GENERAL ENFORCEMENT AND PENALTY PROVISIONS OF THE CEDAR RAPIDS MUNICIPAL CODE SECTIONS 1.06 AND OR 1.12.

YOU KNOW, WHEN WE STARTED LOOKING AT THIS SIX YEARS AGO, WE WEREN'T IN THE SAME PLACE THAT WE ARE TODAY.

NOT JUST WITH ACTUAL ORDINANCES, WITH ADDITIONAL STATE LAWS THAT HAVE BEEN ADDED SINCE THEN, BUT ALSO ALL OF THE INTERPERSONAL TRAINING THAT HAS HAPPENED WITHIN THE DEPARTMENT THAT WE SHOULD ALL BE VERY PROUD OF.

THIS KIND OF CRUSADE OF SORTS STARTED WITH ME BEING VERY ENGAGED WITH CHILDREN IN FOSTER CARE, KNOWING THAT THEY WERE EXTREMELY SUSCEPTIBLE TO BEING TRAFFICKED BECAUSE THEY HAD FEWER TIES AT HOME IF THEY HAD A HOME AT ALL.

AND THAT LACK OF PERMANENCY WAS SOMETHING THAT MAKE THEM AND OTHERS VERY VULNERABLE TO HUMAN TRAFFICKING.

SO, WE AS A CITY, HAD A LOT OF EDUCATION TO GET CAUGHT UP ON THE PRECARIOUSNESS AND THE REALITY OF BEING SUCH A GREAT LOGISTICAL LOCATION FOR HUMAN TRAFFICKING TO HAPPEN.

BUT SINCE THEN, YOU'LL SEE IN MANY OF OUR MANY OF OUR BUSINESSES, YOU'LL SEE INFORMATION ABOUT HUMAN TRAFFICKING.

YOU'LL SEE THAT INFORMATION IN OUR AIRPORTS.

WE'VE REALLY DEVELOPED A HUGE NETWORK OF PARTNERS, INCLUDING CHAINS INTERRUPTED, WHICH I CAN'T LEAVE OUT.

BUT I ALSO HAD THE OPPORTUNITY DURING ALL THIS PROCESS TO MEET WITH MULTIPLE SURVIVORS OF HUMAN TRAFFICKING AND JUST ASK THEM, WHAT DID YOU NEED THAT YOU DIDN'T HAVE THEN? AND WE'VE REALLY WORKED HARD TO INCORPORATE THEIR VOICES THROUGHOUT THIS PROCESS.

SO, IT IS SOMETHING THAT I JUST WANT TO BE INFINITELY CLEAR ABOUT.

WE ARE NOT GIVING UP ON OUR PURSUIT OF COMBATING HUMAN TRAFFICKING AT ALL.

THAT PURSUIT WILL NEVER STOP.

AND OVER THE LAST SIX YEARS, WE HAVE GAINED AN INCREDIBLE PARTNERSHIP WITH ONE ANOTHER AND WITH OUR COUNCIL TO KNOW THAT IT HAPPENS.

IT HAPPENS RIGHT HERE AND WHAT IT LOOKS LIKE.

AND SO, ALTHOUGH THE STATE HAS FINALLY CAUGHT UP TO SOME OF THE PRINCIPLES THAT WE WORKED REALLY HARD TO BE THE LEADER ON SIX YEARS AGO, I JUST WANT TO MAKE THAT CLEAR TO OUR PUBLIC THAT HUMAN TRAFFICKING IS NOT WELCOME IN CEDAR RAPIDS, AND WE WILL CONTINUE DOING EVERYTHING TO COMBAT IT ON EVERY LEVEL.

THANK YOU. MAYOR, HAS THE CHANGE IN THE STATE LAW? THEY WERE REDOING A WHOLE SERIES OF DIFFERENT BOARDS AND REGISTRATION TYPE THINGS, YOU KNOW, ARCHITECTURE, REGISTERED REAL ESTATE AGENTS.

AND THEY DID KEEP IN PLACE THEN THE LICENSING AND TRAINING THINGS THROUGH THE STATE LAW.

THAT'S ONE PART. SO, THE BIG DIFFERENCE IS WE GOT A LITTLE TOUGHER, YOU KNOW, ON REQUIRING EXTRA.

LICENSE CHECKS, WHICH WAS ALSO BACKGROUND CHECKS, WHAT'S ON THE DARK WEBSITE, ETCETERA.

HOW DO WE STILL KEEP DOING SOME OF THOSE THINGS? WE DON'T HAVE A WAY TO DO THAT BECAUSE THEY'RE NOT GOING TO THE CITY.

AS LONG AS THEY GET A STATE LICENSE, THEY'RE LEGAL.

SO, COREY, DO YOU WANT TO MAYBE ADD ANY THOUGHTS ON THAT? WHAT WE FOUND IS WE DUG INTO THIS IS THE IOWA ADMINISTRATIVE CODE FOR MASSAGE THERAPY IS A PRETTY POWERFUL PIECE OF ADMINISTRATIVE LAW THAT HOLDS MASSAGE THERAPISTS AND MASSAGE THERAPY BUSINESSES ACCOUNTABLE.

SO, AS WE LEARNED MORE ABOUT THAT ADMINISTRATIVE CODE, WE LEARNED THAT THERE'S A LOT OF TOOLS ADMINISTRATIVELY THAT WE CAN DO AS WELL TO HOLD MASSAGE THERAPY BUSINESSES AND MASSAGE THERAPISTS WHO AREN'T IN COMPLIANCE.

WE CAN HOLD THEM ACCOUNTABLE AS WELL, WHETHER IT'S NOT NECESSARILY A CRIMINAL ACT, BUT IT WOULD BE AN ADMINISTRATIVE ACT BY THE IOWA MASSAGE THERAPY BOARD. SO IF WE FIND A VIOLATION, WE THEN GO BACK TO THE STATE BOARD.

THAT WOULD THEN PULL THEIR LICENSE.

IS THAT HOW THAT WORKS VERSUS US HAVING THAT CONTROL? THAT'S CORRECT. PULL THEIR LICENSE IS ONE OF MANY OPTIONS THAT WE DISCOVERED DURING OUR RESEARCH.

THAT'S OKAY. 916 FIFTH STREET SOUTHEAST AND 512 10TH AVENUE SOUTHEAST WERE ACQUIRED IN 2011 AND 2010, RESPECTIVELY, WITH COMMUNITY DEVELOPMENT BLOCK GROUP BLOCK GRANT FUNDS AND ARE 7800FT² COMBINED.

BOTH PROPERTIES ARE ZONED TRADITIONAL RESIDENTIAL SINGLE UNIT.

WHICH IS INTENDED TO PROVIDE SINGLE UNIT NEIGHBORHOOD LEVEL DEVELOPMENT MEDIUM TO HIGH DENSITY.

BOTH PROPERTIES ARE IN THE 100-YEAR FLOOD PLAIN, AND SO WOULD NEED TO NEED TO FOLLOW FLOODPLAIN REQUIREMENTS.

IF APPROVAL OF THE RESOLUTION IS GRANTED, THE RFP WILL BE ISSUED AND PROPOSALS WILL BE DUE ON DECEMBER 1ST.

ON JANUARY 9TH, WE WOULD COME BACK TO COUNCIL FOR CONSIDERATION AND SELECTION OF THE PROPOSAL.

NEGOTIATION OF THE DEVELOPMENT AGREEMENT WOULD FOLLOW IN SPRING 2024.

WITH THAT, STAFF RECOMMENDS THE APPROVAL OF THE RESOLUTION AND THE INITIATION OF THE COMPETITIVE DISPOSITION PROCESS BY CITY COUNCIL.

BOTH THE CITY AND IOWA CODES ALLOW FOR CREATION OF AN EXTENSION CHARGE TO RECOVER THE COST OF PUBLIC UTILITY PROJECTS WITHIN THE AREA SERVED.

CEDAR RAPIDS CURRENTLY HAS FOUR OF THESE SUCH DISTRICTS, AND I'LL GO INTO THOSE IN MORE DETAIL LATER IN THE PRESENTATION.

AND AS A POINT OF CLARIFICATION, THIS IS DIFFERENT THAN THE STANDARD CONNECTION FEE, AND THIS WOULD BE IN PLACE OF THAT CONNECTION FEE.

SO THE PROJECT WAS TO EXTEND 16 INCH SANITARY SEWER FROM E AVENUE NORTHWEST DOWN TO 16TH AVENUE.

THE ALIGNMENT AND THE PROJECT LOCATION IS SHOWN ON THE RIGHT WITH THE MAP THERE.

THAT'S DRIVEN MOSTLY BY TOPOGRAPHY, BUT WE DID COORDINATE THE ALIGNMENT SOMEWHAT WITH MULTIPLE PLANNED DEVELOPMENTS.

340 ACRES SERVICE AREA PROJECT WAS BID LAST JULY AND THE SEATING WAS COMPLETED LAST MONTH.

SO IT'S ESSENTIALLY COMPLETE AND THE PROJECT COST IS APPROXIMATELY 1.4 MILLION.

HERE'S A MAP SHOWING THE DISTRICT BOUNDARIES, WHICH IS ALSO THE SERVICE AREA OF THE SEWER.

NORTH IS TO THE LEFT.

GET. YOUR ORIENTATION GENERALLY FOLLOWS TOPOGRAPHY, BUT THEN ALSO THE EXISTING BOUNDARIES OF WHAT'S SERVED CURRENTLY.

THIS PROJECT WAS A BIT SPECIAL AND IT HAD SOME UNIQUE CHALLENGES.

SPAN MULTIPLE PROPERTIES, BUT ALSO THERE WERE MULTIPLE ROAD CLOSURES FOR SEWER CROSSINGS AND CONNECTIONS.

THE CONNECTION POINT IN THE AVENUE WAS A DEEP CONNECTION THAT REQUIRED A SIGNIFICANT ROAD CLOSURE, AND ALSO CROSSINGS OF 80TH STREET AND 80TH STREET.

LANE CROSSINGS OF TWO LARGE WATER MAINS AT TWO DIFFERENT LOCATIONS, AND DRAINAGE WAY CROSSINGS THAT REQUIRED ARMORING, POOR SOILS THAT REQUIRED DEWATERING, ADDITIONAL TRENCH BEDDING AND MODIFIED MANHOLES, AND ALL OF THAT LED TO A HIGHER THAN AVERAGE COST, WHICH WILL GO INTO THE CALCULATIONS OF THE PROPOSED FEE IN A MINUTE.

THAT'S SOME BACKGROUND ON THE PROJECT.

SPECIFICALLY, SERVICE AREAS LOCATED WITHIN THE WEST GROWTH AREA OF THE ENVISIONED PLAN INCLUDES APPROXIMATELY 60 ACRES IN CITY LIMITS.

REMAINING AREAS NOT YET ANNEXED NOR SUBSTANTIALLY DEVELOPED.

SOME PROPOSED DEVELOPMENTS WITHIN THE DISTRICT INCLUDE THE ENDERLEY COMMERCIAL DEVELOPMENT, BENSON'S FIRST EDITION, AND HEMPEL CROSSROADS ADDITION.

SO THE FEE WE'RE PROPOSING TODAY IS 3100 AN ACRE.

THIS REPRESENTS ABOUT A 75% RECOVERY OF PROJECT COSTS.

THIS WOULD BE AGAIN IN PLACE OF THE CONNECTION CHARGE, WHICH IS CURRENTLY $2,000 FOR SINGLE OR TWO FAMILY RESIDENCES OR 1000 AN ACRE WITH A MINIMUM OF 2000 FOR ALL OTHER USES.

AND THE REASON WE'RE PROPOSING THE EXTENSION CHARGE IS TO RECOVER MORE OF THAT PROJECT COST THAN WITH THE STANDARD CONNECTION FEE WOULD ALLOW.

WE'RE ALSO PROPOSING AN ANNUAL INTEREST RATE OF 3.0%, NOT TO EXCEED TWICE THE ORIGINAL EXTENSION CHARGE, WHICH IS CONSISTENT WITH OUR C AVENUE AND WEXFORD DISTRICTS. A LITTLE MORE BACKGROUND ON THIS.

BACK IN MAY, WE SENT LETTERS OUT TO PROPERTY OWNERS OF UNDEVELOPED LAND IN THE DISTRICT TO GET THEIR FEEDBACK.

AT THE TIME, WE WERE PROPOSING A 100% RECOVERY PROJECT COSTS, WHICH WOULD BE $4,100 AN ACRE.

WE WERE ALSO PROPOSING A LITTLE BIT HIGHER INTEREST RATE, THE 4.56%, WHICH WAS BASED ON SEWER BONDS AT THE TIME.

UM, AND WE DID HAVE ONE OBJECTOR AND WE DISCUSSED THAT WITH THEM AND ALSO INFRASTRUCTURE COMMITTEE.

WE HAD INFRASTRUCTURE COMMITTEE PRESENTATIONS BACK IN MARCH AND ALSO IN JULY.

AND AFTER ALL OF THAT DISCUSSION, THAT'S WHY WE'RE PROPOSING A MODERATED FEE OF 3100 AN ACRE.

NOW. WHICH IS A LITTLE MORE CONSISTENT WITH SOME PREVIOUS DISTRICTS.

HERE'S A BREAKDOWN OF THE DISTRICTS THAT WE ALREADY HAVE WITH THE PROPOSED DISTRICT AT THE TOP.

C AVENUE NORTHEAST DISTRICT IS PROBABLY THE MOST SIMILAR IN SCOPE.

IT DIDN'T HAVE AS MANY CHALLENGES AS THIS PROJECT DID, AND THE COST PER ACRE IS LOWER.

BUT ALSO IT OVERLAPS WITH SOME MARION DISTRICTS, WHICH, DEPENDING ON THE TYPE OF DEVELOPMENT, COULD ADD PRETTY SIGNIFICANTLY TO THE COST PER ACRE.

THERE'S ALSO THE JOHNSON COUNTY WATER AND SEWER EXTENSION.

THAT ONE IS A BIT DIFFERENT BECAUSE IT WAS THE DEVELOPER THAT EXTENDED THE SEWER, AND FOR EIGHT YEARS THE FEES ACTUALLY GO BACK TO THE

DEVELOPER. THAT ONE WAS 2000 AN ACRE FOR SEWER.

THERE WAS ALSO A DISTRICT FOR THE WEXFORD LIFT STATION.

IT WAS OVERSIZE TO SERVE ADDITIONAL AREA BEYOND THAT DEVELOPMENT.

AND SO THERE WAS A FEE PROPOSED AT 1300 PER RESIDENTIAL UNIT.

THAT'S IN ADDITION TO THE CONNECTION FEE AND A 3% ANNUAL INCREASE.

AND THEN THE WILLOWBROOK, GEORGIA DISTRICT, WHICH WAS SET ON A PER FOOT OF LOT FRONTAGE BASIS.

SO AS I MENTIONED, WE HAD INFRASTRUCTURE COMMITTEE, CITY COUNCIL, INFRASTRUCTURE COMMITTEE PRESENTATIONS IN MARCH AND JULY.

AND TODAY WE'RE RECOMMENDING APPROVAL OF THE FIRST READING OF THE EXTENSION CHARGE ORDINANCE WITH POTENTIAL SECOND AND THIRD READING NOVEMBER 7TH.

SO THE GOOD NEWS IS WE'RE IN IT'S SIMILAR NOW TO OTHERS WITH THE INTEREST RATE, AND IT'S STILL HIGHER ON THE OTHER PART, BUT IT'S A VERY UNIQUE THING AND WE'LL HOPEFULLY GENERATE A LOT MORE DEVELOPMENT ALONG HIGHWAY 100.

NOW, THIS IS NOT A THE FULL PUBLIC HEARING ON THAT PROJECT.

THIS IS AN ADVANCED PUBLIC HEARING THAT IS REQUIRED WHEN THE CITY GOES TO ACQUIRE ANY LAND FROM AN AGRICULTURAL PARCEL.

THERE IS ONE AGRICULTURAL PARCEL ON THIS PROJECT.

AND SO, WE'RE FOLLOWING THE REQUIREMENTS OF IOWA CODE SECTION 6B.

AND WE'VE NOTICED THE PROPERTY PUBLIC HEARING ON SEPTEMBER 13TH.

THERE IS SOME RIGHT-OF-WAYS, ALSO SOME TEMPORARY EASEMENT FROM THE PROPERTY.

THIS IS A PROJECT INCLUDES SOME BRIDGE MODIFICATIONS TO WIDEN THE SIDEWALK ON THE EAST SIDE TO A TRAIL WIDTH.

ALSO INVOLVES SOME BRIDGE REPAIR AND PAINTING AND REPAVING OF THE BRIDGE APPROACHES, AND THE UNIQUE FEATURE OF LINING THE WATER MAIN THAT'S HANGING CURRENTLY UNDER THE BRIDGE.

AS STATED, THE ENGINEER'S OPINION OF PROBABLE COST WAS $2.8 MILLION.

THIS IS PARTIALLY FUNDED BY SURFACE TRANSPORTATION BLOCK GRANT THROUGH THE FEDERAL GOVERNMENT, AND THE IOWA DOT LETTING OCCURRED JUST LAST WEEK ON OCTOBER 17TH. THIS IS A LOCATION MAP.

THIS IS THE EDGEWOOD ROAD BRIDGE OVER THE CEDAR RIVER.

THERE ARE FIVE BIDDERS HERE.

THE RANGE FROM LOW $3,709,833.91 TO THE HIGH $4,434,591.93. NOW, AS WE NOTED, WITH THE 2.8 MILLION ENGINEER'S ESTIMATE, THE LOW BID WAS APPROXIMATELY $900,000, MORE THAN THE ENGINEER'S OPINION OF PROBABLE COST.

HOWEVER, WHEN WE LOOK AT THE RANGE OF BIDS, THAT WAS A PRETTY GOOD GROUPING.

SO WE FEEL LIKE THE BIDDERS WERE AT LEAST LOOKING AT IT.

SIMILARLY, LOOKING AT THE ANALYSIS OF THE BID TAB, WE NOTED THERE WERE ABOUT FOUR BID ITEMS THERE THAT KIND OF DRIVEN THE COST DIFFERENCE IN WHAT THE ENGINEER THOUGHT.

THERE'S THREE OF THEM THERE.

THERE'S THE CONTAINMENT OF THE SANDBLASTING OVER THE RIVER, SOME REMOVALS AND SOME MOBILIZATION.

AND WHEN AN ENGINEER LOOKS AT THAT, IN THIS CASE, THEY FOUND A WIDE VARIATION IN COSTS THAT WERE BID THROUGH THE DOT.

AND IT'S REALLY HARD TO PUT DOWN A, TO NAIL DOWN A REALLY GOOD COST WHEN YOU'VE GOT KIND OF A WIDE GROUPING TO GO ON.

THE OTHER THING WAS LINING THE WATER MAIN.

THAT WAS A FAIRLY SIGNIFICANT COST INCREASE OR DIFFERENCE.

IT IS REALLY A RARE ITEM.

YOU DON'T TYPICALLY SEE THAT ON PROJECTS BID THROUGH THE IOWA DOT.

OUR CONSULTANT DID CONTACT CONTRACTORS TO TRY TO GET A FEEL FOR THE COST, AND THEY BASED THEIR ESTIMATE IN PART ON THAT AS WELL.

HOWEVER, IT'S IT'S NO GUARANTEE THAT THE BIDDERS ARE GOING TO GO OUT TO THE SUB CONTRACTOR DOING THE WATER MAIN WORK AND FOR THAT PARTICULAR ONE AND GETTING THAT THAT QUOTE FROM THEM.

I ALSO, I NOTICE ONE OF THE REASONS WHY THE COSTS WOULD HAVE BEEN HIGHER THAN THE ORIGINAL OPINION IS BECAUSE THESE BIDDERS ARE NOT LOCAL BIDDERS, AND THEIR MAJOR WORK IS A HEAVY HIGHWAY CONSTRUCTION TO THE IOWA DOT.

SO, THEY ARE BUSY ALL YEAR LONG AND GENERALLY WORKING ON HIGHER PRICED WORK.

RAMIFICATIONS OF NOT AWARDING THE CONTRACT AS YOU WERE PREVIOUSLY INFORMED, WE DID NOT GET A BID LAST APRIL FOR THE PROJECT.

I FEEL LIKE DELAYING IT.

THERE'S NO GUARANTEES.

WE'RE GOING TO SHARPEN OUR PENCILS AND WIPE OUT THE $900,000.

I THINK WE'RE JUST GOING TO HAVE FURTHER ISSUES OF NOT BEING ABLE TO AWARD THE CONTRACT.

WITH THAT, THERE IS NO ACTION TODAY ON THIS.

THE DOT STILL NEEDS TO REVIEW THE BID, AND THEN THEY'RE GOING TO ISSUE A CONCURRENCE ON THAT.

THESE PROPHECIES OF DOOM SIMPLY NEVER COME TRUE.

THE POLAR BEARS ARE STILL HERE.

ACTUALLY, THEIR POPULATION IS BOOMING, SO THE ICEBERGS, OBVIOUSLY THEY AREN'T MELTING.

THE SEA HASN'T RISEN.

THE OZONE LAYER IS FINE.

BUT THE POINT OF THIS MESSAGING IS TO MAKE THE PUBLIC AFRAID.

BECAUSE IF CLIMATE APOCALYPSE IS IMMINENT, THEN GOVERNMENTS OF THE WORLD CAN CENTRALIZE THEIR POWER AND CONTROL AND CONTROL EVERYONE'S ACTIONS WITH THE SO CALLED EMERGENCY.

THIS IS NOT SERVING THE AMERICAN INTEREST AND THE PEOPLE OF THIS CITY.

YOU'RE TRYING TO CONTROL US AND MAKE US WEAK.

DEPARTMENT IN 2017 TO DEVELOP A SOCIAL MEDIA RECRUITMENT PLAN FOR THE CITY.

THEY WERE HAVING TROUBLE.

THEY ATTRACT PEOPLE, AND THE PEOPLE WOULD COME, COME, COME THERE.

AND THEY WOULD WORK FOR A YEAR OR A YEAR AND A HALF, WHATEVER THEIR CONTRACT WAS.

AND THEN THEY TAKE A JOB WITH A STARTUP BECAUSE THERE'S A BIG STARTUP CULTURE GOING ON THERE.

SO, THEY HAD A REAL PROBLEM WITH RETENTION.

AND THEY ALSO HAD A PROBLEM WITH ATTRACTING DIVERSE EMPLOYEES.

AND SO, THEY WERE LOOKING FOR SOMEBODY TO DO SOME WORK ON THAT.

SO THE FIRST THING I DID WHEN I WAS DEVELOPING MY PITCH FOR THEM WAS TO LOOK AT THE DEMOGRAPHIC DATA, AND I REALIZED THAT A CITY THAT PRESENTS ITSELF AS WELCOMING AND INCLUSIVE IS THE LEAST DIVERSE CITY IN THE AREA.

THE. I SENT AN EMAIL TO YOU WITH A WITH A SLIDE DECK, AND SLIDE NINE OF THAT DECK SHOWS TWO DIFFERENT IMAGES.

IT SHOWS THAT WELD COUNTY AND THE OTHER COUNTIES THAT ARE AROUND THE AREA, AND IT'S GOT AN IMAGE OF OF BOULDER.

BOULDER IS AT THE TIME WAS 83% WHITE.

THE US AS A WHOLE IS 40% WHITE, AND COLORADO IS SOMEWHERE IN COLORADO AS A WHOLE IS SOMEWHERE IN BETWEEN THOSE.

AND SO I STARTED LOOKING AT WHAT IS THE REASON FOR THAT AND WHAT IS IMPACTING THAT DIVERSITY IN A IN A WELCOMING CITY LIKE BOULDER.

AND IT REALLY CAME DOWN TO A FEW DIFFERENT THINGS.

IT CAME DOWN TO NUMBER ONE DEVELOPMENT WAS WAS ONE OF THE PIECES.

AND THEY HAVE A UNIQUE DEVELOPMENT APPROACH IN BOULDER.

THEY HAD ACTUALLY CAPS DEVELOPMENT SO THAT HOUSES COULDN'T BE BUILT HIGHER THAN THE TREE LINE.

AND THEY HAD CREATED A DEVELOPMENT CIRCLE AROUND THE CITY THAT THEY WEREN'T GOING TO GO BEYOND.

AND THEY PURCHASED BETWEEN THE LAND THAT HAD BEEN DEVELOPED AND THAT OUTER BOUNDARY, THEY PURCHASED THE LAND AND APPLIED IT TO NATURAL RESOURCES.

SO THEY HAVE PLENTY OF TRAILS, PLENTY OF OF HUMAN ACCESS.

WHAT THAT DID IS AS AS THE ECONOMY GREW WITH STARTUPS AND, AND DEVELOPMENT AND TECHNOLOGY AND FOOD STARTUPS, THEY DO MOST OF THE FOOD.

IF YOU MAIL ORDER FOOD, MOST OF THAT IS BRANDED IN BOULDER.

AND SO THE PROBLEM WAS THAT THEY WEREN'T DEVELOPING ANY NEW HOUSING.

AND SO THE PRICE OF PROPERTY WAS SKYROCKETING.

SO THE MEDIAN HOUSEHOLD VALUE IS $750,000.

MOST OF THE DOWNTOWN HOMES ARE 1 TO $2 MILLION, AND CEDAR RAPIDS IS AT RISK OF CREATING THE SAME KIND OF SCENARIO.

BUT DURING DURING THE DAY BOULDER, IT SEEMS VERY DIVERSE, AND IT'S BECAUSE PEOPLE COME IN TO WORK FROM THE OUTSIDE AREAS INTO THE CITY.

AND THEN AT 5:00 THEY LEAVE.

AND SO, AT FIVE AND LATER, IT'S AN 83% WHITE COMMUNITY.

AND DURING THE DAY, THERE'S LOTS OF WORKERS THAT ARE DIVERSE.

AND SO WHEN I'M LOOKING AT THE WAY THAT CEDAR RAPIDS IS DEVELOPING, I SEE SIMILARITIES, ESPECIALLY IN THE PRESSURE ON THE DOWNTOWN REGION.

AND I THINK THAT THAT WHEN WE'RE LOOKING AT THE WAY THAT THE CITY DEVELOPS, WE I THINK THAT THE DOWNTOWN I THINK WELLINGTON HEIGHTS IS A GEM OF THE CITY. THE DIVERSITY THERE, IT'S 40% DIVERSE, WHICH IS SIMILAR TO THE DIVERSITY OF THE UNITED STATES.

WHEN WE'RE LOOKING AT BUSINESS DEVELOPMENT, ONE OF THE KEY THINGS IN BUSINESS DEVELOPMENT IS YOU WANT TO UNDERSTAND HOW PEOPLE THAT ARE DIFFERENT FROM YOU EXPERIENCE AND LIVE THEIR LIVES SO THAT YOU CAN CREATE PRODUCTS AND SERVICES THAT DELIVER TO THEM.

WELLINGTON HEIGHTS SHOULD BE WHERE WE SHOULD LOVE THAT AREA AND PROTECT ITS DIVERSITY AND GROW THAT DIVERSITY AS, AS, AS A MICROCOSM OF THE UNITED STATES AS A WHOLE.

AND SO, IN THAT REGARD, I THINK THAT THAT, YOU KNOW, WHEN WE'RE LOOKING AT DEVELOPMENT OF THE CITY OF THE OF THE COLLEGE DISTRICT, THERE ARE SOME AREAS THAT ARE HIGH DIVERSITY IN THAT ZONE UP FIRST AVENUE AND WEST, AS YOU GO TOWARDS THE CATHOLIC COLLEGE, THERE'S OTHER AREAS. YOU KNOW, I HAVE QUESTIONS ABOUT HOW FAR INTO WELLINGTON HEIGHTS THAT IS GOING TO EXTEND FOR A SECOND AND SO ON AND SO FORTH.

AND THEN ALSO THE MED CORRIDOR.

WE'VE ALREADY HAD A CONVERSATION ABOUT THE MED CORRIDOR AND ITS DEVELOPMENT.

AND IT'S, YOU KNOW, ASKING PROFESSIONALS IN THE MEDICAL FIELD, DO THEY WANT TO SEE THE MED CORRIDOR DEVELOP EXPANDED.

PEOPLE. WHEN THEY GET PUSHED OUT OF A DIVERSE COMMUNITY, THEY GET PUT INTO SITUATIONS WHERE THEY DON'T HAVE A COMMUNITY AROUND THEM, THEY DON'T HAVE THE SAFETY OF A NETWORK.

AND THAT'S ANOTHER CONSIDERATION, I BELIEVE.
