AND SO THE CITY OF CEDAR RAPIDS PROCLAMATION, WHEREAS THE FAIR HOUSING ACT ENABLED ON APRIL 13TH, 19, APRIL 11TH, 1968 WAS ENSHRINED. INTO FEDERAL LAW TO PROHIBIT DISCRIMINATORY HOUSING PRACTICES, UNDO RACIAL SEGREGATION PATTERNS, AND PROVIDE EQUITABLE ACCESS TO HOUSING FOR ALL. AND WHEREAS FAIR HOUSING MONTH PROVIDES AN OPPORTUNITY TO REFLECT ON OUR PROGRESS AND ACKNOWLEDGE REMAINING CHALLENGES. SO CHAPTER 60A, SURVEILLANCE CAMERAS FOR BUSINESSES, WAS ORIGINALLY DRAFTED ABOUT 10 YEARS AGO AS IT IS RIGHT NOW. SO 10 YEARS, A LOT OF THINGS CHANGE IN TECHNOLOGY. SO WE ARE PROPOSING TO REPEAL THE EXISTING CHAPTER AND REPLACE IT WITH AN UPDATED 60A, SURVEILLANCE CAMERAS FOR BUSINESSES. THE MAIN THINGS THE REVISED ORDINANCE UPDATES ARE THE KEY DEFINITIONS, [00:10:01] MODERNIZES THE VIDEO SYSTEM STANDARDS, AND CLARIFIES THE VIOLATIONS AND ENFORCEMENT PROCEDURES. AND THESE UPDATES ARE NECESSARY TO ALIGN THE ORDINANCE WITH CURRENT TECHNOLOGY STANDARDS AND ENSURE IT REMAINS RELEVANT AND EFFECTIVE. SO ONE OF THE BIG CHANGES WE MADE IS THE DEFINITION OF A VIDEO SURVEILLANCE SYSTEM. AT THE TIME THIS WAS WRITTEN, THE STANDARD WAS DVR SYSTEMS. NOW, MOST EVERYBODY HAS CLOUD-BASED SYSTEMS. THE ORDINANCE, AS IT WAS WRITTEN, DIDN'T ALLOW FOR CLOUD-BASED SYSTEMS. WITH THAT BEING WHAT MOST OF OUR BUSINESSES USE, WE WANT TO ACCOMMODATE THAT OPTION SO THAT WAY THEY CAN USE CLOUD-BASED SYSTEMS. ANOTHER CHANGE THAT WE ARE PROPOSING TO MAKE IS AT THE TIME THE ORDINANCE WAS WRITTEN, AN AFTER-HOURS BUSINESS WAS NOT DEFINED. NOW, THAT IS A PERMITTED BUSINESS THAT HAS TO GO THROUGH PERMITTING THROUGH THE CITY. WE HAVE TWO AFTER-HOURS BUSINESSES THAT CURRENTLY ARE PERMITTED BY THE CITY. BOTH OF THESE BUSINESSES CURRENTLY MEET OR ACTUALLY EXCEED THE STANDARDS THAT WE'RE PUTTING FORTH IN THE UPDATED ORDINANCE. THE OTHER TYPE OF BUSINESS THAT REALLY DIDN'T EXIST AT THE TIME THE ORDINANCE WAS WRITTEN WAS THE SMOKE AND VAPE SHOPS. SINCE THEY HAVE SIMILAR RISKS AS OUR ALCOHOL AND TOBACCO SHOPS, WE FELT THAT IT WAS ONLY FAIR TO ADD THEM TO THE ORDINANCE. ONCE AGAIN, MOST OF THESE BUSINESSES ARE NEW ENOUGH THAT... THEY HAVE SYSTEMS THAT EXCEED THE PROPOSED CHANGES TO THE ORDINANCE. ANOTHER CHANGE IS JUST WITH THE CHANGES AT THE STATE LEVEL, CHANGING WHERE SOME OF THESE BUSINESSES FALL UNDER, SUCH AS LIQUOR LICENSES NOW FALL UNDER THE STATE'S DEPARTMENT OF REVENUE. WE JUST UPDATED DEFINITIONS THAT WAY THOSE STATE, AS STATE DEFINITIONS CHANGE. WE ARE OKAY WITH NOT HAVING TO UPDATE THE ORDINANCE. ANOTHER THING WE DID, AND THIS WAS AFTER CONSULTING WITH SOME OF THE BUSINESSES, IS THEY ARE PROVIDING HIGHER DEFINITION SYSTEMS, WHICH MEANS MORE STORAGE SPACE. AND ONE OF THEIR PUSHBACKS WAS WHY DURING TIMES THAT THERE'S NO EMPLOYEES OR PATRONS PRESENT, WHY WOULD THEY NEED TO RECORD? WHY COULDN'T THEY GO MOTION ACTIVATED DURING THOSE CLOSED BUSINESS HOURS? WE FELT IT WAS ONLY FAIR, ESPECIALLY WITH THEM PROVIDING HIGHER DEFINITION COVERAGE ON THEIR OWN, THAT IF THEY WANT TO DROP TO MOTION ACTIVATED SYSTEMS AT THE TIME THAT THE BUSINESSES ARE CLOSED, THAT'S A VERY REASONABLE ACCOMMODATION. THE NEXT AREA WE GOT INTO WAS THE ENFORCEMENT AND CIVIL PENALTY SIDE. WE OPTED TO TAKE MORE OF A PUSH FOR COMPLIANCE RATHER THAN ENFORCEMENT. SO ONE OF THE THINGS WE DID WAS ALIGN THE TIMEFRAMES WITH WHAT IS ALREADY IN EXISTENCE WITH OUR SAFECR NUISANCE PROGRAM. THAT WAY PEOPLE HAVE AMPLE CHANCE TO APPEAL IF THEY ARE FOUND IN VIOLATION. THEY HAVE TIME TO ALSO CREATE A PLAN OF ACTION, WHICH I'LL COVER HERE IN A MINUTE. JUST BROADENING THAT TIMEFRAME FOR THE BUSINESS AND ALSO PROVIDING CLARITY BECAUSE THE... TIMEFRAMES ARE THE SAME WITH OUR SAFECR NUISANCE PROGRAM AND ALSO THE VIDEO SURVEILLANCE PROGRAM. SO THE PLAN OF ACTION. SO THIS WAS NOT IN PLACE AT THE TIME THAT THE ORDINANCE WAS DRAFTED 10 YEARS AGO. ONCE AGAIN, OUR PUSH IS FOR COMPLIANCE RATHER THAN ENFORCEMENT. SO WE WOULD RATHER IF A BUSINESS IS FOUND OUT OF COMPLIANCE FOR THEM TO PRESENT A PLAN OF ACTION OF HOW THEY ARE GOING TO GET INTO COMPLIANCE. WE ALSO REALIZE THAT IN ORDER TO UPDATE A SYSTEM, IT'S NOT CHEAP. AND SO SOMETIMES THEY NEED TIME TO HAVE TO CREATE A BUDGET FOR IT. AND SO WE WANT TO ALLOW THAT WIGGLE ROOM. ONCE AGAIN, OUR EMPHASIS IS ON COMPLIANCE RATHER THAN THE ENFORCEMENT. SO TODAY WE'RE HAVING THE PUBLIC HEARING AND FIRST READING. OUR HOPE IS TO HAVE SECOND AND POSSIBLE THIRD READING ON APRIL 14TH. OVER THE SUMMER, OUR PLAN IS TO UTILIZE THE SCHOOL RESOURCE OFFICERS, WHO OBVIOUSLY AREN'T IN SCHOOL, TO PROVIDE THE EDUCATION TO OUR AREA BUSINESSES. TO HOPEFULLY GET THEM IN COMPLIANCE PRIOR TO THEM HAVING AN INCIDENT ON THEIR PROPERTY. WITH THAT BEING SAID, WE PROPOSE THAT CHAPTER 60A SHOULD BE REPEALED AND REPLACED WITH THE NEW SURVEILLANCE CAMERAS FOR BUSINESSES. ALL RIGHT. SO THAT'S ONE QUESTION, BILL, IF YOU CAN ANSWER WHAT'S HAPPENING WITH THAT. AND THEN WE HAVE THE CATHOLIC SCHOOLS GO BUY TOYOTA FINANCIAL, AND THEY'RE GOING TO PUT A $40 MILLION MIDDLE SCHOOL THERE. SO TRAFFIC IS GOING TO INCREASE WITH TWO SCHOOLS. THAT'S NOT A CONVENIENCE STORE, TWO SCHOOLS. THAT COULD BE SIZABLE, BUILDING GYMS. OUTDOOR ATHLETIC FIELDS, AND EVERYTHING ELSE. THE CITY OF CEDAR RAPIDS DOES NOT PAY A DIME. HE HAS TO BUILD IT, PAY THE TAXES, HE GETS A PIECE OF IT BACK, WHICH IS ALWAYS A MISCONCEPTION ON THESE KIND OF PROPERTIES. PLUS, EACH OF THESE PROPERTIES, HE HAS TO COME, AND THEY HAVE TO MEET OUR NEW DESIGN STANDARDS, WATER DETENTION, LIGHTING, TREES, TRAFFIC. MY ASSUMPTION, AS WE HAD BEFORE A YEAR AGO, AND WITH... AND THEN, AS YOU MENTIONED, A PORTION OF THAT GETS REBATED BACK TO THE PROPERTY OWNER. AND IN A LOT OF CASES, WHETHER IT'S MULTIFAMILY RESIDENTIAL OR OTHER PROJECTS, YOU KNOW, THOSE ARE NEEDED TO HELP PUT IN INFRASTRUCTURE OR ESSENTIALLY MAKE THE PRO FORMA WORK. WITH EACH INDIVIDUAL LOT, THEY WILL HAVE TO SUBMIT. SO LET'S SAY THEY SELL IT TO SOMEONE OR THEY LEASE IT TO SOMEONE, WHOMEVER IS GOING TO DO THE DEVELOPMENT WILL HAVE TO GO THROUGH ZONING AND MEET ALL OF THE DESIGN STANDARDS, LANDSCAPING STANDARDS, ALL THESE TYPES OF THINGS THAT ARE INCORPORATED INTO THE ZONING CODE. AND IN THAT TRAFFIC STUDY, THERE ARE THRESHOLDS FOR... VOLUME TRAFFIC VOLUMES SO TRAFFIC COUNTS AND THERE ARE LEVELS OF SERVICE AS WELL AND AS THOSE ARE IMPACTED BECAUSE WE KEEP TRAFFIC COUNTS AT THE CITY THEY HIT THOSE THRESHOLDS THERE WILL NEED TO BE IMPROVEMENTS TO 42ND AND ORLAND, FOR EXAMPLE, EDGEWOOD ROAD AND 42ND. ABOUT THAT PROPERTY, WHICH IS WHY IT'S NOT INCLUDED IN THE DEVELOPMENT AGREEMENT AT THIS POINT. YOU KNOW, IF AND IF THE SCHOOL DEVELOPS THERE, OF COURSE, SCHOOL DOES NOT GENERATE PROPERTY TAXES, WOULD NOT BE A PART OF OF THE DEVELOPMENT AGREEMENT. AND THEN AS FAR AS THE STORMWATER GOES, THEY, LIKE ALL DEVELOPMENTS, HAVE TO TAKE CARE OF STORMWATER ON SITE. AND SO. SOMEONE COMMENTED THAT THERE WAS A STORMWATER DETENTION POND. THAT IS ACCURATE. I'M HERE TO UPDATE YOU ON A VOLUNTEER EXPERIENCE WITH COMMUNITY DEVELOPMENT STAFF AND TO CHALLENGE YOU. BOTH ELECTED OFFICIALS AND CITY STAFF, TO DEVELOP A BETTER COMMUNICATION MODEL AND CLEAR WRITTEN STANDARDS FOR SUPPORTING NEIGHBORHOOD ASSOCIATIONS AND ALL VOLUNTEERS. I SERVED AS PRESIDENT OF OAK HILL JACKSON NEIGHBORHOOD ASSOCIATION FOR THREE YEARS. DEALING WITH COMMUNITY DEVELOPMENT AND CITY ATTORNEY STAFF WAS LESS THAN A POSITIVE EXPERIENCE. YOU MAY REMEMBER THAT I SPOKE BEFORE THIS COUNCIL IN JUNE 2025. AFTER COMMUNITY DEVELOPMENT STAFF INFORMED THE ASSOCIATION'S DULY ELECTED BOARD THAT IT WOULD NO LONGER BE RECOGNIZED AS THE NEIGHBORHOOD ASSOCIATION AND WOULD ALSO NOT BE REIMBURSED FOR EXPENSES THAT OUR MEMBERS HAD APPROVED. FORTUNATELY, AFTER THAT MEETING, THE ISSUE WAS RESOLVED AND THE DULY ELECTED BOARD WAS ABLE TO DISPERSE ITS REMAINING FUNDS PER THE MEMBERS' VOTES, OR SO I HAD BELIEVED UNTIL MARCH 12TH. ON MARCH 12TH, AT AN AD HOC NEIGHBORHOOD MEETING, I HANDED BETSY BORCHARDT ANOTHER CEASE AND DESIST LETTER, CONFISCATED AN ASSOCIATION SIGN, AND REITERATED THAT NO GROUP HAD PERMISSION TO USE THE ASSOCIATION'S SIGNAGE AND LOGO. JANE KILGALLEN, THE SELF-APPOINTED, RATHER THAN ELECTED, PRESIDENT OF THE AD HOC GROUP, NOW CALLING ITSELF FRIENDS OF OAK HILL JACKSON OR SOMETHING LIKE THAT, HAS REPEATEDLY TOLD ME THAT THE CITY INFORMED HER THAT THE CITY OWNED THE LOGO AND SIGNAGE BELONGING TO OAK HILL JACKSON NEIGHBORHOOD ASSOCIATION BECAUSE THEY PAID FOR IT. 12TH, BETSY B. TOLD ME IN PERSON THAT MS. KILGALLEN HAD THE RIGHT TO USE THE LOGO AND SIGNAGE BECAUSE THE INTENT WAS FOR IT TO BE USED FOR THE GOOD OF THE NEIGHBORHOOD. I FOLLOWED UP BY CALLING THE CITY ATTORNEY'S OFFICE ON MARCH 13TH REQUESTING A CALLBACK. NO CALLBACK WAS RECEIVED, SO I EMAILED THE OFFICE ON MARCH 17TH. FINALLY, I RECEIVED A BRIEF EMAIL FROM AN ASSISTANT CITY ATTORNEY TELLING ME TO SPEAK TO THAT OFFICE ABOUT THE ASSOCIATION MATTER, AND THAT WAS IT. THIS MATTER HAS GONE ON FOR FAR TOO LONG. I'M NOT AN ATTORNEY, SO PLEASE BEAR WITH ME. AND THAT'S NOT A DIG AT MR. HOGUE. BUT I CAN FIND NO EVIDENCE THAT THERE WAS ANY CONTRACT, VERBAL OR WRITTEN, BETWEEN THE NON-PROFIT AND THE CITY STATING THAT ANY PROPERTY, PHYSICAL ITEMS, INTELLECTUAL PROPERTY OR TRADEMARK, ETC., PURCHASED BY THE NON-PROFIT FOR WHICH THE NON-PROFIT HAD BEEN REIMBURSED SUBSEQUENTLY BELONGED TO THE CITY. OAK HILL JACKSON NEIGHBORHOOD ASSOCIATION WAS A NON-PROFIT CORPORATION REGISTERED WITH THE STATE OF IOWA SECRETARY OF STATE'S OFFICE FOR DECADES. OAK HILL JACKSON NEIGHBORHOOD ASSOCIATION WAS NOT A BOARD OR COMMISSION ESTABLISHED BY THE CITY OF CEDAR RAPIDS. AS SUCH, THE CITY OF CEDAR RAPIDS COMMUNITY DEVELOPMENT STAFF HAS NO AUTHORITY TO INTERFERE WITH THE NON-PROFIT'S OPERATION. IF COMMUNITY DEVELOPMENT STAFF HAD IN JUNE 2025. SIMPLY ADVISED THE AD HOC GROUP THAT ITS ELECTION HADN'T FOLLOWED THE NONPROFITS BYLAWS, WHICH IT DIDN'T. A SECOND LEGITIMATE ELECTION COULD HAVE BEEN SCHEDULED WITH PROPER NOTICE GIVEN TO ALL MEMBERS AND A NEW ELECTION HELD TO CREATE A DULY ELECTED BOARD. SUCH A BOARD COULD HAVE TAKEN OVER THE NONPROFIT ON JULY 1ST, 2025, WITH THE EXISTING BOARD'S BLESSING AND ASSISTANCE. AND THE LOGO. I ASK THAT THIS ISSUE BE REVIEWED AND RESOLVED PROMPTLY AND THAT COMMUNITY DEVELOPMENT STAFF CEASE ADVISING ANY INDIVIDUAL OR GROUP THAT THEY HAVE A RIGHT TO USE OAK HILL JACKSON NEIGHBORHOOD ASSOCIATION'S NAME, LOGO, AND SIGNAGE. SO YOU'RE GOING TO ASK YOURSELVES, WHY DO I CARE, RIGHT? SECONDLY, THE NEIGHBORHOOD ASSOCIATION SYSTEM CURRENTLY IN PLACE IS POORLY STRUCTURED WITH VERY LITTLE GUIDANCE FOR VOLUNTEERS. STAFF'S PREFERENCE APPEARS TO BE TO SUPPORT NEIGHBORHOOD ASSOCIATIONS WITH LONG-TIME LEADERSHIP THAT DOESN'T CHANGE AND ADAPT TO NEIGHBORHOOD NEEDS. WHEN YOU WEAPONIZE THE CEDAR RAPIDS POLICE TO SILENCE WHISTLEBLOWERS LIKE MELISSA DUFFIELD, WILL FRAZIER, AND MYSELF, WHILE TELLING VICTIMS THAT THEY HAVE NO RIGHTS UNTIL AN ARREST IS MADE, YOU ARE BREAKING THE LAW.
