THE PUBLIC HEARING NOW TO CONSIDER THE AUTHORIZATION OF THE ISSUANCE OF NOT TO EXCEED $12,000,500 GENERAL OBLIGATION URBAN RENEWAL BONDS, FY 24 GEO BONDS FOR BUDGETED PROJECTS.

AT THE FEBRUARY 13TH COUNCIL MEETING, I PRESENTED THE SERIES 2024 A GENERAL OBLIGATION BONDS.

THESE WERE PUBLIC HEARINGS TWO THROUGH FIVE FOR A PUBLIC OR FOR A TOTAL PAR OF $53,095,000.

TODAY I'M PRESENTING AN ADDITIONAL PIECE OF SERIES 2024 ASSOCIATED WITH THE URBAN RENEWAL AREA.

THE PROPOSED STREETS AND TRAFFIC CONSTRUCTION PROJECT COSTS WILL BE $12 MILLION.

ANTICIPATED ISSUANCE COSTS OF $215,000, FOR A TOTAL PAR OF $12,215,000.

SO, WITH YOUR APPROVAL TODAY, THE TOTAL PAR SOLD FOR SERIES 2024 A WILL BE $65,310,000.

THIS IS THE UPCOMING SCHEDULE FOR THE BOND SALE ON APRIL 23RD.

WE'LL SET THE SALE DATE, APPROVE THE PRELIMINARY OFFICIAL STATEMENT AND ELECTRONIC BIDDING ON MAY 14TH.

WE WILL ACCEPT BIDS AND AWARD THE BONDS ON MAY 28TH.

WE'LL APPROVE THE FINAL DOCUMENTS AND THEN THE DELIVERY OF FUNDS.

AND THE OFFICIAL CLOSING WILL BE ON JUNE 18TH.

FINANCE RECOMMENDS APPROVING THE RESOLUTIONS, INSTITUTING PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF GENERAL OBLIGATION URBAN RENEWAL BONDS.

A public hearing will be held to consider repealing Chapter 61 of the Municipal Code, Traffic Regulations, and enacting a new Chapter 61 in its place to include new and updated definitions; regulate the use of all-terrain vehicles, off-road vehicles, golf carts and snowmobiles; add or increase parking fees; and comply with current practice and relevant law (Heidi Stiffler and Sgt. Graham Campshure). (Council Priority) CIP/DID #FIN2024-10]

61, IN ITS PLACE TO INCLUDE NEW AND UPDATED DEFINITIONS, REGULATE THE USE OF ALL-TERRAIN VEHICLES, OFF ROAD VEHICLES, GOLF CARTS AND SNOWMOBILES, ADD OR INCREASE PARKING FEES, AND COMPLY WITH CURRENT PRACTICE AND RELEVANT LAW.

THE FIRST PART OF THIS IS AMENDING THE CHAPTER 61 CODE TO ADD A SECTION REGARDING THE REGULATION OF ATV AND UTV ORDINANCES.

SOME OF THE BACKGROUND IS IN 2022, THE STATE CHANGED THE LAW THROUGHOUT THE STATE REGARDING THE USE OF ATVS AND ATVS ON COUNTY SECONDARY ROADS.

WE HAVE BEEN RECEIVING MULTIPLE CALLS.

ARE THEY LEGAL IN THE CITY? ARE THEY NOT? SO THE WHOLE IDEA OF ADDING 61, 141 WAS TO HAVE CLEAR GUIDANCE TO THE PUBLIC ON THEIR USAGE IN THE CITY.

OOPS. FIRST OF ALL, HERE'S THE CODE IN AND OF ITSELF, WHERE WE PROHIBIT THE USE OF THEM IN THE CITY, EXCEPT FOR THE LISTED GOVERNMENT VEHICLES, UTILITY VEHICLES, UTILITY COMPANIES, GOVERNMENT AGENCIES, AND THAT KIND OF OTHER ENTITIES THAT WOULD NEED TO USE THEM THROUGHOUT THE CITY.

I THINK IT WENT TOO FAR.

THERE WE GO. NO, I DID NOT.

BASICALLY, THE FINE FOR THIS WOULD BE A SCHEDULE VIOLATION, WHICH IS THE SAME AS A TRAFFIC CITATION.

SO, IF SOMEBODY IS USING A UTV OR ATV OR GOLF CART IN THE CITY LIMITS, THEY COULD BE STOPPED AND CITED WITH A TRAFFIC VIOLATION.

AND THEN THERE WOULD BE A SET AMOUNT BASED ON IOWA CODE.

AND THAT IS ALL I HAVE FOR THE ATV/UTV.

SO, THE OTHER CHANGES PROPOSED TO THE ORDINANCE RELATE TO PARKING OPERATIONS.

THERE ARE CHANGES IN THE ORDINANCE TO ALIGN WITH CURRENT PRACTICE, AS WELL AS RELEVANT LAW, AS WELL AS IMPLEMENTING A FEW RATE INCREASES FOR THE PARKING SYSTEM.

SO THE RATE INCREASES ON THIS SLIDE ARE PROPOSED TO ASSIST WITH RECOVERING OPERATING COSTS, SETTING ASIDE FUNDS FOR DEBT AND CAPITAL NEEDS WHILE STILL CHARGING COMPETITIVE RATES. THE FIRST PROPOSAL IS TO INCREASE THE ON-STREET PARKING FEE FROM $1 PER HOUR TO $1.25 PER HOUR, MONDAY THROUGH FRIDAY, 9 A.M.

TO 5 P.M., SO NO CHANGES IN THE DAYS OR THE HOURS ENFORCED, JUST AN INCREASE IN THE RATE OF $0.25 PER HOUR.

RAMPS AND LOTS WILL STILL BE AT $0.75 PER HOUR, SO THERE WILL BE A LOWER COST OPTION FOR PEOPLE THAT CHOSE CHOOSE TO NOT PAY THE HIGHER ON STREET PARKING RATE.

OTHER CHANGES TO THE ORDINANCE INCLUDE AN INCREASE IN THE PENALTY FOR VIOLATIONS NOT PAID WITHIN 30 DAYS.

THE FEE INCREASE WOULD BE FROM 5 TO $10 PER PENALTY.

THERE'S ALSO A PROPOSED INCREASE TO LOST TICKET FEE TO INCREASE FROM 12 TO $24 IF A DUPLICATE TICKET NEEDS TO BE PRODUCED.

THE CURRENT ORDINANCE HAS VERBIAGE TO ALLOW ON STREET FEEDS FOR FOOD TRUCKS.

ADDITIONAL VERBIAGE WOULD BE ADDED WITH THIS UPDATE TO EXPAND OPPORTUNITIES TO ALLOW FOOD TRUCKS AND LOTS AND RAMPS AT THE SAME FEE AS ON STREET PARKING, WHICH IS $5 PER DAY. AND THEN THE FINAL CHANGE WOULD BE AN INCREASE IN THE METER PLACARD FEE FROM 2 TO $3 PER DAY.

A METER PLACARD IS JUST A WAY TO RESERVE AN ON-STREET SPACE FOR A FEW HOURS AT A SPECIFIC TIME, SO IT'S A LOWER COST OPTION THAN HAVING A METER FOR AN ENTIRE DAY.

SO, THIS CONCLUDES OUR PRESENTATION TO REPEAL AND REPLACE CHAPTER 61 AND MUNICIPAL CODE FOR TRAFFIC REGULATIONS.

FINANCE AND POLICE RECOMMEND APPROVAL OF THE FIRST READING OF THE ORDINANCE WITH SECOND AND POSSIBLE THIRD READINGS ON MARCH 12TH.

CONCERNING THE ATV USE.

IT'S MY UNDERSTANDING THAT MARION HAS LEGALIZED THE USE OF ATVS IN THEIR CITY LIMITS.

FAIRFAX HAS LINN COUNTY HAS ATVS ARE PROVIDING MORE VISIBILITY THAN ELECTRIC BIKES, BIKES OR MOPEDS.

ELECTRIC BIKES AND SCOOTERS ARE PROVIDED BY THE CITY FOR RENT THAT ARE DRIVEN IN THE STREETS CURRENTLY ALL OVER THE CITY, ESPECIALLY DOWNTOWN.

MY SIDE BY SIDE IS REGISTERED WITH TAGS.

REAR VIEW MIRRORS, HAZARD LIGHTS, TURN SIGNALS, SEATBELTS, A HORN DOORS, VIRTUALLY EVERYTHING THAT A CAR HAS.

THEY GO FAST ENOUGH THAT THEY DO NOT IMPEDE TRAFFIC FLOW.

LIKE I SAID, IN MY SIDE BY SIDE IS REGISTERED AND LICENSED THROUGH THE LINN COUNTY WITH THE DNR.

WITH MY SNOWPLOW ON MY SIDE BY SIDE, I DO A LOT OF VALUABLE PUBLIC SERVICE FOR SENIOR CITIZENS, NEIGHBORS WITH HEALTH PROBLEMS, OR PEOPLE WHO IN GENERAL CANNOT REMOVE SNOW ON THEIR OWN. I'VE HELPED GET CARS UNSTUCK IN DEEP SNOW.

I DON'T CHARGE ANYBODY MONEY.

BUT I'VE BEEN THANKED BY COUNTLESS PEOPLE WHO APPRECIATE THE HELP THAT I CAN PROVIDE WITH MY SIDE BY SIDE.

THEY ARE MUCH MORE FUEL EFFICIENT THAN LOADING THEM ON A TRACTOR OR TRAILER TO MOVE THEM.

AND WE ARE SURROUNDED ONCE AGAIN BY CITIES THAT HAVE ALREADY LEGISLATED LEGALIZED ATV USE WITHIN CITY LIMITS.

I ASK THAT IT'S CONSIDERED TO PERMIT ATVS TO BE LEGALLY DRIVEN IN THE CITY LIMITS USING COMMON SENSE LEGISLATION.

LEGISLATION SUCH AS PERMITS, LICENSING, AND SAFETY EQUIPMENT.

I MEAN, DO WE HAVE CITY LIMIT SIGNS ON ALL OF THOSE SECONDARY ROADS COMING INTO CEDAR RAPIDS? I'VE BEEN IN CONTACT WITH PUBLIC WORKS, AND WE'RE WORKING ON CREATING SIGNAGE THAT WOULD BE PLACED IN THOSE AREAS ON THOSE ROADS COMING INTO TOWN.

SO, AN EXAMPLE WOULD BE SIXTH STREET SOUTHWEST.

AS YOU COME IN FROM LINN COUNTY OR BEVERLY ROAD SOUTHWEST, OVER BY GENERAL MILLS, THOSE KINDS OF ROADS THAT ARE OUT ON THE OUTLYING

AREAS THAT HAVE MIXED USE OF BOTH COUNTY AND CITY.

SO, WE ARE IN THE PROCESS OF WORKING WITH THEM TO GET SIGNS CREATED.

TWO THINGS. I REMEMBER WHEN WE WERE GOING OVER THE DRAFT, WE SPECIFICALLY TALKED ABOUT MARION AND SOME OF THE OTHER CITIES THAT DO ALLOW THESE VEHICLES.

AND I BELIEVE THE RESPONSE WAS THAT BECAUSE OF THE, YOU KNOW, NOT AS MUCH DENSITY IN THOSE CITIES.

THAT'S WHY THEY HAD PASSED THEM.

AND YOU KNOW, CEDAR RAPIDS, WE WERE CONCERNED ABOUT, YOU KNOW, ESPECIALLY CENTER CITY AND SOME MORE HIGHLY POPULATED AREAS.

SO, I DON'T KNOW IF EITHER OF YOU TWO CAN VALIDATE THAT OR ANY OTHER INSIGHT YOU WANT TO SHARE.

I CAN'T, COUNCILMAN.

WE ACTUALLY LOOKED AT DES MOINES, DAVENPORT, BETTENDORF, SIOUX FALLS, OR I'M SORRY, SIOUX CITY COUNCIL BLUFFS AND THEY'RE ALL CITIES WITH LARGER DENSITY POPULATIONS.

OBVIOUSLY, WE'RE THE SECOND LARGEST CITY IN THE STATE.

WE HAVE A VERY DENSE URBAN AREA.

AND THOSE CITIES HAVE ALSO BANNED THE USE OF ATVS, UTVS FOR RECREATIONAL USE IN THE CITY.

THEY PRIMARILY ALLOW FOR, AGAIN, EMERGENCY MANAGEMENT, MS UTILITIES, GOVERNMENT ENTITIES THAT NEED TO BE USING THEM TO GET AROUND, TO DO THE WORK THAT NEEDS TO BE DONE FOR INFRASTRUCTURE OR MAINTENANCE OF THE CITY.

SO THAT IS WHERE WE CAME.

WE LOOKED AT TO SAY, IS THIS A GOOD IDEA IN CEDAR RAPIDS OR NOT? AND GIVEN AGAIN, OUR BEING THE SECOND LARGEST AND OUR DENSITY, IT WAS DECIDED THAT IT WAS BEST THAT WE DO NOT ALLOW THEM FOR RECREATIONAL USE.

THAT RESPONSE DENSITY IS THE BIG DIFFERENCE HERE.

YOU KNOW, BEING AS LARGE AS WE ARE, EVEN WHEN WE'RE COMPARING, WITH THE EXCEPTION OF DES MOINES, THERE REALLY ARE NO CITIES THAT ARE AS LARGE AS WE ARE IN IOWA.

SO, IT IS VERY PARTICULAR TO THE SIZE AND DENSITY OF OF OUR HOUSING, OF OUR BUSINESSES AND SPECIFICALLY UNFORTUNATELY, YOU KNOW, ATVS, UTVS THE ACCIDENTS THAT CAN HAPPEN WITH THEM IF THEY WERE TO COLLIDE WITH CARS ARE REALLY SEVERE.

I CANNOT EMPHASIZE ENOUGH THAT THE FIRST INTERNSHIP I EVER HAD IN HEALTH CARE WAS WORKING IN THE BURN TREATMENT CENTER.

I'M NOT GOING TO DESCRIBE, BUT JUST TRUST ME WHEN I SAY THAT THESE INJURIES ARE LIFE THREATENING IF YOU SURVIVE THEM.

AND I UNDERSTAND THAT THERE ARE PEOPLE WHO USE THESE SAFELY.

AND I SAID, YOU KNOW, THERE'S THAT.

I DON'T HAVE THE AUTHORITY TO SAY THAT WHETHER OR NOT YOU COULD, YOU KNOW, I DIRECTED THEM TO THE PUBLIC WORKS DEPARTMENT AND EVERYTHING, BUT THERE WERE SOME LIABILITY ISSUES THAT THEY BROUGHT UP REGARDING THE USE OF PRIVATE VEHICLES TO DO WORK ON CITY STREETS, EVEN IF IT IS IN A HELPFUL WAY.

AND CEDAR RAPIDS HAS WHAT'S CALLED A MUNICIPAL SEPARATE STORM SEWER SYSTEM MS4 PERMIT.

THIS COMES FROM THE IOWA DNR.

AND THIS REQUIRES US TO REGULATE OUR EROSION, OUR STORM WATER DISCHARGES INTO OUR STORM WATER DRAINAGE SYSTEM.

AND WE ARE ONE OF 44 CITIES AND UNIVERSITIES THAT HAVE THIS PERMIT.

CHAPTER 71 SPECIFICALLY REGULATES THE EROSION AND SEDIMENT CONTROL FOR CONSTRUCTION SITES.

AND THE LAST TIME WE HAD LOOKED AT THIS CODE UPDATE WAS IN 2006.

SO, THIS IS A PROPOSAL TO REPEAL AND ENACT A NEW CHAPTER 71.

THE CHANGES TO 71 ARE I THINK THEY'RE FAIRLY COSMETIC AND THAT WE ARE UPDATING OUR TERMINOLOGY TO BE MORE CURRENT WITH OUR OPERATIONS.

SO, SOME EXAMPLES ARE LISTED HERE.

WE'RE JUST REMOVING SOME STAFF TITLES THAT REALLY DON'T ENFORCE THE CODE OR ADMINISTER THE CODE.

AND WE'RE ADDING THE TERM CITY STORMWATER OFFICIAL.

AND THAT WOULD BE ANYBODY THAT'S PART OF OUR WATER RESOURCES TEAM OF INSPECTORS AND STAFF.

AND THEY WOULD BE THE ONES INVOLVED IN ADMINISTERING THE CODE.

THE CODE APPEALS WOULD NOT GO DIRECTLY TO THE CITY MANAGER, BUT TO THE PUBLIC WORKS DIRECTOR.

AND THEN WE REMOVE SOME REFERENCES TO OBSOLETE DESIGN STANDARDS AND OTHER HANDBOOKS AND GUIDANCE THAT WE NO LONGER USE IN THE DEPARTMENT.

AND THEN MOVING ON TO CHAPTER 72 OF THE CEDAR RAPIDS MS4 PERMIT ALSO REQUIRES US TO MANAGE AND CONTROL STORMWATER FOR FLOOD AND EROSION RISKS.

AND THAT'S NOT ONLY FOR CONSTRUCTION SITES, BUT THAT'S FOR FINISHED DEVELOPMENT AS WELL.

AND THE CITY DOES HAVE BEST MANAGEMENT PRACTICES.

WE'VE ADOPTED THE IOWA STORMWATER MANAGEMENT MANUAL FOR MANY DIFFERENT WAYS TO CONTROL WATER QUALITY AND QUANTITY.

WE ALSO HAVE A COST SHARING PROGRAM TO ENCOURAGE RESIDENTS AND BUSINESSES TO CONSTRUCT SOME PRACTICES, AND WE WOULD REIMBURSE THEM FOR THOSE COSTS. THE THE CODE ALSO SETS THE STORMWATER UTILITY RATES AND ALSO CREDITS FOR THOSE OWNERS PROPERTY OWNERS THAT DO EDUCATION AND, AND HAVE SOME OF THOSE BEST MANAGEMENT PRACTICES ON THEIR PROPERTY, THEY'RE ELIGIBLE FOR SOME

CREDITS TO THE UTILITY RATE.

WE LAST LOOKED AT THIS IN 2013.

AND AGAIN, WE'RE PROPOSING TO REPEAL AND ENACT A NEW CHAPTER 72.

SO, THE CHANGES HERE RIGHT NOW, THE CODE CURRENTLY ONLY ALLOWS THE IOWA STORMWATER MANAGEMENT MANUAL AND THOSE PRACTICES CONTAINED WITHIN TO BE THE THINGS THAT WE WOULD CONSIDER FOR COST SHARING AND FOR CREDITS AND THOSE THINGS THAT THE PROPERTY OWNERS CAN DO.

BUT WE'VE HAD REQUESTS FROM PROPERTY OWNERS TO, TO DO OTHER THINGS.

THEY'VE SEEN SOME PRACTICES THAT MAY HAVE OCCURRED IN OTHER PARTS OF THE COUNTRY.

AND PREVIOUSLY WE WOULD JUST SAY, NO, THAT'S NOT ALLOWED.

WE HAVE TO GO BY THE IOWA STANDARDS.

BUT NOW WE WOULD LIKE TO ALLOW THOSE THINGS.

AND IN THE EVENT THAT SOMETHING LIKE THAT WAS BROUGHT TO OUR ATTENTION, WE WOULD LOOK AT THAT AS STAFF AND AS WELL AS HAVE IT REVIEWED BY THE STORMWATER COMMISSION.

SO, WITH THE MORE BMP OPTIONS THAT ARE AVAILABLE TO THEM, WE CAN HAVE BETTER SOURCE CONTROL.

AND THAT'S ULTIMATELY WHAT WE'RE LOOKING FOR HERE IN CHAPTER 72, IS TO TRY AND KEEP AS MUCH AS A STORMWATER RUNOFF ON SITE AS POSSIBLE, AND NOT TO JUST SIMPLY CONVEY IT OFF INTO THE PIPING SYSTEM AND EVENTUALLY TO STREAMS AND RIVERS WHERE YOU GOT A GREATER FLOODING RISK.

AND THEN WE'RE ALSO ADDING SOME, SOME PROVISIONS IN HERE SO THAT IF YOU'RE A PROPERTY OWNER OF MULTIPLE PROPERTIES, YOU CAN BE ELIGIBLE FOR STORMWATER CREDITS ON THOSE MULTIPLE PROPERTIES. PREVIOUSLY, WE WOULD ONLY GIVE YOU CREDIT FOR ONE PROPERTY MAXIMUM.

AND IF YOU'RE A VERY EDUCATION AND CONSERVATION MINDED ON SEVERAL PROPERTIES, YOU CAN GET MORE CREDITS.

AND WE'RE ALSO SIMPLIFYING THE APPLICATION FORMS FOR THOSE STORMWATER CREDITS.

SO, THE EFFECTS OF THESE, THESE UPDATED CHAPTERS, CHAPTER 71.

THERE'S NO UPDATE HERE THAT'S GOING TO CAUSE ANY ADVERSE IMPACTS TO OUR BUSINESSES, OUR DEVELOPERS.

WE'RE NOT INCREASING COSTS TO REGULATIONS WITH THIS.

SO, THERE ARE NO IMPACTS.

WE FEEL THAT CHAPTER 72 IS ACTUALLY GOING TO HAVE A POSITIVE IMPACT, BECAUSE WE'RE PROVIDING MORE FLEXIBILITY IN WHAT PROPERTY OWNERS CAN DO FOR BEST MANAGEMENT PRACTICES. AND WE'RE OPENING UP THE AMOUNT OF CREDIT ELIGIBILITY THAT THEY CAN HAVE ON THEIR RATES.

SO, WE FEEL LIKE THAT'S A POSITIVE BUSINESS FRIENDLY IMPACT.

AND WE DID SHARE THIS INFORMATION WITH INTERESTED PROPERTY OWNERS THAT HAVE BEEN IN CONTACT WITH US FREQUENTLY OVER SEVERAL MONTHS ABOUT IMPROVING OUR ORDINANCES, AS WELL AS RAN THIS BY DEVELOPERS.

I DON'T WANT TO PICK ON ANYBODY IN PARTICULAR, BUT I'VE SEEN A FEW WHERE IT LOOKS LIKE WE DID SOME WATER QUALITY THINGS THAT JUST CHECKED THE BOX.

IT WAS JUST SOME KIND OF A SAND BED OR JUST SOME SORT OF.

THEY CALL IT A BIO RETENTION, BUT IT ENDS UP LOOKING LIKE A BIG SAND PIT THAT'S IN THE FRONT YARD, AND THAT DOESN'T LOOK VERY GOOD.

AND IT REALLY DOESN'T PERFORM MUCH OF A PURPOSE THERE.

SO, IF WE WOULD JUST IF THEY WERE TO COME IN AND SAY, HEY, CAN WE REALLY BEEF UP OUR TOPSOIL OUT HERE? IF WE COULD PUT EIGHT INCHES OF COMPOST TO TOPSOIL, I'D SAY THAT WOULD BE BETTER THAN WHAT THEY DID.

THE REMAINDER OF THE EASEMENT, WHICH GOES NORTH SOUTH AND THEN ON THE NORTH SIDE OF 9900, THAT'S NOT SUBJECT TO THE REQUEST TO VACATE.

THEY'RE ONLY REQUESTING TO VACATE THIS EAST WEST PORTION BETWEEN 10,000 AND 990O 6TH STREET.

THIS IS THE CULMINATION OF QUITE A LOT OF WORK LEADING UP TO THIS MINIMUM INVESTMENT OF 576 MILLION.

THAT'S CAPITAL INVESTMENT FOR THE CONSTRUCTION OF ONE OR MORE DATA CENTERS.

IN TERMS OF CONSTRUCTION TIMELINE COMMENCEMENT WITHIN THREE YEARS OF THE DEVELOPMENT AGREEMENT EFFECTIVE DATE AND WILL CREATE A MINIMUM OF 31 JOBS THAT ARE AT OR ABOVE THE HIGH-QUALITY WAGE RATES.

IN TERMS OF THE BASE LEVEL INCENTIVES IT'S 20-YEAR, 70% TAX EXEMPTION.

THIS IS, OF COURSE, IN COOPERATION WITH THE STATE'S HIGH QUALITY JOBS PROGRAM AND SUBJECT TO MEETING THE EMPLOYMENT THRESHOLDS, WHICH THIS DOES ASSUMING THAT THE APPLICATION IS APPROVED THE IF IT IS NOT IMPROVED, WE DO HAVE ANOTHER OPTION TO PROVIDE A COMPARABLE TAX REBATE VIA TIF.

AND THE FINAL THING RELATED TO THE INCENTIVES IS A 20-YEAR, 75% ECONOMIC DEVELOPMENT REBATE OF FRANCHISE FEES COLLECTED BY THE CITY THROUGH THE ELECTRICAL PROVIDER, PER THE DATA CENTER.

AND I'M GOING TO LET SCOTT TALK ABOUT THE REMAINDER HERE.

SO, IN ADDITION, THERE IS ALSO A COMMUNITY BETTERMENT FUND, WHEREAS THE COMPANY WILL PROVIDE ANNUAL COMMUNITY BETTERMENT PAYMENTS TO THE CITY, WHICH CAN BE USED TO INCREASE ECONOMIC DEVELOPMENT ACTIVITIES INCLUDING GROWTH OF AMENITIES AND INFRASTRUCTURE.

THE COMPANY WOULD MAKE ANNUAL PAYMENTS OF $400,000 PER DATA CENTER FOR 15 YEARS, WITH A MAX OF 6 MILLION PER DATA CENTER AND A TOTAL OF 36 MILLION.

THERE'S ALSO A GRAY WATER DISCHARGE CREDIT, WHEREAS THE CITY WOULD PROVIDE MONTHLY GRAY WATER OR MONTHLY CREDIT FOR GRAY WATER DISCHARGE ESCALATED ANNUALLY, UP TO A MAXIMUM OF 57% OF THE UNIT SEWER DISCHARGE.

SO, HERE'S A MAP OF THE PROJECT LOCATION.

IT IS ONE PART OF THE BIG CEDAR INDUSTRIAL CENTER, WITH EDGEWOOD ROAD TO THE EAST, ALONG THEIR NORTH AND SOUTH, AND 76TH AVENUE ALONG THE SOUTHERN BOUNDARY. STAFF RECOMMENDS AUTHORIZATION OF THE DEVELOPMENT AGREEMENT WITH HEAVYSIDE, LLC FOR THE CONSTRUCTION OF ONE OR MORE DATA CENTERS.

AND WHEN YOU CONSIDER HOW THESE PROJECTS HAVE GONE IN OTHER COMMUNITIES IT'S LIKELY TO SOME EXTENT, RIGHT? I DON'T KNOW WHAT THE PERCENTAGE IS, RIGHT, BUT THAT THERE'S GOING TO BE MORE THAN ONE, YOU KNOW, SO IT COULD EASILY TURN INTO A 15 YEAR CONSTRUCTION PROJECT.

YOU KNOW, WE RECENTLY HAD THE CITY BUDGET HEARING, RIGHT, FOR OUR ANNUAL BUDGET THAT WILL BE SET TO BE APPROVED IN THE NEXT FEW MONTHS.

AND WE TALKED A LOT ABOUT THE FEES THERE AND ALSO THE CAPITAL PLAN FOR UTILITY, THE UTILITY DEPARTMENT GOING FORWARD.

SO AS FAR AS THE SCOPE OF THE PROJECT, THIS IS THE BLAIRS FERRY ROAD BRIDGE OVER 380.

SO, THEY WILL BE DOING A DECK OVERLAY AND SOME APPROACH REPLACEMENT HERE.

YOU CAN SEE THESE SIDEWALK RAMPS CROSSING ON THE NORTH SIDE OF THE BRIDGE.

AS WELL AS I THINK THIS IS A LONG-NEEDED WIDENING OF THE SOUTHBOUND EXIT RAMP.

HERE'S THE LOCATION OF THIS.

AND THE COUNCIL MAY HAVE SEEN A PREVIOUS COMMUNICATION NOT LONG AGO.

THE BOWLING STREET TRAIL WAS ORIGINALLY CONSTRUCTED IN 1978 AND IS ONE OF THE FIRST SEPARATED TRAILS IN THE CITY OF CEDAR RAPIDS.

AND IT'S A IT'S AN IMPORTANT CONNECTOR BETWEEN THIS NEIGHBORHOOD AND JONES PARK.

AND SO, THIS PROJECT WILL RECONSTRUCT THE TRAIL THAT'S A SITTING ON THE WEST SIDE OF BOWLING STREET.

AND THEN ONCE WE GET JUST NORTH OF 21ST AVENUE, WE WILL CONSTRUCT SIDEWALKS ON BOTH SIDES OF THE STREET.

AND THEN HERE AT WILSON AND BOWLING STREET THERE'S THE HY-VEE AND THEN THE DAIRY QUEEN OVER HERE.

THAT'S GOING TO BE A ROUNDABOUT.

HERE'S AN OVERVIEW OF THE ROUNDABOUT.

AND AS FAR AS THE ROUNDABOUTS GO, WE DID DO A GOOD TRAFFIC ENGINEERING ANALYSIS.

AND THE JUSTIFICATION FOR HAVING A ROUNDABOUT HERE IS TO ALLEVIATE A CRASH HISTORY AS WELL AS SOME, SOME NOTABLE DELAYS THAT OCCUR AT THE EXISTING FOUR-WAY STOP.

IT'S ALSO VERY ADVANTAGEOUS WHEN YOU HAVE A TRAIL TO USE A ROUNDABOUT RATHER THAN A TRADITIONAL INTERSECTION BECAUSE OF THE CONFLICT POINTS, AS WE'VE MAY HAVE POINTED OUT IN SOME OF OUR PREVIOUS COUNCIL MEETINGS THAT THE ADVANTAGE OF A ROUNDABOUT IS IT GIVES DRIVERS AS WELL AS PEDESTRIANS FEWER THEY DON'T HAVE TO LOOK ALL WAYS.

AND, YOU KNOW, SO THERE'S FEWER CONFLICTS, FEWER DECISIONS TO BE MADE.

AND SO IT'S A SAFER ACCESS FOR, FOR CYCLISTS ON THE TRAIL.

NOW, IT'S GOING TO BE A RURAL SECTION JUST SIMILAR TO WHAT'S THERE NOW AS WE GO TO THE EAST FROM 38TH OVER TO EDGEWOOD ROAD, THAT IS GOING TO BE CHANGED FROM ASPHALT SEAL COAT AS IT IS NOW TO A CONCRETE STREET.

THE NORTH EDGE OF THE ROAD WILL HAVE A CURB SO THAT CAN FACILITATE A SIDEWALK CONSTRUCTION, A SIDEWALK EXTENSION, BASICALLY BETWEEN 38TH AND EDGEWOOD. AND THE SOUTH SIDE OF THAT STREET WILL BE A RURAL SECTION AS IT IS TODAY, WITHOUT THE CURB.

FOR SOME OF YOU ON THE COUNCIL THAT HAVE BEEN HERE AROUND 2017 OR SO THE, THE SIDEWALK WAS PART IN BECAUSE OF THE COMMON BOND DEVELOPMENTS THAT OCCURRED AT CRESTWOOD AND EDGEWOOD.

AND AT THAT TIME SEVERAL OF THE NEIGHBORHOOD RESIDENTS WERE ALSO ASKING FOR A SIDEWALK EXTENSION TO GO FURTHER WEST.

AND IN THE COMMON BOND DEVELOPMENT HAS ACTUALLY PROVIDED A LETTER OF CREDIT TO HELP FUND SOME OF THAT.

THESE ARE THE TYPICAL SECTIONS.

SO, THE BETWEEN 38TH STREET AND WYLIE.

THIS IS GOING TO BE THE TYPICAL RURAL ASPHALT SECTION MUCH LIKE IT IS TODAY EXCEPT A BRAND NEW.

AND WE'RE GOING TO BE STAGING THIS IN BY THE BLOCK.

SO EACH BLOCK WILL BE CLOSED OFF AND AND STAGED ACCORDINGLY.

I RECEIVED A CALL BACK FROM ONE OF THE CONTACTS THAT I MADE IN THE SECRETARY OF STATE'S OFFICE, AND THEY BOUNCED ME AROUND SEVERAL DIFFERENT PLACES AND EXPLAINED, ULTIMATELY, THAT THERE'S NO ORGANIZATION IN THE STATE THAT HAS JURISDICTION OVER GOVERNMENT, NONPROFIT AND FOR PROFIT ENTITIES IN THE WAY THAT THESE DEALS GET DONE.

AND THEY REFERRED ME TO A FEDERAL AGENCY THAT IS CALLED THE.

PROCUREMENT COLLUSION STRIKE FORCE.

AND THEY FOCUS SPECIFICALLY ON THIS KIND OF ISSUE.

AND THE REASON THAT THAT HAS AN IMPACT IN RELATION TO THE CITY ALL OF THIS HAS A RELATION TO THE CITY IN THAT MANY OF THE BID PROCESSES GO FROM THE CITY TO THE ECONOMIC ALLIANCE, AND THEY MANAGE THEM.
