[1. A public hearing will be held to consider the fiscal year 2024 budget amendment (Abhi Deshpande). CIP/DID #FIN2023-09 a. Resolution adopting the fiscal year 2024 budget amendment and transfers.]

ABHI DESHPANDE, FINANCE DIRECTOR, FOR THE RECORD.

SO WE ARE DOING THE BUDGET AMENDMENT PUBLIC HEARING FOR FISCAL YEAR 2020 FOR THE FISCAL YEAR 2024. BUDGET WAS DEVELOPED AROUND 18 MONTHS PRIOR TO THE END OF FISCAL YEAR 2024, WHICH IS THE JUNE 30TH, 2024, BASED ON THE PROJECTIONS AND REVENUES FOR THE FISCAL YEAR.

SO THE BUDGET WAS DEVELOPED 18 MONTHS BEFORE THE END OF THE FISCAL YEAR.

THEREFORE, THE STATE REQUIRES IF YOU HAVE ANY BUDGET AMENDMENTS, IF THE ACTUAL EXPENSES WILL EXCEED THE ADOPTED BUDGET OR FOR TRANSFER OF FUNDS THAT ARE NOT INCLUDED IN THE ADOPTED BUDGET.

THE FISCAL YEAR 2024 BUDGET AMENDMENT DOES NOT IMPACT ON PROPERTY TAX LEVIES AS WELL AS IT REFLECTS THE CHANGES TO THE REVENUE AND EXPENSES EXPENSE PROJECTIONS.

IT INCLUDES ADJUSTMENTS FOR ACCOUNTING PURPOSES AND INCLUDE TRANSFER OF FUNDS, WHICH ARE THE ACCOUNTING TREATMENTS.

THIS PRESENTATION WILL HIGHLIGHT SOME OF THESE CHANGES.

SO FOR THE GENERAL FUND ON THE REVENUE SIDE, THE BUDGET IS INCREASED BY 22.7 MILLION.

ON THE EXPENDITURE SIDE, THE BUDGET IS INCREASED BY 25.7 MILLION.

THE KEY ITEMS IN THIS IS 10.1 MILLION FOR INTERNAL CHARGES FOR ADMIN ADMINISTRATION, FINANCE, AND IT FOR THE GENERAL CHARGES FOR THE GENERAL FUND, THEN 1.3 MILLION INCREASE IN REVENUE AND EXPENDITURE FOR THE AMPHITHEATER.

THERE ARE VARIOUS DIFFERENT EXPENSES, INCLUDING LICENSE PLATE READER SAFETY PROGRAM, FIRE ALL TIME OR AGRICULTURE MOWER PURCHASE THOSE EQUAL AROUND HALF MILLION DOLLARS.

THEN THERE ARE SOME OF THE PURCHASES, THOSE OVERLAY ON THE CROSS FISCAL OVER THERE, WHICH IS BASICALLY THE TIMING OF PURCHASES, OR THOSE ARE ABOUT 600,000, AND THEN OVERALL, THERE ARE ANNUAL ALLOWANCES FOR THE BAD DATE AROUND TOTAL $7 MILLION.

ON THE INTERNAL SERVICES FUNDS.

ON THE REVENUE SIDE, THE BUDGET IS INCREASED BY 4.3 MILLION, AND ON THE EXPENDITURE SIDE, THE BUDGET IS INCREASED BY 9.5 MILLION.

SOME OF THE KEY ITEMS ARE AROUND 900,000 FOR THE PROPERTY AND LIABILITY INSURANCE EXPENSES, AROUND 750,000 FOR INCREASE IN THE WORKMEN COMPENSATION EXPENSES, 4.1 MILLION.

INCREASE IN THE HEALTH INSURANCE COST AND AROUND $4 MILLION DUE TO THE TIMING OF PURCHASES AND PROJECTS.

ON THE TAX SUPPORTED FUNDS.

ON THE REVENUE SIDE, THE BUDGET INCREASED BY 42 MILLION, AND ON THE EXPENDITURE SIDE, THE BUDGET HAS INCREASED BY 66.3 MILLION.

SO THE KEY ITEMS ARE REALLY ABOUT THE TRANSFER ASSOCIATED WITH THE CAPITAL PROJECTS AND THE TIMING OF PROJECTS.

THESE PROJECTS INCLUDES ANY PROJECTS ABOUT THE PAVING FOR PROGRESS FRAUD CONTROL SYSTEM OR VARIOUS PROJECTS SUPPORTED BY DEBT LEVY.

ON THE DEBT SERVICE FUNDS, ON THE REVENUE SIDE, THE REVENUE AND EXPENDITURE SIDE, THE INCREASE IS 1.6 MILLION DUE TO THE INCREASE IN THE ISSUANCE, DEBT ISSUANCE COSTS FOR FY 24 DEBT.

ON THE ENTERPRISE FUND, ON THE REVENUE SIDE, THE BUDGET DECREASED BY 13.4 MILLION, AS WELL AS ON THE EXPENDITURE SIDE, THE BUDGET DECREASED BY 15 MILLION, AND THIS IS MAINLY DUE TO THE AMENDMENTS SUBMITTED BY COMPONENT UNITS LIKE CEDAR RAPIDS, LINN COUNTY, SOLID WASTE AGENCY OR AIRPORT.

ALSO INCREASE IN REVENUE AND EXPENDITURE FOR CITY ENTERTAINMENT VENUES AND ALSO FOR SOME OF THE COSTS ARE ASSOCIATED WITH THE TIMING OF THE PROJECTS THAT CROSS OVER DIFFERENT FISCAL YEARS.

ON THE SPECIAL REVENUE SIDE THE REVENUE BUDGET INCREASED BY AROUND $7.8 MILLION AND THE EXPENDITURE BUDGET INCREASED BY $23.2 MILLION, AND THESE ARE THE BASICALLY DIFFERENT TRANSFERS BETWEEN ACCOUNTS FROM THE REVENUE COLLECTION TO THE ACTUAL THE TRANSFER GOING OUT AS EXPENDITURE, SUCH AS THE LOST REVENUE RECORDED WITH THE ARPA TRANSFERS ALSO TIF REVENUE AND SOME OF THE PUBLIC SAFETY AND SPECIAL PUBLIC SAFETY RELATED GRANTS.

ALSO, THERE ARE SOME OF THE COSTS ASSOCIATED WITH TIMING OF THE PROJECT CROSSING OVER DIFFERENT FISCAL YEARS.

SO THE OVERALL THE TOTAL FUND IMPACT IS ON THE REVENUE SIDE, THE BUDGET IS INCREASING BY $65.2 MILLION AND THE BUDGET ON THE EXPENDITURE SIDE, THE BUDGET IS INCREASING BY $111.8 MILLION.

THE SIGNIFICANT AMOUNT OF THESE TRANSFERS OR INCREASES ON THE BOTH REVENUE AND EXPENDITURE SIDE IS DUE TO THE TIMING OF THE TRANSFERS. THERE ARE AROUND $45 MILLION THERE.

ALSO, THE IMPROVEMENT PROJECTS RELATED TO THE RATIO WORK, WHICH ACTUALLY THE DECREASE IN THE REVENUE AND THE INCREASE ON THE EXPENDITURE.

ALSO THE ENTERTAINMENT VENUE OPERATIONS REVENUE AND EXPENDITURE INCREASES.

THAT HAS COST AROUND 30 MILLION ON THE REVENUE SIDE, 40 MILLION ON THE EXPENDITURE SIDE, AND THE OVERALL YEAR END ACCOUNTING AND ALLOWANCE ADJUSTMENT FOR THE BAD DEBT IS AROUND $8.5 MILLION.

THIS PARTICULAR SLIDE SHOWS THE COMPARISON BETWEEN THE PREVIOUS FISCAL YEAR'S BUDGET ADJUSTMENT.

SO YOU CAN SEE THAT AS COMPARED TO THE 2020 OR 2021, THE BUDGET AMENDMENT HAS DECREASED SIGNIFICANTLY, AND THAT IS DUE TO THE WRAPPING UP OF THE 2020 DEBT RATIO ACTIVITIES.

WITH THAT THE STAFF RECOMMENDATION IS TO APPROVE THE FISCAL YEAR 2024 BUDGET AMENDMENT.

WITH THAT, IF YOU HAVE ANY QUESTION, I WILL TAKE THOSE.

CONSTRUCTION WALL SWINGS, BUT I THINK THAT IN OUR CURRENT AUDIT WE'RE STILL GET OUR HIGH RANKING AND EVERYTHING.

SO, IT'S GOOD TO SEE THE DECREASE BECAUSE WE'VE HAD THIS, AND I'M ON A COUPLE DIFFERENT CITY AND BOARDS OF THE LINN COUNTY SOLID WASTE, AND WE HAVE TO DO THE SAME THING, AND IT'S ALWAYS CONFUSING THAT THE STATE REQUIRES YOU TO DISCLOSE ALL OF THESE AND HAVE A MOTION BEFORE US, EVEN THOUGH THERE'S SO MANY OF OUR PROJECTS THAT OVERLAP MULTIPLE YEARS. SO YOU FEEL COMFORTABLE NOW THAT YOU'RE INTO THE NEW ROLE OF THE THINGS YOU'RE SEEING? DEFINITELY, YOU KNOW AS YOU SAID, THAT THERE ARE STATE REQUIREMENTS THAT WE NEED TO ABIDE BY AS WELL AS THERE IS SOME ACCOUNTING REQUIREMENT ON THE AUDIT SIDE.

SO DEFINITELY THE RECONCILIATION BETWEEN TWO REQUIREMENTS IS SOMETHING A FINE BALANCE THAT WE, THE EVERYONE IN FINANCE IS TRYING TO ACHIEVE THAT.

SO WITH DEFINITELY WITH YOUR QUESTION, I THINK YOU KNOW, MY TEAM AND I, WE ARE WELL EQUIPPED TO HANDLE THOSE REQUIREMENTS ON THE BOTH SIDE.

SO IT WAS A VERY GOOD AUDIT.

SO DEFINITELY BASED ON THE, THE AMOUNT OF ACCOUNTING TRANSACTIONS THAT WE GO THROUGH AS A CITY ENTITY.

I THINK THAT'S DEFINITELY A GOOD ACHIEVEMENT HERE.

I'M HERE TO TALK ABOUT CHAPTER 12 REVISION HISTORY, AND FIRST OF ALL, CHAPTER 12 WAS REENACTED BY ORDINANCE NUMBER 00308, PASSED IN MARCH OF 2008.

IT WAS LAST REVISED IN 2014.

THAT REVISION DEFINED PURPOSE FOR CONNECTION FEE REVISED THE CONNECTION FEE TO $800 PER ACRE AND DEFINE THE MINIMUM PIPE DIAMETER FOR WATER MAIN INSTALLED FOR DOMESTIC SERVICE.

THIS REVISION IN 2024 WAS AN INNOVATION PROJECT AND IT WAS CROSS-DEPARTMENTAL TEAM.

IN GENERAL THE CHANGES NOTED HERE, ALL DEFINITIONS WERE MOVED TO THE FRONT OF THE DOCUMENT TO BE CONSISTENT.

SECTIONS WERE REARRANGED TO PLACE RELEVANT SECTIONS ADJACENT TO ONE ANOTHER, AND WE REPLACED OUTDATED REFERENCES TO THE METRO DESIGN STANDARDS AND SPECIFICATIONS TO THE SUDAS AND OTHER CLARIFICATIONS.

REGARDING THE CONNECTION FEE, WE ADJUSTED THE CONNECTION FEE FROM $800 PER ACRE TO $1,000 PER ACRE, WITH A $1,000 MINIMUM.

THE $800 CONNECTION FEE HAD NOT BEEN ADJUSTED SINCE THAT 2014 AMENDMENT TO THE CHAPTER.

REGARDING THE SITE ACCESS SECTION, WE CLARIFIED THE RIGHTS TO ACCESS FOR METER SERVICES.

WE ADDED THE RIGHT OF ACCESS FOR PRIVATE FACILITIES FOR PURPOSES OF WATER QUALITY SAMPLING AND TESTING, AND WE ADDED THAT THE WATER DIVISION HAS THE RIGHT TO ACCESS PRIVATE WATER FACILITIES IF IT'S DEEMED NECESSARY.

WE ADDED SECTIONS REGARDING PRIVATE HYDRANT MAINTENANCE.

WE ADDED A SECTION REGARDING ACCESSORY DWELLING UNITS, PRIVATE WELLS INCLUDING GEOTHERMAL WELLS, CONSTRUCTION OBSERVATION COSTS FOR PRIVATE DEVELOPER WATER MAIN INSTALLATION MAY BE INCLUDED IN THIS BRINGS THE WATER SERVICE CONSISTENT WITH SANITARY SEWER CONSTRUCTION.

OBSERVATION FEES.

OTHER SECTIONS REVISED INCLUDED UPDATING THE WATER USE RESTRICTIONS TO BE CONSISTENT WITH THE CITY'S DROUGHT CONTINGENCY PLAN, WHICH WAS ADOPTED IN 2013, AND WE REMOVED A SECTION REPLACING FIGURES FROM THE CHAPTER AND ADDED REFERENCES TO THE CEDAR RAPIDS SUPPLEMENTAL SPECIFICATION TO SUIT US. REGARDING THE SCHEDULE, WE'RE HAVING THE FIRST PUBLIC HEARING TODAY ON MAY 28TH.

A SECOND AND THIRD POSSIBLE READING ON JUNE 11TH, WITH AN EFFECTIVE DATE OF JULY 1ST, AND OUR RECOMMENDATION

I AM THE PROJECT COORDINATOR FOR THE POLICE DEPARTMENT FOR THE AUTOMATED TRAFFIC ENFORCEMENT PROGRAM.

SO IN 2009, THE CITY COUNCIL PASSED ENACTED AN ORDINANCE ALLOWING THE USE OF ATE SYSTEMS THROUGHOUT CEDAR RAPIDS AT DOCUMENTED HIGH CRASH, HIGH RISK LOCATIONS.

SOME STATISTICS FROM THAT PROGRAM HAVE BEEN IN 2023, THERE WAS A 24% REDUCTION IN CRASHES AT ALL LOCATIONS WHERE AT SYSTEMS ARE USED COMPARED TO 2022 AVERAGE CRASHES ON I-380.

THE S CURVE PER MONTH HAVE DECREASED WITH THE USE OF ATE SYSTEMS BY 58.3% WHEN COMPARED TO THE SAME TIME FRAME WHEN AT SYSTEMS WERE NOT USED.

THERE WAS A 44.7% CHANCE THAT A CRASH WOULD RESULT IN AN INJURY ON I-380 IN THE THREE YEARS PRIOR TO UTILIZING ATE SYSTEMS ON I-380 AND THE LIKELIHOOD DECREASE TO 27.7 COMPARING THE LAST THREE YEARS THAT WE HAVE USED ATES ON THE INTERSTATE.

THE SAFE SYSTEM APPROACH IS A STRATEGY ENDORSED AT THE FEDERAL, STATE AND LOCAL LEVELS TO ASSIST IN ACHIEVING THE GOAL OF ERADICATING ALL TRAFFIC FATALITIES AND SERIOUS INJURIES.

THE FHWA AND NHTSA INCLUDE SPEED SAFETY CAMERAS AS A PROVEN SAFETY COUNTERMEASURE THAT FURTHERS THE SAFE SYSTEM APPROACH. SO IN, OOPS, ON MAY 17TH OF THIS YEAR GOVERNOR REYNOLDS PASSED HOUSE FILE 2681 THAT REGULATES THE USE OF AUTOMATED TRAFFIC ENFORCEMENT SYSTEMS FOR SPEED VIOLATIONS THROUGHOUT THE STATE.

THIS LAW WILL PROMOTE UNIFORMITY FOR ALL MUNICIPALITIES AUTHORIZED TO USE ATE SYSTEMS. SOME GENERIC OVERVIEWS OF THE LAW IS THAT THERE'S A FEE STRUCTURE THAT ALL CITIES WILL BE ENFORCING A T 11MPH OVER THE SPEED LIMIT, AND IT REQUIRES MUNICIPALITIES TO PROVIDE DATA DRIVEN EVIDENCE THAT THERE IS A NEED FOR ATE SYSTEMS IN THEIR COMMUNITY. THE USE OF MOBILE SYSTEMS WILL WILL BE AUTHORIZED AND REGULATED BY RULES ADOPTED BY THE IOWA DOT AND WILL LIMIT USE TO NEIGHBORHOODS, CONSTRUCTION ZONES, SCHOOL ZONES COLLEGIATE ZONES, AND LOCATIONS WHERE TRAFFIC ENFORCEMENT IS DIFFICULT OR DANGEROUS TO ENFORCE BY ALTERNATIVE METHODS.

LOOKING THERE IS A PERMIT REQUIREMENT WHICH IS WHAT I WAS REFERENCING ON THE LAST SLIDE WITH THE DATA DRIVEN INFORMATION.

SO THE DOT HAS TO DETERMINE THAT AN ATE SYSTEMS ARE APPROPRIATE AND NECESSARY, AND FOR MUNICIPALITIES THAT HAVE ATE SYSTEMS ESTABLISHED BEFORE JANUARY 1ST TO APPLY FOR A PERMIT.

SO INCLUDED IN THAT PERMIT ARE CRASH AND VIOLATION STATISTICS FOR EACH LOCATION, TRAFFIC DATA ANALYSIS AND MEASUREMENTS OF THE AT INTERSECTIONS AND LOCATIONS AND ALTERNATIVE METHODS CONSIDERED TO IMPROVE TRAFFIC SAFETY AT EACH LOCATION. ANOTHER ACTION ITEMS ON THE PERMIT IS THAT IT'S THE APPLICATION IS DUE TO THE DOT BY JULY 1ST OF THIS YEAR.

THE DECISION FROM THE DOT IS WILL BE GIVEN BY OCTOBER 1ST OF 2024.

SOME VERY BASIC AMENDMENTS TO CHAPTER 61.138.

THE DEFINITIONS ARE ARE PART OF THAT.

WE'RE GOING TO JUST NEED TO REPLACE THAT WITH THE EXACT LANGUAGE IN HOUSE FILE 2681.

THE FIRST ONE WOULD BE THE DEFINITION OF A PHOTOGRAPHIC VIDEO OR ELECTRONIC CAMERA AND REPLACE THAT WITH CAMERA OR OTHER OPTICAL DEVICE.

REMOVE AUTOMATICALLY PRODUCE PHOTOGRAPHS, DIGITAL VIDEO IMAGES OF EACH VEHICLE VIOLATING A STANDARD AND REPLACE IT WITH THE USE OF WHICH RESULTS IN THE ISSUANCE OF CITATIONS SENT THROUGH THE MAIL OR BY ELECTRONIC MEANS.

THE OWNER OF OR WILL ALSO HAVE TO AMEND THE LANGUAGE DEFINING A VEHICLE OWNER PERTAINING TO LEASE AGREEMENTS.

IOWA LAW 321.493 STATES THAT THE LESSEE OF A VEHICLE IS CONSIDERED THE VEHICLE OWNER.

CURRENTLY IN OUR ORDINANCE, WE HAVE THAT IN THE EVENT THAT THE STATE REGISTRATION OFFICE DOES NOT SPECIFY WHETHER A PERSON OR ENTITY IS LISTED FOR THE VEHICLE, IS THE OWNER OR THE LESSEE OF THE VEHICLE, ANY PERSON OR ENTITY LISTED ON THE REGISTRATION MAY BE DEEMED THE VEHICLE OWNER.

SO THAT'S JUST GOING TO BE UPDATED TO THE IOWA LAW MATCHING THAT.

SO NEXT IS A CLOSER LOOK AT THE FEE STRUCTURE.

CURRENT IN OUR ORDINANCE, THE FINE SCHEDULE STARTS AT ONE THROUGH FIVE AND SIX THROUGH TEN.

THOSE WILL BE REPLACED WITH WHAT YOU SEE HERE, STARTING AT 11MPH OVER THE SPEED LIMIT.

I WANT TO NOTE THAT THIS PART OF OUR THE FEE SCHEDULE IN CEDAR RAPIDS DOES MATCH WHAT'S IN HOUSE FILE 2681.

SO IN TERMS OF THAT, IT WILL MATCH AND WE WILL BE IN COMPLIANCE WITH THAT.

SO WE JUST NEED TO REMOVE THE TOP TWO LINES.

WE HAVE ALWAYS THE CEDAR RAPIDS STANDARD OPERATING PROCEDURE HAS ALWAYS BEEN TO ISSUE CITATIONS TO VEHICLES IDENTIFIED GOING 12 MILES AN HOUR OR MORE OVER THE SPEED LIMIT.

SO THAT HAS ALWAYS BEEN IN COMPLIANCE WITH WHAT HAS BEEN PASSED NOW AND THEN ALSO THE CONSTRUCTION ZONE STATING 30MPH WILL BE CHANGED FROM 750 TO 1000.

WITH THAT WE RECOMMEND APPROVAL OF THE FIRST READING AND THE SECOND AND POSSIBLE THIRD READING OF THE ORDINANCE ON JUNE 11TH.

I DRIVE THAT QUITE A BIT.

THE PROBLEM IS, IS THAT THIS IS ONE MEANS TO REDUCE BEHAVIOR.

IT IS AN EFFECTIVE MEANS.

IT IS SUPPORTED BY LOTS OF RESEARCH.

IT IS SUPPORTED BY YOUR INSURANCE CARRIERS, PRETTY MUCH EVERY SINGLE ONE THAT YOU MIGHT BE ABLE TO GET INSURANCE WITH SUPPORTS THIS AS AN EFFICACY TO KEEP YOU SAFE, TO KEEP OUR STREETS SAFE AND OUR HIGHWAYS.

THAT IS A PARTICULARLY DANGEROUS PART.

SO THE REALITY IS, WE COULD HAVE BEEN HEAVIER IN OUR INTEREST TO RESPOND TO BEHAVIOR.

WHEN WE HAD THE CAMERAS BRIEFLY OFF ABOUT A YEAR OR SO THERE WERE FOLKS WHO WERE DRIVING 114MPH ON THAT.

SOME OF THE WAY THAT PEOPLE DRIVE ON THAT, GIVEN HOW BUSY IT IS, IS ABSOLUTELY OUTRAGEOUS.

I MYSELF HAVE A TENDENCY TO SPEED THAT'S BEING EXTREMELY TRANSPARENT, BUT I'M ALSO GOING TO TELL YOU WHEN I'M IN CEDAR RAPIDS, WHEN I'M ON THE S CURVE, I DO NOT.

THAT'S TO KEEP YOU SAFE, THAT'S TO KEEP THE DRIVERS AROUND YOU SAFE, AND THAT'S TO KEEP OUR OFFICERS SAFE BECAUSE THERE IS NOT A CURB ON THERE FOR THEM TO SAFELY PULL SOMEBODY OVER. SO WE ARE BEING TRANSPARENT IN WHAT WE'RE TRYING TO ACCOMPLISH HERE.

I WOULD ALSO SUPPORT SOMEDAY REEVALUATING THIS AND HAVING THIS BE A, YOU KNOW, A COUNT, A STRIKE ON PEOPLE'S INSURANCE AT THAT POINT IN TIME, THE WAY THAT PEOPLE ARE STILL DRIVING, EVEN WITH THESE MEASURES, MOST PEOPLE WOULD LOSE THEIR THEIR DRIVING ABILITY.

IN THIS PROGRAM, WE REPAIR DAMAGE AND MISMATCHED SIDEWALK PANELS THROUGHOUT THE CITY, THE PURPOSE OF WHICH IS TO REDUCE THE RISK OF SLIP AND FALL HAZARDS, AS WELL AS TO FACILITATE ADA ACCESSIBILITY THROUGHOUT.

WE HAVE APPROXIMATELY 370 PROPERTIES WITHIN THE PROGRAM, AND THE PROJECT WILL BID ON MAY 29TH, AND STATED THE COST OPINION IS $370,000, AND SIDEWALK REPAIRS ARE A NOTED COUNCIL PRIORITY OF STRENGTHENING AND STABILIZING THE NEIGHBORHOODS.

FIRST OF ALL, IT STARTS WITH THE CITY INSPECTING SIDEWALKS, AND WE DO THIS EVERY SUMMER, FIRST OF ALL, BY HIRING A COLLEGE ENGINEERING INTERNS TO ASSESS THE CONDITIONS OF OUR VARIOUS FOUR QUADRANTS, AND AS WELL AS WE TAKE MY CR COMPLAINTS THROUGHOUT THE YEAR AND ANY OTHER TYPE OF COMPLAINT BY PHONE OR EMAIL AS FAR AS THE SIDEWALK CONDITIONS.

WHEN WE DO FIND A DEFECTIVE SIDEWALK, WE MARK IT AND THEN WE PROVIDE A NOTIFICATION TO THE PROPERTY OWNER.

IT'S A CERTIFIED LETTER.

WE STATE THAT THEY ARE PROVIDED A YEAR TO REPAIR IT THEMSELVES, IN WHICH CASE THEY COULD QUALIFY FOR CITY REIMBURSEMENT PROGRAM WHERE WE CAN PAY THEM BACK FOR PART OF THAT COST.

OR IF THEY CHOOSE, THEY CAN SIMPLY WAIT, AND THEN THE CITY WOULD ASSESS THEM THE COST OF THE SIDEWALK, AND WE DO PROVIDE OWNERS WITH AN ASSESSED AN ESTIMATED ASSESSMENT AND AN ESTIMATED REIMBURSEMENT AT THE TIME OF THAT LETTER.

SO STARTING WITH A LITTLE BIT OF BACKGROUND, THE GREENWAY FIRST AND FOREMOST IS THE RECREATION AREA CREATED ON THE WEST SIDE OF THE CEDAR RIVER BY THE FLOOD CONTROL SYSTEM. THIS GREENWAY AREA WAS REALLY ORIGINATED POST THE 2008 FLOOD AND THE RIVER CORRIDOR REDEVELOPMENT PLAN WHEN THE FLOOD CONTROL SYSTEM ALIGNMENT WAS FIRST ORIGINATED, AND THROUGH THAT PLANNING PROCESS, WE HEARD PRETTY LOUD AND CLEAR THAT PEOPLE DID NOT WANT TO BE DISCONNECTED FROM THE RIVER. THEY WANTED TO HAVE RECREATION AND OPEN SPACE AND REALLY EMBRACE THE RIVER AS AN ASSET.

THE GREENWAY WAS THEN FURTHER REFINED IN 2014 THROUGH DEVELOPMENT OF THE CEDAR RAPIDS GREENWAY PARKS PLAN, AND AT THAT TIME THIS PLANNING PROCESS INCLUDED PARTICIPATION FROM OVER 300 PARTICIPANTS, AS WELL AS OUTREACH TO A VARIETY OF USER GROUPS AND THE GREENWAY OVERALL AT THAT TIME INCLUDED OVER 100 ACRES OF PARK AND RECREATION AREA.

SO WHY UPDATE THE GREENWAY PLAN NOW? IT IS TEN YEARS OLD, AND WE'VE SEEN OVER THE PAST SEVERAL YEARS ADDITIONAL PLANNING WORK AND NEW DEVELOPMENT THAT IS KIND OF CHANGING THE LANDSCAPE OF THE AREA ALONG THE GREENWAY.

SO SOME EXAMPLES INCLUDE AN UPDATED WEST SIDE FLOOD CONTROL SYSTEM ALIGNMENT, ESTABLISHED FEASIBILITY OF THE WHITEWATER PARK THROUGH THE RIVER, RECREATION FEASIBILITY STUDY, AS WELL AS DEVELOPMENT LIKE THE FIRST AND FIRST WEST PROJECT, AND OF COURSE, ONGOING CURRENTLY OR RIGHT NOW IS DESIGNED FOR THE LIGHT LINE LOOP.

SO LOOKING TO ALIGN THE GREENWAY PLAN REALLY WITH THESE CHANGING CIRCUMSTANCES.

THE PURPOSE OF THIS PLAN IS TO ENGAGE WITH THE COMMUNITY TO BUILD MOMENTUM, ESPECIALLY AS WE MOVE TOWARDS IMPLEMENTATION.

COLLABORATE TO ENHANCE AMENITIES THROUGH OTHER CITY PROJECTS SUCH AS FLOOD CONTROL AND THEN OF COURSE, POSITIONS THE CITY TO BE COMPETITIVE FOR FEDERAL FUNDING AND OTHER GRANT OPPORTUNITIES. SO THIS PLANNING PROCESS HAS BEEN A JOINT PROJECT LED BY PARKS AND RECREATION AND COMMUNITY DEVELOPMENT, BUT OF COURSE, WITH MASSIVE INPUT AND COORDINATION WITH PUBLIC WORKS AND OUR POLICE AND FIRE DEPARTMENTS AS WELL AND THE CITY HAD AWARDED THE CONTRACT TO MICHAEL VAN VALKENBURGH ASSOCIATES WITH SOME LOCAL AND NON-LOCAL SUBCONTRACTORS WORKING ON THE PROJECT AS WELL.

SO THIS PLANNING PROCESS KICKED OFF IN AUGUST OF LAST YEAR, AND FOLLOWING A NUMBER OF ROUNDS OF COMMUNITY ENGAGEMENT, WE ARE FINALLY HERE THIS AFTERNOON TO PRESENT THE FINAL PLAN.

SO IN TERMS OF COMMUNITY ENGAGEMENT, THE FIRST ENGAGEMENT OPPORTUNITY KICKED OFF IN THE FALL OF 2023 AND INCLUDED BOTH IN-PERSON AND ONLINE OPPORTUNITIES, AND IT WAS KIND OF A MORE BROAD OR HIGH LEVEL OPPORTUNITY TO PROVIDE FEEDBACK ON WHAT PEOPLE WANTED TO SEE IN TERMS OF PASSIVE AND RECREATION OPPORTUNITIES IN CEDAR RAPIDS, MAYBE PREFERRED LANDSCAPING TYPES, WILDLIFE, REALLY THAT HIGH LEVEL KIND OF WHAT DO YOU WANT THIS SPACE TO BE? AND WE HAD AT THAT TIME APPROXIMATELY OVER 400 PEOPLE ENGAGED, AND THEN IN THE SPRING OR MORE PARTICULARLY IN FEBRUARY OF THIS YEAR, WE SHARED OUT DRAFT CONCEPT PLANS FOR THE GREENWAY AGAIN, INCLUDING BOTH IN-PERSON AND ONLINE OPPORTUNITIES TO GET ENGAGED, AND HAD AN ESTIMATED 516 PEOPLE ENGAGED AT THAT POINT AND THEN MORE RECENTLY IN APRIL, ONCE THE FEEDBACK WAS INCORPORATED INTO THOSE DRAFT CONCEPTS PARTNERED WITH SOME COMMUNITY ORGANIZATIONS SUCH AS MATTHEW 25, CEDAR RAPIDS PARKS FOUNDATION, AS WELL AS ECO FEST TO SHOWCASE THE FINAL DRAFT CONCEPTS, AND WHAT WE HEARD FROM THAT FEEDBACK WERE SOME KEY THEMES AROUND EMBRACING AND CELEBRATING NATURAL FEATURES, PLANTING NATIVE PLANTINGS, CREATING OPPORTUNITIES FOR TREES AND SHADE, AS WELL AS OPEN SPACE, A CONNECTING TO THE RIVER AND PROVIDING OPPORTUNITIES FOR WATER ACTIVITIES.

OF COURSE, CONTINUING TO EXPAND THE CITY'S TRAIL SYSTEM, PUBLIC ART PROGRAM CREATE OPPORTUNITIES FOR DOG PARK OR BIKE SKILLS COURSE AND THEN DESIRE FOR VARIOUS TYPES OF EVENTS AND PROGRAMMING OPPORTUNITIES, AND THEN IN TERMS OF FEELING, WE ASKED, WHAT DO PEOPLE WHAT DO YOU WANT TO FEEL WHEN YOU ARE AT THE GREENWAY AND WE HEARD RELAXATION PLAY IN SOLITUDE, AND THEN FINALLY I JUST WANT TO HIGHLIGHT OVERWHELMINGLY, I THINK FROM EVERYBODY THAT WE TALKED TO WAS A GENERAL EXCITEMENT, APPRECIATION.

SO THESE WERE DEVELOPED BASED ON SOME OF THE FEEDBACK THAT WE RECEIVED, AS WELL AS RECOMMENDATION AND BEST PRACTICE FROM OUR CONSULTANT TEAM, AND THESE DESIGN PRINCIPLES WERE TO CONNECT PEOPLE TO THE RIVER, BALANCE TRADITIONAL AND WILD SETTINGS, INTEGRATE CIRCULATION WITH THE LEVEE, BUILD CONNECTIVITY AND UPLIFT ECOLOGY. SO ON THE RIGHT HAND SIDE OF THE SCREEN ARE JUST TWO EXAMPLES OF THOSE DESIGN PRINCIPLES AND PRACTICE, IN WHICH THERE'S AN OPPORTUNITY TO RELAX SOME OF THE SLOPES TO PROVIDE ACCESS AND VIEWS OF THE RIVER, AND THEN, OF COURSE, WITH THE FLOOD CONTROL SYSTEM KIND OF SEPARATING OR CUTTING IN HALF THE TIME CHECK GREENWAY CONNECTING BOTH SIDES AND CREATING KIND OF DISTINCT FEELS AND OPPORTUNITIES FOR AMENITIES, BUT AT THE SAME TIME REALLY MAKING SURE THAT THE EXPERIENCE IS SEAMLESS AND NATURAL AS PEOPLE NAVIGATE THROUGHOUT THE SPACE.

SO THE FACT THAT THIS IS WHAT OUR FUTURE LOOKS LIKE YOU KNOW, THE FACT THAT WE PROVED THIS WEEKEND HOW THE FLOOD MITIGATION MATTERS ARE EFFECTIVE AND ARE WORKING WHEN THOSE WATERS RISE, BECAUSE THEY CAN HAPPEN QUICKLY, AND SO, YOU KNOW, WE'VE BEEN BLESSED WITH REALLY LOW WATER RATES FOR AN EXTENDED AMOUNT OF TIME BUT THEN IT COMES BACK AND, YOU KNOW, IT'S KIND OF ALWAYS THERE.

THIS GETS US FURTHER TOWARDS ALL OF THOSE CONCURRENT AND COMPOUNDING GOALS THAT JUST GETS US TO A MUCH BETTER CITY, AND ONE OF THE IMPORTANT THINGS THAT I WOULD JUST CALL OUT AS WELL WE HAVE HAD IN THAT.

AFTER COLLEGE, I WORKED FOR A $15 BILLION NATIONAL RETAILER AND SERVED IN A VARIETY OF SENIOR LEADERSHIP ROLES.

I CAN UNDERSTAND THOUGH I DO NOT SUPPORT WHEN BIG CORPORATIONS MAKE DECISIONS LIKE HY-VEE'S DECISION.

WHAT I FIND SO PROBLEMATIC ABOUT THE HY-VEE CHOICE, THOUGH, IS THAT THEY LET THE COUNCIL AND THE COMMUNITY BELIEVE THAT THEY WERE RENEWING THEIR INVESTMENT IN OUR COMMUNITY WHEN THEY SIGNED A FIVE YEAR LEASE JUST LAST FALL, AND THEN THEY ANNOUNCED THEIR INCREDIBLY RAPID DEPARTURE AND DIVESTITURE FROM OUR COMMUNITY WITH LESS THAN TWO MONTHS NOTICE.

IT IS IMPOSSIBLE FOR A CITY OR A NEIGHBORHOOD TO RECRUIT A REPLACEMENT GROCERY AND PHARMACY IN SUCH A SHORT TIME.

SO THIS AMOUNTS TO WHAT I FIND TO BE A CALLOUS CREATION OF A FOOD DESERT RIGHT HERE IN OUR OWN COMMUNITY.

WHAT HAPPENS IN ONE NEIGHBORHOOD HAPPENS TO US ALL.

I'M SIMILARLY SADDENED THAT HY-VEE COMMUNICATED VERY LITTLE UNDERSTANDING OR REGARD FOR THE COMMUNITIES IN WHICH THEY ARE LOCATED.

WHEN THEY SUGGESTED THAT RESIDENTS WOULD BE OKAY BECAUSE THEY COULD ORDER ONLINE WITH NEARLY A $10 FEE EACH TIME.

HY-VEE HAS LONG ASKED FOR OUR LOYALTY GIVEN THEIR CORPORATION PRACTICES, EMPLOYEE OWNERSHIP, TREATMENT OF CUSTOMERS AND EMPLOYEES AND THE LIKE, AND I HAVE BEEN GLAD TO GIVE THEM MY LOYALTY FOR THOSE REASONS.

RECENT CHANGES IN THE HY-VEE CORPORATION, HOWEVER, ARE CAUSING ME TO RETHINK MY LOYALTIES.

THE SPECIFIC ACTIONS THAT HY-VEE HAS TAKEN WITH REGARD TO THE FIRST AVENUE LOCATION ARE NOT INDICATIVE OF A CORPORATION THAT I BELIEVE ACTS AS A GOOD CORPORATE CITIZEN,
